Us Congress Senate Bill SJR46

Introduced
4/4/25

Caption

A joint resolution providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule submitted by the Environmental Protection Agency relating to "California State Motor Vehicle and Engine Pollution Control Standards; Heavy-Duty Vehicle and Engine Emission Warranty and Maintenance Provisions; Advanced Clean Trucks; Zero Emission Airport Shuttle; Zero-Emission Power Train Certification; Waiver of Preemption; Notice of Decision".

Impact

If passed, SJR46 would effectively eliminate the EPA's rule on California's emissions standards, thereby impacting the state's ability to enforce its pioneering environmental regulations on air quality and vehicle emissions. This resolution reflects a broader pushback against state-specific environmental policies that aim to combat pollution and climate change at a local level. The actions taken by Congress through SJR46 may set a precedent for how federal and state environmental regulations interact going forward.

Summary

SJR46 is a joint resolution that aims to disapprove a rule submitted by the Environmental Protection Agency (EPA) concerning California's motor vehicle and emission standards. The resolution specifically targets regulations related to heavy-duty vehicle emissions, advanced clean trucks, and zero-emission power trains. The intention behind disapproval is to undermine the EPA's authority to enforce these specific regulations, which are considered more stringent than federal standards.

Contention

The bill arises amid significant contention around state versus federal regulatory powers, particularly in the realm of environmental policy. Supporters argue that disapproving the EPA's rule is necessary to maintain consistency in federal regulations and to prevent states from setting standards that could disadvantage businesses operating across state lines. Conversely, opponents contend that this action undermines California's leadership in environmental protection, limiting state capabilities to implement policies that address local air quality issues effectively.
