11	11	AN ACT to amend 50.03 (14) (c) 1.; and to create 46.284 (4) (km) of the statutes;
12	12	relating to: notification of certain facility closures, change in type or level of
13	13	services or means of reimbursement accepted, and care management
14	14	organization notification of contract termination with a provider that is a
15	15	nursing home or community-based residential facility.

17	17	This bill requires, before a resident of a nursing home or community-based
18	18	residential facility (CBRF) is required to be relocated, that the nursing home or
19	19	CBRF provide 90 days' written notice to a resident, to the resident's guardian, if any,
20	20	and to a member of the resident's family, if practicable, unless the resident requests
21	21	that notice to the family be withheld. Under current law, a nursing home or CBRF
22	22	must provide only 30 days' written notice prior to relocation to each resident who is
23	23	to be relocated. The bill also requires that when terminating a contract with a
24	24	provider that is a nursing home or CBRF, a care management organization must
25	25	similarly provide at least 90 days' written notice of the termination to the provider
26	26	and to the resident, to the resident's guardian, if any, and to a member of the

35	35	be withheld.
36	36	The people of the state of Wisconsin, represented in senate and assembly, do
37	37	enact as follows:
38	38	SECTION 1. 46.284 (4) (km) of the statutes is created to read:
39	39	46.284 (4) (km) When terminating a contract with a provider that is a nursing
40	40	home or community-based residential facility, provide at least 90 days' written
41	41	notice of the termination to the provider, to any resident who is to be relocated, to the
42	42	resident's guardian, if any, and to a member of the resident's family, if practicable,
43	43	unless the resident requests that notice to the family be withheld.
44	44	SECTION 2. 50.03 (14) (c) 1. of the statutes is amended to read:
