The bill also requires that every hospital must inform medical students, nursing students, persons providing nursing care, other persons authorized to perform pelvic examinations, and physicians supervising any of these individuals, of the informed consent policy and must take appropriate action to discipline any individual who violates the policy or instructs a medical student, a nursing student, or a person providing nursing care to conduct an examination in violation of the policy. ASSEMBLY SUBSTITUTE AMENDMENT 1 The substitute amendment replaces the bill with a requirement that a hospital ensure written informed consent is obtained from a patient before a pelvic exam is performed on the patient solely for educational purposes while the patient is under general anesthesia or otherwise unconscious. The substitute amendment also creates a Department of Health Services administrative rule that provides that a hospital must maintain written policies and procedures requiring written informed consent to be obtained from a patient before a pelvic exam is performed on the patient solely for educational purposes while the patient is under general anesthesia or otherwise unconscious.
