AN ACT to repeal 66.0409; and to amend 175.60 (2g) (a) and 895.527 (5) (b) of
the statutes; relating to: eliminating the preemption on local government
regulation of firearms.
Analysis by the Legislative Reference Bureau
Current law preempts a political subdivision from regulating the sale,
purchase, purchase delay, transfer, ownership, use, keeping, possession, bearing,
transportation, licensing, permitting, registration, or taxation of any firearm,
firearm part, ammunition, or knife in a manner that is more stringent than under
state statute.  This bill eliminates the preemption so that a political subdivision may
regulate such activity in a manner that is more stringent than under state statute.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1.  66.0409 of the statutes is repealed.
SECTION 2.  175.60 (2g) (a) of the statutes is amended to read:
175.60 (2g) (a)  A licensee or an out-of-state licensee may carry a concealed
weapon anywhere in this state except as provided by local ordinance or resolution

or as provided under subs. (15m) and (16) and ss. 943.13 (1m) (c) and 948.605 (2) (b)

SECTION 3.  895.527 (5) (b) of the statutes is amended to read:
895.527 (5) (b)  Section 66.0409 (3) (b) or any Any ordinance or resolution.
