A BILL
To amend title 23, United States Code, with respect to
the highway safety improvement program, and for other
purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Sarah Debbink 4
Langenkamp Active Transportation Safety Act’’. 5
SEC. 2. HIGHWAY SAFETY IMPROVEMENT PROGRAM. 6
(a) H
IGHWAYSAFETYIMPROVEMENT PROJECT.— 7
Section 148(a)(4)(B) of title 23, United States Code, is 8
amended— 9

(1) in clause (xxix), by striking ‘‘through 1
(xxviii)’’ and inserting ‘‘through (xxx)’’; 2
(2) by redesignating clause (xxix) as clause 3
(xxxi); and 4
(3) by inserting after clause (xxviii) the fol-5
lowing: 6
‘‘(xxix) The connection of 2 or more 7
segments of existing bicyclist or pedestrian 8
infrastructure. 9
‘‘(xxx) The reduction of safety risks to 10
vulnerable road users through a project or 11
strategy described in a program of projects 12
or strategies developed pursuant to sub-13
section (l)(2)(B).’’. 14

(1) I
N GENERAL.—Section 148(j) of title 23, 17
United States Code, is amended— 18
(A) by striking ‘‘Except as provided in sec-19
tions 120 and 130’’ and inserting the following: 20
‘‘(1) I

tions 120 and 130 and paragraph (2)’’; and 22
(B) by adding at the end the following: 23
‘‘(2) E
XCEPTION.—Notwithstanding any other 24
provision of law, the Federal share of the cost of a 25

highway safety improvement project carried out with 1
funds apportioned to a State under section 2
104(b)(3) may be up to 100 percent if the project 3
is a project described in clause (xxix) or (xxx) of 4
subsection (a)(4)(B).’’. 5
(2) F
LEXIBLE FINANCING.—Section 133(h)(7) 6
of title 23, United States Code, is amended— 7
(A) by redesignating subparagraph (C) as 8
subparagraph (E); and 9
(B) by striking subparagraph (B) and in-10
serting the following: 11
‘‘(B) F
LEXIBLE FINANCING .—Notwith-12
standing section 120— 13
‘‘(i) the non-Federal share for a 14
project under this subsection may be cal-15
culated on a project, multiple-project, or 16
program basis; and 17
‘‘(ii) the Federal share of the cost of 18
an individual project under this subsection 19
may be up to 100 percent. 20
‘‘(C) T
REATMENT AS NON -FEDERAL 21
SHARE.—Notwithstanding any other provision 22
of law, funds made available to carry out sec-23
tion 148 may be credited toward the non-Fed-24

eral share of the costs of a project under this 1
subsection if— 2
‘‘(i) the project includes a Proven 3
Safety Countermeasure for bicyclists or pe-4
destrians, as determined by the Federal 5
Highway Administration; 6
‘‘(ii) the relevant State strategic high-7
way safety plan includes an emphasis area 8
related to vulnerable road users; or 9
‘‘(iii) the proposed project— 10
‘‘(I) was described in a program 11
of projects or strategies developed 12
pursuant to section 148(l); or 13
‘‘(II) was identified by a local 14
government, metropolitan planning or-15
ganization, or regional transportation 16
planning organization, including in a 17
safety plan described in subparagraph 18
(D), as addressing 1 or more areas of 19
high risk to vulnerable road users 20
during the consultation process re-21
quired under section 148(l)(4)(B) and 22
through a planning process and data- 23
based analysis. 24

‘‘(D) SAFETY PLANS DESCRIBED .—A safe-1
ty plan referred to in subparagraph (C)(iii)(II) 2
is— 3
‘‘(i) a pedestrian or bicyclist safety 4
plan; 5
‘‘(ii) a Complete Streets plan; 6
‘‘(iii) a local roadway safety plan; 7
‘‘(iv) a Vision Zero Action Plan; 8
‘‘(v) a transition plan described in 9
section 35.150(d) of title 28, Code of Fed-10
eral Regulations (or successor regulations) 11
(commonly known as an ‘ADA Transition 12
Plan’); 13
‘‘(vi) a Tribal transportation safety 14
plan; 15
‘‘(vii) a comprehensive safety action 16
plan (as defined in section 24112(a) of the 17
Infrastructure Investment and Jobs Act 18
(23 U.S.C. 402 note; Public Law 117– 19
58)); or 20
‘‘(viii) any other safety plan, as deter-21
mined by the Secretary.’’. 22

NCREASED FEDERAL SHARE FOR PROVEN 23
SAFETY COUNTERMEASURES .—Section 120(c)(1) of 24
title 23, United States Code, is amended, in the first 25
