42	41		Be it resolved by the Legislature of the state of Utah:

44	43		WHEREAS, counties in Utah contract with the Department of Corrections to provide

46	45		prison bed space for state prisoners;

48	47		WHEREAS, this contracting arrangement has proved beneficial to both the state and the

50	49		counties by saving taxpayers from the burden of building new state correctional facilities

52	51		while, at the same time, assisting counties to meet their own correctional space needs;

54	53		WHEREAS, in accordance with Utah Code Subsection 64-13e-103(6), the Department of

56	55		Corrections may not enter into a contract with a county to house state inmates unless the

60	59		beds to be contracted, the approximate amount of a county's long-term debt, and the repayment

64	63		WHEREAS, the Department of Corrections is authorized to contract for 165 beds in

66		-	addition to the current 35 beds in Iron County;

68	67		WHEREAS, the correctional facility that will house the inmates in Iron County has

70	69		$87,500,000 in facility debt, and the repayment time for the debt for the facility is a 40-year

74	73		WHEREAS, Iron County will have sufficient facilities and beds to accommodate additional

76	75		state inmates and has met the requirements of Utah Code Subsection 64-13e-103(6); and

78	77		WHEREAS, contracting with the Department of Corrections for additional jail bed space

80	79		would assist the state in addressing projected bed space and treatment needs:

82	81		NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah approves

84	83		contracting for beds in the correctional facility located in Iron County in the amount specified

88	87		BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Iron County

90	89		Commission and the Department of Corrections.
