2023 Assembly Bill 1024 Assembly Amendment 1 
CURRENT LAW 
Current law requires school districts to mail a notice letter to parents when a student qualifies as 
habitually truant, which means the student has had five unexcused absences during a semester. The 
letter must include the following information: (1) a statement that the parent must have the student 
attend regularly; (2) a statement that the parent may request program or curriculum modifications; (3) 
a statement that the student may be eligible for a program for children at risk; (4) a request that the 
parent meet with school personnel; and (5) a statement of the potential penalties for failing to have the 
student attend school regularly. 
2023 ASSEMBLY BILL 1024 
Assembly Bill 1024 requires the parent notification letter to include additional information for parents 
regarding evaluation for special education services. Specifically, the letter must include a statement 
informing parents that they may ask for an evaluation of whether the student is a child with a disability, 
or may ask to have an existing individualized education program (IEP) reviewed or revised. 
ASSEMBLY AMENDMENT 1 
Assembly Amendment 1 adds further required information to the parent notification letter. Under the 
amendment, a parent notification letter must state that a parent may correct an unexcused absence by 
providing documentation to the school district demonstrating that the absence is excused.  
BILL HISTORY 
Assembly Amendment 1 was offered by Representative Binsfeld on February 7, 2024. On February 14, 
2024, the Assembly Committee on Education adopted the amendment on a vote of Ayes, 11; Noes, 4. 
The committee then passed the bill, as amended, on a vote of Ayes, 9; Noes, 6.
