1111 AN ACT relating to: a tier I license issued by the Department of Public
1212 Instruction and modifying administrative rules promulgated by the
1313 Department of Public Instruction.
1414 Analysis by the Legislative Reference Bureau
1515 Under current law, the state superintendent of public instruction must
1616 promulgate rules to license all teachers and individuals employed to provide publicly
1717 funded special education and related services in public schools. Additionally, under
1818 current law, school boards must ensure that teachers, supervisors, administrators
1919 and professional staff members hold a license or permit issued by the Department
2020 of Public Instruction. Similarly, under current law, charter school authorizers must
2121 ensure that all charter school instructional staff hold a license or permit issued by
2222 DPI.
2323 Under current DPI administrative rules, an individual is eligible for a tier I
2424 license as a clinically trained social worker issued by DPI if the individual holds 1)
2525 a master's degree in social work and 2) a valid social work certificate or license issued
2626 by the social worker section of the marriage and family therapy, professional
2727 counseling, and social work examining board. This bill creates a similar tier I license
2828 issued by DPI for clinically trained marriage and family therapists. Under the bill,
2929 an individual is eligible for such a tier I license if the individual holds 1) a master's
3030 degree in marriage and family therapy and 2) a valid marriage and family therapy
3131 certificate, training license, or clinical license issued by the marriage and family
3232 therapy section of the marriage and family therapy, professional counseling, and

3838 social work examining board. A tier I license is valid for one year but may be
3939 renewed. Under the bill, a clinically trained marriage and family therapist license
4040 may be renewed as long as the individual continues to meet the eligibility
4141 requirements for the license.
4242 The people of the state of Wisconsin, represented in senate and assembly, do
4343 enact as follows:
4444 SECTION 1. PI 34.028 (2) (f) of the administrative code is created to read:
4545 PI 34.028 (2) (f) Clinically trained marriage and family therapist.
4646 Notwithstanding par. (a), for a tier I license as a clinically trained marriage and
4747 family therapist, the applicant holds a master's degree in marriage and family
4848 therapy and a valid marriage and family therapy certificate, training license, or
4949 clinical license issued by the marriage and family therapy section of the marriage
5050 and family therapy, professional counseling, and social work examining board.
5151 SECTION 2. PI 34.028 (4) (d) of the administrative code is created to read:
5252 PI 34.028 (4) (d) A license under sub. (2) (f) may be renewed if the applicant
5353 continues to meet the requirements under sub. (2) (f) and has not yet become eligible
5454 for tier II licensure under s. PI 34.040.
5555 SECTION 3.0Effective date.
5656 (1) This act takes effect as provided in s. 227.265.
