2525 SEC. 2. STATE OF RESIDENCE. 6

2727 EFINITIONS.—Section 921 of title 18, United 7

2929 (1) in subsection (a)— 9

3737 ‘‘(i) the State in which an individual re-5

3939 ‘‘(ii) in the case of an individual, or spouse 7
4040 of an individual, who is an active duty member 8
4141 of the Armed Forces— 9
4242 ‘‘(I) the State in which the permanent 10
4343 duty station of the member is located; and 11
4444 ‘‘(II) the State in which the member 12
4545 maintains a place of abode from which the 13
4646 member commutes each day to the perma-14
4747 nent duty station of the member; or 15
4848 ‘‘(iii) in the case of an individual who does 16
4949 not have a physical residence in any State, the 17
5050 State in which an individual maintains a private 18
5151 mailbox or post office box. 19
5252 ‘‘(B) For purposes of subparagraph (A)(i)— 20
5353 ‘‘(i) an individual resides in a State if the 21
5454 individual is present in the State with the inten-22
5555 tion of making a home in that State; and 23
5656 ‘‘(ii) an individual who maintains a home 24
5757 in more than 1 State is a resident of each such 25
