AN ACT to renumber 118.07 (1); and to create 118.07 (1) (b) of the statutes;
relating to: supplying anti-choking devices in schools.
Analysis by the Legislative Reference Bureau
Current law requires every school board and the governing body of every
private school to provide a standard first aid kit for use in cases of emergency.  This
bill requires school boards and governing bodies of private schools to make
accessible, as part of a first aid kit, an anti-choking device that is registered as a
Class I or Class II medical device with the United States Food and Drug
Administration. The bill also requires school boards and the governing bodies of
private schools to annually provide training on the use of anti-choking devices
according to the device manufacturer's instructions.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1.  118.07 (1) of the statutes is renumbered 118.07 (1) (a).
SECTION 2.  118.07 (1) (b) of the statutes is created to read:
118.07 (1) (b)  Every school board and the governing body of every private school
shall, as part of a first aid kit provided under par. (a), make accessible an

anti-choking device that is registered as a class I or class II medical device with the
federal food and drug administration and shall annually provide training for school
staff on the use of the anti-choking device according to the device manufacturer's
instructions.
