4047 38Be it enacted by the Legislature of the state of Utah:
4148 39 Section 1. Section 51-9-902 is amended to read:
4249 40 51-9-902. Outdoor Adventure Infrastructure Restricted Account.
4350 41 (1) As used in this section, "outdoor recreation infrastructure" means:
4451 42 (a) an unpaved trail, trail head infrastructure, signage, or crossing infrastructure for
4552 43recreation, regardless of whether the recreation is motorized or nonmotorized recreation;
4653 44 (b) a campground or day-use recreation site;
4754 45 (c) water recreation infrastructure, including a pier, dock, or boat ramp; or
4855 46 (d) outdoor recreation facilities that are accessible to visitors with disabilities.
4956 47 (2) There is created within the General Fund a restricted account known as the
5057 48"Outdoor Adventure Infrastructure Restricted Account."
5158 49 [(2)] (3) The account shall consist of:
5259 50 (a) money deposited into the account under Subsection 59-12-103(16); and
5360 51 (b) interest and earnings on money in the account.
5461 52 [(3)] (4) Subject to appropriation from the Legislature, money from the account shall
5562 53be used for:
5663 54 (a) new construction of outdoor recreation infrastructure;
5764 55 (b) upgrades of outdoor recreation infrastructure;
58-56 (c) the replacement of or structural improvements to outdoor recreation infrastructure;

67+57 (d) the acquisition of land, a right-of-way, or easement used in relationship to outdoor
6168 58recreation infrastructure; or
6269 59 (e) providing access from state highways, as defined in Section 72-1-102, to outdoor
6370 60recreation infrastructure.
6471 61 (5) For each fiscal year, beginning with fiscal year 2023-2024, the Division of Finance
6572 62shall, subject to appropriation by the Legislature, distribute money from the Outdoor Adventure
6673 63Infrastructure Restricted Account as follows:
6774 64 (a) at least 15% to the Department of Natural Resources - Division of State Parks -
6875 65Capital, to be expended using the department's existing prioritization process for capital
6976 66projects in state parks described in Subsection (4);
7077 67 (b) at least 22% to the Department of Natural Resources - Division of Outdoor
7178 68Recreation - Capital, to be expended for competitive Recreation Restoration Infrastructure
7279 69grants or Outdoor Recreational Infrastructure grants for outdoor recreation capital projects and
7380 70related maintenance expenses, where maintenance expenses do not exceed 15% of the
7481 71appropriation; and
7582 72 (c) at least 53% to the Department of Natural Resources - Division of Outdoor
7683 73Recreation - Capital, to be expended for larger outdoor recreation infrastructure projects as
7784 74recommended to the Legislature by the Outdoor Adventure Commission described in
7885 75Subsection (4).
7986 76 [(4)] (6) If the Legislature appropriates money to the Department of Transportation
8087 77from the account, the Transportation Commission, created in Section 72-1-301, shall prioritize
8188 78projects and determine funding levels in accordance with Subsection 72-1-303(1)(a) based on
8289 79recommendations of the Department of Transportation.
8390 80 Section 2. Section 63C-21-201 is amended to read:

8592 82 (1) There is created the Outdoor Adventure Commission consisting of the following

127134 122reappointment, adjust the length of terms to ensure that the terms of commission members are
128135 123staggered so that approximately half of the commission members appointed under Subsections

130137 125 (d) An individual may be appointed to more than one term.
131138 126 (4) (a) Eight commission members constitutes a quorum.
132139 127 (b) The action of a majority of a quorum constitutes an action of the commission.
133140 128 (5) (a) The salary and expenses of a commission member who is a legislator shall be
134141 129paid in accordance with Section 36-2-2, Legislative Joint Rules, Title 5, Chapter 2, Lodging,
135142 130Meal, and Transportation Expenses, and Legislative Joint Rules, Title 5, Chapter 3, Legislator

137144 132 (b) A commission member who is not a legislator may not receive compensation or
138145 133benefits for the member's service on the commission, but may receive per diem and
139146 134reimbursement for travel expenses incurred as a commission member at the rates established by

163170 157consultation and assistance that the division may reasonably request.

166173 160 To the extent money is available, the division shall administer outdoor recreation grants

170177 164 (3) off-highway vehicle incentives;
171178 165 (4) boat access and clean vessels;
172179 166 (5) land, water, and conservation; [and]

174181 168 (7) maintenance projects related to the above allowable uses.

202209 195fiscal year 2024. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
203210 196Act, the Legislature appropriates the following sums of money from the funds or accounts
