4-AN ACT to amend 101.022; and to create 440.041 of the statutes; relating to: biennial report on various metrics
5-related to the issuance of occupational credentials.
6-The people of the state of Wisconsin, represented in
7-senate and assembly, do enact as follows:
8-JOINT LEGISLATIVE COUNCIL PREFATORY NOTE:  This bill
9-was prepared for the Joint Legislative Council’s Study Com-
10-mittee on Occupational Licenses.
11-The bill requires the Department of Safety and Profes-
12-sional Services (DSPS) to include the following information
13-in its biennial report to the Legislature, for the time period
14-since the prior report:
15- The number of applications for initial, renewal, and
16-reciprocal credentials received by DSPS and any credential-
17-ing board, and the number of those credentials granted and
18-issued. DSPS must also separately report these numbers for
19-each profession.
20-The lowest, highest, and median number of days
21-from the day that an application for initial, renewal, or recip-
22-rocal credential is initiated to the date that a final determina-
23-tion is made. DSPS must also separately report these num-
24-bers for applications in the health professions, business
25-professions, trades professions, all other professions, and
26-each profession individually.
27-The median number of contacts made to and
28-received from an applicant for an initial, renewal, or recipro-
29-cal credential before a final determination on the applicant’s
30-credential is issued. DSPS must also separately report these
31-numbers for each profession.
32-The number of applications for initial, renewal, and
33-reciprocal credentials for which DSPS or a credentialing
34-board requested more information. DSPS must also sepa-
35-rately report these numbers for each profession.
36-The number of applications for initial, renewal, and
37-reciprocal credentials that required DSPS or a credentialing
38-board to review an arrest, conviction, or other offense
39-record. DSPS must also separately report these numbers for
40-each profession.
41-SECTION 1.  101.022 of the statutes is amended to
42-read:
43-101.022  Certain laws applicable to occupational
44-licenses.  Sections 440.03 (1), (3m), (4), (11m), and (13)
45-(a), (am), and (b) 75., 440.041, 440.05 (1) (a) and (2) (b),
46-440.075, 440.09 (2), 440.11, 440.12, 440.121, 440.13,
47-440.14, 440.15, 440.19, 440.20 (1), (3), (4) (a), and (5)
48-(a), 440.205, 440.21, and 440.22, and the requirements
49-imposed on the department under those statutes, apply to
50-occupational licenses, as defined in s. 101.02 (1) (a) 2.,
51-in the same manner as those statutes apply to credentials,
52-as defined in s. 440.01 (2) (a).
53-SECTION 2.  440.041 of the statutes is created to read:
54-440.041  Biennial report on issuance of creden-
55-tials.  The department shall, in its report under s. 15.04 (1)
56-(d), include all of the following covering the time period
57-since the previous report:
58-(1)  The number of applications for initial credentials,
59-the number of applications for the renewal of a credential,
60-and the number of applications for a reciprocal credential
61-that were received by the department and by any creden-
62-tialing board and the number of initial credentials, the
63-number of renewed credentials, and the number of recip-
64-rocal credentials granted and issued.  The department
65-shall separately report for each profession the number of

68-applications for initial credentials, the number of applica-
69-tions for the renewal of a credential, and the number of
70-applications for a reciprocal credential that were received
71-and the number of initial credentials, the number of
72-renewed credentials, and the number of reciprocal cre-
73-dentials granted and issued.
74-(2)  The lowest, highest, and median number of days
75-from the day that an application for an initial credential
76-is initiated by an applicant to the date that a final determi-
77-nation on the application is made; the lowest, highest, and
78-median number of days from the day that an application
79-for the renewal of a credential is initiated by an applicant
80-to the date that a final determination on the application is
81-made; and the lowest, highest, and median number of
82-days from the day that an application for a reciprocal cre-
83-dential is initiated by an applicant to the date that a final
84-determination on the application is made.  The depart-
85-ment shall separately report the lowest, highest, and
86-median number of days for all such applications in the
87-health professions, business professions, trade profes-
88-sions, all other professions, and each profession individu-
89-ally.
90-(3)  The median number of contacts made to and
91-received from an applicant for an initial credential, the
92-median number of contacts made to and received from an
93-applicant for the renewal of a credential, and the median
94-number of contacts made to and received from an appli-
95-cant for a reciprocal credential before a final determina-
96-tion on the applicant’s application is issued.  The depart-
97-ment shall separately report for each profession the
98-median number of contacts made to and received from an
99-applicant for an initial credential, the median number of
100-contacts made to and received from an applicant for the
101-renewal of a credential, and the median number of con-
102-tacts made to and received from an applicant for a recip-
103-rocal credential before a final determination on the appli-
104-cant’s application is issued.
105-(4)  The number of applications for an initial creden-
106-tial, the number of applications for the renewal of a cre-
107-dential, and the number of applications for a reciprocal
108-credential submitted for which the department or a cre-
109-dentialing board requested more information.  The
110-department shall separately report for each profession the
111-number of applications for an initial credential, the num-
112-ber of applications for the renewal of a credential, and the
113-number of applications for a reciprocal credential for
114-which the department or a credentialing board requested
115-more information.
116-(5)  The number of applications for an initial creden-
117-tial, the number of applications for the renewal of a cre-
118-dential, and the number of applications for a reciprocal
119-credential that required the department or a credentialing
120-board to review an arrest or conviction record or any
121-other offense if the offense is reviewable by the depart-
122-ment or credentialing board that issues the credential.
123-The department shall separately report for each profes-
124-sion the number of applications for an initial credential,
125-the number of applications for the renewal of a credential,
126-and the number of applications for a reciprocal credential
127-that required the department or a credentialing board to
128-review an arrest or conviction record or any other offense
129-if the offense is reviewable by the department or creden-
130-tialing board that issues the credential.
