15 | 15 | | days during a semester. Under current law, the definition is a pupil who is absent |

16 | 16 | | without an acceptable excuse for part or all of a day for at least five school days during |

17 | 17 | | a semester. Current law requires the school attendance officer for a school district |
---|
18 | 18 | | to notify a pupil's parent or guardian when a child initially becomes a habitual truant |

19 | 19 | | and include in the notice various information related to compulsory school |
---|
20 | 20 | | attendance. Current law also authorizes counties, cities, villages, and towns to enact |
---|
21 | 21 | | an ordinance that prohibits individuals who are younger than 18 years of age from |
---|
22 | 22 | | being habitual truants. Such ordinances may provide for various dispositions listed |
---|
23 | 23 | | in current law, including the suspension of the child's driver's license; an order for |
---|
24 | 24 | | the child to participate in counseling, a supervised work program, or other |
---|
25 | 25 | | community service work; an order for the child's parent, guardian, or legal custodian |
---|
26 | 26 | | to participate in counseling at their own expense or to attend school with the child; |
---|
27 | 27 | | an order to attend school; and a forfeiture. |
---|
28 | 28 | | The bill also changes the definition of truancy to mean an absence that is more |

29 | 29 | | than one-third of one or more days from school for which the school is not notified |

40 | 40 | | SECTION 1. 118.16 (1) (a) of the statutes is amended to read: |

41 | 41 | | 118.16 (1) (a) “Habitual truant" means a pupil who is absent from school |

42 | 42 | | without an acceptable excuse under sub. (4) and s. 118.15 for part or all of more than |
---|
43 | 43 | | one-third of a day for 5 or more days on which school is held during a school semester. |

44 | 44 | | SECTION 2. 118.16 (1) (c) of the statutes is amended to read: |

45 | 45 | | 118.16 (1) (c) “Truancy" means any absence of part or all that is more than |

46 | 46 | | one-third of one or more days from school during which the school attendance officer, |
---|
47 | 47 | | principal, or teacher has not been notified of the legal cause of such absence by the |
---|
48 | 48 | | parent or guardian of the absent pupil, and also means intermittent attendance |
---|
49 | 49 | | carried on for the purpose of defeating the intent of s. 118.15. |

50 | 50 | | SECTION 3.0Effective date. |
