2023 WISCONSIN ACT
AN ACT to amend 101.022; and to create 440.041 of the statutes; relating to: biennial report on various metrics
related to the issuance of occupational credentials.
The people of the state of Wisconsin, represented in
senate and assembly, do enact as follows:
JOINT LEGISLATIVE COUNCIL PREFATORY NOTE: This bill
was prepared for the Joint Legislative Council’s Study Com-
mittee on Occupational Licenses.
The bill requires the Department of Safety and Profes-
sional Services (DSPS) to include the following information
in its biennial report to the Legislature, for the time period
since the prior report:
The number of applications for initial, renewal, and
reciprocal credentials received by DSPS and any credential-
ing board, and the number of those credentials granted and
issued. DSPS must also separately report these numbers for
each profession.
The lowest, highest, and median number of days
from the day that an application for initial, renewal, or recip-
rocal credential is initiated to the date that a final determina-
tion is made. DSPS must also separately report these num-
bers for applications in the health professions, business
professions, trades professions, all other professions, and
each profession individually.
The median number of contacts made to and
received from an applicant for an initial, renewal, or recipro-
cal credential before a final determination on the applicant’s
credential is issued. DSPS must also separately report these
numbers for each profession.
The number of applications for initial, renewal, and
reciprocal credentials for which DSPS or a credentialing
board requested more information. DSPS must also sepa-
rately report these numbers for each profession.
The number of applications for initial, renewal, and
reciprocal credentials that required DSPS or a credentialing
board to review an arrest, conviction, or other offense
record. DSPS must also separately report these numbers for
each profession.
SECTION 1. 101.022 of the statutes is amended to
read:
101.022 Certain laws applicable to occupational
licenses. Sections 440.03 (1), (3m), (4), (11m), and (13)
(a), (am), and (b) 75., 440.041, 440.05 (1) (a) and (2) (b),
440.075, 440.09 (2), 440.11, 440.12, 440.121, 440.13,
440.14, 440.15, 440.19, 440.20 (1), (3), (4) (a), and (5)
(a), 440.205, 440.21, and 440.22, and the requirements
imposed on the department under those statutes, apply to
occupational licenses, as defined in s. 101.02 (1) (a) 2.,
in the same manner as those statutes apply to credentials,
as defined in s. 440.01 (2) (a).
SECTION 2. 440.041 of the statutes is created to read:
440.041 Biennial report on issuance of creden-
tials. The department shall, in its report under s. 15.04 (1)
(d), include all of the following covering the time period
since the previous report:
(1) The number of applications for initial credentials,
the number of applications for the renewal of a credential,
and the number of applications for a reciprocal credential
that were received by the department and by any creden-
tialing board and the number of initial credentials, the
number of renewed credentials, and the number of recip-
rocal credentials granted and issued. The department
shall separately report for each profession the number of

applications for initial credentials, the number of applica-
tions for the renewal of a credential, and the number of
applications for a reciprocal credential that were received
and the number of initial credentials, the number of
renewed credentials, and the number of reciprocal cre-
dentials granted and issued.
(2) The lowest, highest, and median number of days
from the day that an application for an initial credential
is initiated by an applicant to the date that a final determi-
nation on the application is made; the lowest, highest, and
median number of days from the day that an application
for the renewal of a credential is initiated by an applicant
to the date that a final determination on the application is
made; and the lowest, highest, and median number of
days from the day that an application for a reciprocal cre-
dential is initiated by an applicant to the date that a final
determination on the application is made. The depart-
ment shall separately report the lowest, highest, and
median number of days for all such applications in the
health professions, business professions, trade profes-
sions, all other professions, and each profession individu-
ally.
(3) The median number of contacts made to and
received from an applicant for an initial credential, the
median number of contacts made to and received from an
applicant for the renewal of a credential, and the median
number of contacts made to and received from an appli-
cant for a reciprocal credential before a final determina-
tion on the applicant’s application is issued. The depart-
ment shall separately report for each profession the
median number of contacts made to and received from an
applicant for an initial credential, the median number of
contacts made to and received from an applicant for the
renewal of a credential, and the median number of con-
tacts made to and received from an applicant for a recip-
rocal credential before a final determination on the appli-
cant’s application is issued.
(4) The number of applications for an initial creden-
tial, the number of applications for the renewal of a cre-
dential, and the number of applications for a reciprocal
credential submitted for which the department or a cre-
dentialing board requested more information. The
department shall separately report for each profession the
number of applications for an initial credential, the num-
ber of applications for the renewal of a credential, and the
number of applications for a reciprocal credential for
which the department or a credentialing board requested
more information.
(5) The number of applications for an initial creden-
tial, the number of applications for the renewal of a cre-
dential, and the number of applications for a reciprocal
credential that required the department or a credentialing
board to review an arrest or conviction record or any
other offense if the offense is reviewable by the depart-
ment or credentialing board that issues the credential.
The department shall separately report for each profes-
sion the number of applications for an initial credential,
the number of applications for the renewal of a credential,
and the number of applications for a reciprocal credential
that required the department or a credentialing board to
review an arrest or conviction record or any other offense
if the offense is reviewable by the department or creden-
tialing board that issues the credential.
