4-AN ACT to amend 440.01 (1) (dm); and to create 440.08 (2m) of the statutes; relating to: renewals of certain creden-

6-The people of the state of Wisconsin, represented in
7-senate and assembly, do enact as follows:
8-JOINT LEGISLATIVE COUNCIL PREFATORY NOTE:  This draft

10-mittee on Occupational Licenses.
11-Under current law, a two−year renewal period applies to
12-many health and business credentials administered by the
13-Department of Safety and Professional Services (DSPS) or a
14-credentialing board. The renewal date is specified by statute,
15-and is designated as the date on which a credential expires and
16-before which it must be renewed for the credential holder to
17-maintain the rights, privileges, and authority conferred by the
18-credential. The statute does not specify what it means to “be
19-renewed,” particularly whether a credential holder’s submis-
20-sion of a complete renewal application satisfies the renewal
21-requirement or whether, instead, DSPS is required to have
22-issued a determination on a renewal application.
23-The bill revises the language regarding the effect of the
24-renewal date to specify that the renewal date is the date on
25-which a credential expires and before which a credential
26-holder must submit a complete renewal application in order to
27-maintain without interruption the rights, privileges, and
28-authority conferred by the credential.
29-The bill specifies that a renewal application is considered
30-complete for purposes of satisfying the renewal requirement
31-only when the credential holder has submitted the required fee
32-and all forms and other documentation required for the
33-renewal of that credential.  A credential holder who has sub-
34-mitted a complete renewal application is also considered to
35-have made timely and sufficient application for the renewal
36-under a separate provision in state law that delays expiration
37-until the opportunity for review of a denial expires or is other-
38-wise resolved.
39-SECTION 1. 440.01 (1) (dm) of the statutes is
40-amended to read:
41-440.01 (1) (dm)  “Renewal date” means the date,
42-specified in s. 440.08 (2), on which a credential expires
43-and before which it must be renewed for the credential
44-holder must submit a complete renewal application under
45-s. 440.08 (2m) (a) in order to maintain without interrup-
46-tion the rights, privileges and authority conferred by the

50+(2) (c) and all forms and other documentation required for the renewal of that

48-SECTION 2. 440.08 (2m) of the statutes is created to
49-read:
50-440.08 (2m)  RENEWAL GENERALLY.  (a)  A renewal
51-application shall be considered complete only when the
52-credential holder has submitted the fee required under
53-sub. (2) (c) and all forms and other documentation
54-required for the renewal of that credential.

56-renewal application as provided in par. (a) has made
