11	11	AN ACT to create 50.373 of the statutes; relating to: requiring informed consent
12	12	before performing a pelvic examination on a patient who is under general
13	13	anesthesia or unconscious.

15	15	This bill requires hospitals to have and enforce a policy requiring written and
16	16	verbal informed consent to be obtained from a patient before a medical student, a
17	17	nursing student, any person providing nursing care, or any other person authorized
18	18	to perform pelvic examinations may perform a pelvic examination on a patient who
19	19	is under general anesthesia or otherwise unconscious. Under the bill, every hospital
20	20	must also inform medical students, nursing students, persons providing nursing
21	21	care, other persons authorized to perform pelvic examinations, and physicians
22	22	supervising any of these individuals of the informed consent policy and must take
23	23	appropriate action to discipline any individual who violates the policy or instructs
24	24	a medical student, a nursing student, or a person providing nursing care to conduct
25	25	an examination in violation of the policy.
26	26	The people of the state of Wisconsin, represented in senate and assembly, do
27	27	enact as follows:
28	28	SECTION 1. 50.373 of the statutes is created to read:

35	35	50.373 Informed consent for pelvic examinations. (1) In this section,
36	36	“nursing care” includes professional nursing, as defined in s. 441.001 (4), and
37	37	practical nursing, as defined in s. 441.001 (3).
38	38	(2) Every hospital shall have and enforce a policy that requires written and
39	39	verbal informed consent to be obtained from a patient before a medical student, a
40	40	nursing student, any person providing nursing care, or any other person authorized
41	41	to perform pelvic examinations may perform a pelvic examination on a patient who
42	42	is under general anesthesia or otherwise unconscious.
43	43	(3) Every hospital shall inform medical students, nursing students, persons
44	44	providing nursing care, any other person authorized to perform pelvic examinations,
45	45	and physicians supervising any of these individuals of the policy required under this
46	46	section and shall take appropriate action to discipline any individual who violates
47	47	the policy or instructs a medical student, a nursing student, any person providing
48	48	nursing care, or any other person authorized to perform pelvic examinations to
49	49	conduct an examination in violation of the policy.
