88 AN ACT to create 632.32 (6) (d) of the statutes; relating to: prohibiting motor

1212 This bill prohibits motor vehicle insurance policies from insuring against
1313 liability for exposing a person to, or infecting a person with, an infectious disease
1414 while occupying a motor vehicle.  Under the bill, “infectious disease” includes a
1515 sexually transmitted disease or communicable disease.
1616 The people of the state of Wisconsin, represented in senate and assembly, do
1717 enact as follows:
1818 SECTION 1. 632.32 (6) (d) of the statutes is created to read:
1919 632.32 (6) (d)  No policy may insure against liability for exposing a person to,
2020 or infecting a person with, an infectious disease while occupying a motor vehicle.  In
2121 this paragraph, “infectious disease” includes a sexually transmitted disease, as
2222 defined in s. 252.11 (1), or communicable disease, as defined in s. 990.01 (5g).

3232 SECTION 2 ASSEMBLY BILL 1009
3333 SECTION 2.0Initial applicability.
3434 (1)  This act first applies to a motor vehicle insurance policy that is issued or
3535 renewed on the effective date of this subsection.
3636 SECTION 3.0Effective date.
3737 (1)  This act takes effect on the first day of the 7th month beginning after
3838 publication.
