242242 (e) a model method for creating individual student learning targets, and a method of

244244 measuring an individual student's performance toward those targets;

246246 (f) progress-based assessments for ongoing performance evaluations of school districts

250250 (g) incentives to achieve the desired outcome of individual student progress in core

252252 academics that do not create disincentives for setting high goals for the students;

516516 provided for in state board rule to determine whether certain mandates or requirements

518518 could be waived to remove funding pressures on public schools on a temporary basis.

524524 board may, in accordance with the rules described in Subsection (8)(c):

530530 (ii) temporarily or permanently withhold state funds from the education entity;

538538 Subsection (8)(a), the state board shall pay the funds into the Uniform School Fund.

544544 (i) that require notice and an opportunity to be heard for an education entity affected

551551 (d)(i) An individual may bring a violation of statute or state board rule to the

553553 attention of the state board in accordance with a process described in rule adopted

559559 the process described in Subsection (8)(d)(i), the state board may take action in

561561 accordance with this section.

563563 (e) The state board shall report criminal conduct of an education entity to the district

565565 attorney of the county where the education entity is located.

567567 (9) The state board may audit the use of state funds by an education entity that receives

569569 those state funds as a distribution from the state board.

571571 (10) The state board may require, by rule made in accordance with Title 63G, Chapter 3,

573573 Utah Administrative Rulemaking Act, that if an LEA contracts with a third party

575575 contractor for an educational good or service, the LEA shall require in the contract that

577577 the third party contractor shall provide, upon request of the LEA, information necessary

579579 for the LEA to verify that the educational good or service complies with:

581581 (a) this public education code; and

583583 (b) state board rule authorized under this public education code.

585585 (11)(a) The state board may appoint an attorney to provide legal advice to the state

587587 board and coordinate legal affairs for the state board and the state board's employees.

589589 (b) An attorney described in Subsection (11)(a) shall cooperate with the Office of the

593593 (c) An attorney described in Subsection (11)(a) may not:

595595 (i) conduct litigation;

597597 (ii) settle claims covered by the Risk Management Fund created in Section 63A-4-201;

603603 (12) The state board shall ensure that any training or certification that an employee of the

605605 public education system is required to complete under this title or by rule complies with

607607 Title 63G, Chapter 22, State Training and Certification Requirements.

609609 (13)(a) The state board shall:

611611 (i) in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act,

613613 establish a process to receive complaints regarding an education entity's violation

615615 of state statute;

617617 (ii) review each complaint the state board receives to determine if the complaint

620620 presents a credible potential violation of state statute;

622622 (iii) if the state board determines that a complaint presents a credible potential

626626 (A) authorize an investigation;

628628 (B) review the results of the investigation and any corresponding evidence in a

630630 meeting of the state board; and

632632 (C) report to the Legislature's Rules Review and General Oversight Committee

634634 regarding the complaint, investigation, and any further action described in

636636 Subsection (13)(b) or (c); and

638638 (iv) if the state board determines that a complaint does not present a credible

640640 potential violation of state statute, take no further action and close the matter.

642642 (b) In reviewing the results of an investigation and the corresponding evidence under

644644 Subsection (13)(a), if the state board finds that the relevant education entity has
645645 317
646646 violated state statute, the state board shall require the education entity to, on or before
647647 318
648648 a date that the state board specifies, review the complaint and associated investigation
649649 319
650650 at a public meeting of the relevant local governing board to:

652652 (i) review any findings from an internal investigation the education entity conducts;
653653 321
654654 (ii) determine a course of action, if any, to remedy the violation, including any
655655 322
656656 remedies that the state board suggests; and

658658 (iii) require the education entity to report the education entity's findings or remedies
659659 324
660660 described in Subsection (13)(b)(ii) to the state board.

662662 (c) After the education entity completes the report described in Subsection (13)(b), the

664664 state board shall vote in a meeting of the state board to:

666666 (i) take no further action and close the matter; or

668668 (ii) take further corrective action, including:

670670 (A) withholding funds;

672672 (B) if applicable, directing an investigation or review by the Utah Professional
673673 331
674674 Practices Advisory Commission under Section 53E-6-506;

676676 (C) requiring additional reporting or monitoring;

678678 (D) referring the complaint, evidence, and findings to the attorney general's office

680680 or the relevant district attorney's office;

682682 (E) requiring the education entity to hire a third-party provider to provide services

686686 (F) requiring reimbursement from the education entity instead of future allocations

719719 (C) the Family Educational Rights and Privacy Act, 20 U.S.C. Sec. 1232g; and

721721 (D) any other state or federal law protecting the privacy of an employee of an
