1515 8General Description:
1616 9 This bill prohibits the use of certain statements or materials by a state entity to
1717 10determine employment, admission, or other benefits.

3636 27Be it enacted by the Legislature of the state of Utah:
3737 28 Section 1. Section 53B-27-502 is enacted to read:
3838 29 53B-27-502. Prohibition on use of certain submissions in higher education --
3939 30Exceptions.
4040 31 (1) (a) As used in this section, "prohibited submission" means a submission, statement,
41-32or document that requires a person to articulate the person's  º [personal] »  beliefs or position
42-32aon a
41+32or document that requires a person to articulate the person's personal beliefs or position on a
4342 33policy or initiative that promotes differential treatment based on race, color, ethnicity, sex,
4443 34national origin, or age.
4544 35 (b) "Prohibited submission" includes a submission, statement, or document that relates
4645 36to a policy, program, or initiative regarding:
4746 37 (i) diversity, equity, and inclusion;
4847 38 (ii) anti-racism;
4948 39 (iii) implicit bias; or
5049 40 (iv) critical race theory.
5150 41 (c) "Prohibited submission" does not include a submission, statement, or document if:
5251 42 (i) the job title for the position includes a phrase listed in Subsections (1)(b)(i) through
5352 43(iv); and
5453 44 (ii) the submission, statement, or document relates to a bona fide occupational
5554 45qualification for the position.
5655 46 (2) An institution may not request a prohibited submission as a certification or
5756 47condition prior to taking action with respect to:
5857 48 (a) employment, including decisions regarding:
5958 49 (i) hiring;
6059 50 (ii) terms of employment;
6160 51 (iii) benefits;
6261 52 (iv) seniority status;
6362 53 (v) tenure;
6463 54 (vi) promotion;
6564 55 (vii) transfer; or

6867 57 (b) admission to or graduation from the institution or an academic program; or
6968 58 (c) qualification for or receipt of state financial aid or other state financial assistance.
7069 59 (3) An institution may not grant any form of preferential consideration to a person who,
7170 60without solicitation from the institution, provides a prohibited submission for consideration for
7271 61any action described in Subsection (2).

8884 74 (1) (a) As used in this section, "prohibited submission" means a submission, statement,

10499 88 (2) An LEA or district school may not request a prohibited submission as a
105100 89certification or condition prior to taking action with respect to:
106101 90 (a) employment, including decisions regarding:
107102 91 (i) hiring;
108103 92 (ii) terms of employment;
109104 93 (iii) benefits;
110105 94 (iv) seniority status;
111106 95 (v) tenure;
112107 96 (vi) promotion;
113108 97 (vii) transfer; or
114109 98 (viii) appointment;
115110 99 (b) admission to or graduation from the LEA or district school; or
116111 100 (c) qualification for or receipt of state financial aid or other state financial assistance.
117112 101 (3) An LEA or district school may not grant any form of preferential consideration to a
118113 102person who, without solicitation from the LEA or district school, provides a prohibited
119114 103submission for consideration for any action described in Subsection (2).

160151 139 (ii) terms of employment;
161152 140 (iii) benefits;
162153 141 (iv) seniority status;
163154 142 (v) tenure;
164155 143 (vi) promotion;
165156 144 (vii) transfer; or
166157 145 (viii) appointment; or
167158 146 (b) admissions and aid, including:
168159 147 (i) admission to any state program or course;
169160 148 (ii) financial or other forms of state-administered aid or assistance; and
