General Description:

This resolution supports contracting for beds for state inmates at the Iron County
6 
correctional facility.

Highlighted Provisions:

This resolution:

▸ supports jail expansion as beneficial to both the state and the counties through a contract

with the Department of Corrections; and

▸ approves contracting for additional beds dedicated to housing state inmates in Iron

County.

Be it resolved by the Legislature of the state of Utah:
19 
       WHEREAS, counties in Utah contract with the Department of Corrections to provide
20 
prison bed space for state prisoners;
21 
       WHEREAS, this contracting arrangement has proved beneficial to both the state and the
22 
counties by saving taxpayers from the burden of building new state correctional facilities
23 
while, at the same time, assisting counties to meet their own correctional space needs;
24 
       WHEREAS, in accordance with Utah Code Subsection 64-13e-103(6), the Department of
25 
Corrections may not enter into a contract with a county to house state inmates unless the
26 
Legislature has previously passed a joint resolution that includes the approximate number of H.J.R. 3	Enrolled Copy
27 
beds to be contracted, the approximate amount of a county's long-term debt, and the repayment
28 
time of the debt for the facility where inmates are to be housed;
29 
       WHEREAS, the Department of Corrections is authorized to contract for 165 beds in
30 
addition to the current 35 beds in Iron County;
31 
       WHEREAS, the correctional facility that will house the inmates in Iron County has
32 
$87,500,000 in facility debt, and the repayment time for the debt for the facility is a 40-year
33 
period starting in 2024;
34 
       WHEREAS, Iron County will have sufficient facilities and beds to accommodate additional
35 
state inmates and has met the requirements of Utah Code Subsection 64-13e-103(6); and
36 
       WHEREAS, contracting with the Department of Corrections for additional jail bed space
37 
would assist the state in addressing projected bed space and treatment needs:

       NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah approves
39 
contracting for beds in the correctional facility located in Iron County in the amount specified
40 
in this resolution.

       BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Iron County
42 
Commission and the Department of Corrections.
