Wisconsin Legislative Council ACT MEMO One Ea st Ma in Stre e t, Suite 401 • Ma dison, W I 53703 • (608) 266-1304 • le g.council@le gis.wisconsin.gov • http://www.le gis.wisconsin.gov/lc Prepared by: Peggy Hurley, Senior Staff Attorney December 8, 2023 2023 Wisconsin Act 61 [2023 Assembly Bill 166] Definition of “Sexual Contact” Current law defines certain intentional acts as “sexual contact” for the purposes of crimes against children and the crime of sexual assault, if done either for the purpose of sexually degrading or sexually humiliating the victim (complainant) or sexually arousing or gratifying the defendant. 2023 Wisconsin Act 61 adds the following to the definition of “sexual contact” for the purposes of crimes against children and the crime of sexual assault: touching by the complainant of the ejaculate, urine, or feces of any person upon the intentional instructions of the defendant, upon the use or threat of force or violence by the defendant, or upon an intentional act of the defendant.
