18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Sarah Debbink 4
22	22	Langenkamp Active Transportation Safety Act’’. 5
23	23	SEC. 2. HIGHWAY SAFETY IMPROVEMENT PROGRAM. 6
24	24	(a) H
25	25	IGHWAYSAFETYIMPROVEMENT PROJECT.— 7
26	26	Section 148(a)(4)(B) of title 23, United States Code, is 8
27	27	amended— 9

32	32	(xxviii)’’ and inserting ‘‘through (xxx)’’; 2
33	33	(2) by redesignating clause (xxix) as clause 3

35	35	(3) by inserting after clause (xxviii) the fol-5
36	36	lowing: 6
37	37	‘‘(xxix) The connection of 2 or more 7
38	38	segments of existing bicyclist or pedestrian 8
39	39	infrastructure. 9
40	40	‘‘(xxx) The reduction of safety risks to 10
41	41	vulnerable road users through a project or 11
42	42	strategy described in a program of projects 12
43	43	or strategies developed pursuant to sub-13
44	44	section (l)(2)(B).’’. 14

50	50	N GENERAL.—Section 148(j) of title 23, 17
51	51	United States Code, is amended— 18
52	52	(A) by striking ‘‘Except as provided in sec-19
53	53	tions 120 and 130’’ and inserting the following: 20
54	54	‘‘(1) I
55	55	N GENERAL.—Except as provided in sec-21
56	56	tions 120 and 130 and paragraph (2)’’; and 22
57	57	(B) by adding at the end the following: 23

59	59	XCEPTION.—Notwithstanding any other 24
60	60	provision of law, the Federal share of the cost of a 25

65	65	funds apportioned to a State under section 2
66	66	104(b)(3) may be up to 100 percent if the project 3
67	67	is a project described in clause (xxix) or (xxx) of 4
68	68	subsection (a)(4)(B).’’. 5

70	70	LEXIBLE FINANCING.—Section 133(h)(7) 6
71	71	of title 23, United States Code, is amended— 7
72	72	(A) by redesignating subparagraph (C) as 8
73	73	subparagraph (E); and 9
74	74	(B) by striking subparagraph (B) and in-10
75	75	serting the following: 11
76	76	‘‘(B) F
77	77	LEXIBLE FINANCING .—Notwith-12
78	78	standing section 120— 13
79	79	‘‘(i) the non-Federal share for a 14
80	80	project under this subsection may be cal-15
81	81	culated on a project, multiple-project, or 16
82	82	program basis; and 17
83	83	‘‘(ii) the Federal share of the cost of 18
84	84	an individual project under this subsection 19
85	85	may be up to 100 percent. 20

87	87	REATMENT AS NON -FEDERAL 21
88	88	SHARE.—Notwithstanding any other provision 22
89	89	of law, funds made available to carry out sec-23
90	90	tion 148 may be credited toward the non-Fed-24

96	96	‘‘(i) the project includes a Proven 3
97	97	Safety Countermeasure for bicyclists or pe-4
98	98	destrians, as determined by the Federal 5
99	99	Highway Administration; 6
100	100	‘‘(ii) the relevant State strategic high-7
101	101	way safety plan includes an emphasis area 8
102	102	related to vulnerable road users; or 9
103	103	‘‘(iii) the proposed project— 10
104	104	‘‘(I) was described in a program 11
105	105	of projects or strategies developed 12
106	106	pursuant to section 148(l); or 13
107	107	‘‘(II) was identified by a local 14
108	108	government, metropolitan planning or-15
109	109	ganization, or regional transportation 16
110	110	planning organization, including in a 17
111	111	safety plan described in subparagraph 18
112	112	(D), as addressing 1 or more areas of 19
113	113	high risk to vulnerable road users 20
114	114	during the consultation process re-21
115	115	quired under section 148(l)(4)(B) and 22
116	116	through a planning process and data- 23
117	117	based analysis. 24

126	126	‘‘(ii) a Complete Streets plan; 6
127	127	‘‘(iii) a local roadway safety plan; 7
128	128	‘‘(iv) a Vision Zero Action Plan; 8
129	129	‘‘(v) a transition plan described in 9
130	130	section 35.150(d) of title 28, Code of Fed-10
131	131	eral Regulations (or successor regulations) 11
132	132	(commonly known as an ‘ADA Transition 12
133	133	Plan’); 13
134	134	‘‘(vi) a Tribal transportation safety 14
135	135	plan; 15
136	136	‘‘(vii) a comprehensive safety action 16
137	137	plan (as defined in section 24112(a) of the 17
138	138	Infrastructure Investment and Jobs Act 18
139	139	(23 U.S.C. 402 note; Public Law 117– 19
140	140	58)); or 20
141	141	‘‘(viii) any other safety plan, as deter-21
142	142	mined by the Secretary.’’. 22
