11	11	AN ACT relating to: a tier I license issued by the Department of Public
12	12	Instruction and modifying administrative rules promulgated by the
13	13	Department of Public Instruction.
14	14	Analysis by the Legislative Reference Bureau
15	15	Under current law, the state superintendent of public instruction must
16	16	promulgate rules to license all teachers and individuals employed to provide publicly
17	17	funded special education and related services in public schools. Additionally, under
18	18	current law, school boards must ensure that teachers, supervisors, administrators
19	19	and professional staff members hold a license or permit issued by the Department
20	20	of Public Instruction. Similarly, under current law, charter school authorizers must
21	21	ensure that all charter school instructional staff hold a license or permit issued by
22	22	DPI.
23	23	Under current DPI administrative rules, an individual is eligible for a tier I
24	24	license as a clinically trained social worker issued by DPI if the individual holds 1)
25	25	a master's degree in social work and 2) a valid social work certificate or license issued
26	26	by the social worker section of the marriage and family therapy, professional
27	27	counseling, and social work examining board. This bill creates a similar tier I license
28	28	issued by DPI for clinically trained marriage and family therapists. Under the bill,
29	29	an individual is eligible for such a tier I license if the individual holds 1) a master's
30	30	degree in marriage and family therapy and 2) a valid marriage and family therapy
31	31	certificate, training license, or clinical license issued by the marriage and family
32	32	therapy section of the marriage and family therapy, professional counseling, and

38	38	social work examining board. A tier I license is valid for one year but may be
39	39	renewed. Under the bill, a clinically trained marriage and family therapist license
40	40	may be renewed as long as the individual continues to meet the eligibility
41	41	requirements for the license.
42	42	The people of the state of Wisconsin, represented in senate and assembly, do
43	43	enact as follows:
44	44	SECTION 1. PI 34.028 (2) (f) of the administrative code is created to read:
45	45	PI 34.028 (2) (f) Clinically trained marriage and family therapist.
46	46	Notwithstanding par. (a), for a tier I license as a clinically trained marriage and
47	47	family therapist, the applicant holds a master's degree in marriage and family
48	48	therapy and a valid marriage and family therapy certificate, training license, or
49	49	clinical license issued by the marriage and family therapy section of the marriage
50	50	and family therapy, professional counseling, and social work examining board.
51	51	SECTION 2. PI 34.028 (4) (d) of the administrative code is created to read:
52	52	PI 34.028 (4) (d) A license under sub. (2) (f) may be renewed if the applicant
53	53	continues to meet the requirements under sub. (2) (f) and has not yet become eligible
54	54	for tier II licensure under s. PI 34.040.
55	55	SECTION 3.0Effective date.
56	56	(1) This act takes effect as provided in s. 227.265.
