17 | 17 | | Under current law, it is a Class C felony for a person who is a licensee, employee, |
---|
18 | 18 | | or nonclient resident of an entity that provides various welfare, foster, adoption, and |
---|
19 | 19 | | health services, including a hospital, to have sexual contact or sexual intercourse |
---|
20 | 20 | | with a client of the entity. Under some but not all circumstances, this prohibition |
---|
21 | 21 | | applies to various health care providers and their clients. Under this bill, it is also |
---|
22 | 22 | | a Class C felony for a health care provider to have sexual contact or sexual |
---|
23 | 23 | | intercourse with a client. |
---|
24 | 24 | | Under current law, with some exceptions, a person is required to register as a |
---|
25 | 25 | | sex offender for certain crimes that are sexually motivated. Under the bill, the new |
---|
26 | 26 | | offense of sexual contact or sexual intercourse by a health care provider is subject to |
---|
27 | 27 | | this provision. |
---|
28 | 28 | | Because this bill creates a new crime or revises a penalty for an existing crime, |
---|
29 | 29 | | the Joint Review Committee on Criminal Penalties may be requested to prepare a |
---|
30 | 30 | | report. |

31 | 31 | | The people of the state of Wisconsin, represented in senate and assembly, do |
