99 AN ACT to create 46.995 (2g) (c) and 46.995 (2m) of the statutes; relating to:

1212 Under current law, the Department of Health Services is required to determine
1313 the amount of contribution that a county is required to maintain based on historical
1414 county expenditures for the Children's Long-Term Support program and may
1515 require counties to maintain a specified level of contribution for the program. This
1616 bill sunsets the current funding methodology after December 31, 2024, and requires
1717 DHS, in cooperation with counties, to review county contributions and develop a
1818 revised funding methodology for the Children's Long-Term Support program to take
1919 effect on January 1, 2025. In developing a revised funding methodology, the bill
2020 prohibits DHS from requiring counties to maintain any level of contribution. The
2121 Children's Long-Term Support program is a program operating under a waiver of
2222 federal Medicaid law to provide home and community-based services to children
2323 with disabilities. The Children's Long-Term Support program is referred to as the
2424 disabled children's long-term support program in the bill.

2727 The people of the state of Wisconsin, represented in senate and assembly, do
2828 enact as follows:

3333 SECTION 1. 46.995 (2g) (c) of the statutes is created to read:
3434 46.995 (2g) (c) This subsection does not apply after December 31, 2024.
3535 SECTION 2. 46.995 (2m) of the statutes is created to read:
3636 46.995 (2m) (a) Beginning on the effective date of this paragraph .... [LRB
3737 inserts date], the department shall cooperate with counties to review county
3838 contributions under sub. (2g) and develop a revised funding methodology for the
3939 disabled children's long-term support program.
4040 (b) In developing a revised funding methodology under par. (a), the department
4141 may not require a county to maintain any level of contribution for the disabled
4242 children's long-term support program.
4343 (c) The revised funding methodology under par. (a) shall take effect on January
4444 1, 2025.
4545 SECTION 3.0Nonstatutory provisions.
4646 (1) No later than June 1, 2024, the department of health services shall report
4747 to the appropriate standing committees of the legislature, as determined by the
4848 speaker of the assembly and the president of the senate, in the manner provided
4949 under s. 13.172 (3), and to the joint committee on finance the amount and source of
5050 moneys that may be reallocated following implementation of the revised funding
5151 methodology under s. 46.995 (2m) (a).
