2121 This bill makes various changes to the broadband expansion grant program.
2222 Current law requires the Public Service Commission to administer the
2323 broadband expansion grant program, under which PSC designates as “underserved”
2424 areas of the state that are served by fewer than two broadband service providers and
2525 awards grants to eligible applicants for the purpose of constructing broadband
2626 infrastructure in underserved areas.  This bill changes the purpose of the grant
2727 program to constructing broadband infrastructure in “unserved areas.”  Under
2828 current law, “unserved areas” are areas not served by an Internet service provider
2929 (ISP) that 1) is a fixed wireless service or wired service and 2) provides service at
3030 actual speeds of at least 20 percent of the upload and download speeds for advanced
3131 telecommunications capability as designated by the Federal Communications

4141 Commission.  The bill adds that, in order to not be an unserved area, Internet service
4242 must be available and reliable, and provided at no less than actual download speeds
4343 of 100 megabits per second and upload speeds of 20 megabits per second.  The bill
4444 also allows PSC to adjust those speed standards every two years by rule if it
4545 determines there is good cause to do so in order to align with changes in technology
4646 and actual market conditions, in which case it must publish the adjusted speed
4747 thresholds on its website.
4848 Current law requires PSC to establish criteria for evaluating applications and
4949 awarding grants under the broadband expansion grant program and requires that
5050 the criteria give priority to projects meeting various standards, such as including
5151 matching funds and involving public-private partnerships.  Under the bill, the
5252 criteria must require applicants to participate in the FCC's Affordable Connectivity
5353 Program or any federally mandated successor program.  Under the bill, the criteria
5454 must give priority to projects with at least 40 percent matching funds and higher
5555 priority to projects with more than 40 percent matching funds.  The bill changes a
5656 requirement under current law that the criteria prioritize projects in a large
5757 geographic area to projects in a geographic area that is difficult to connect.  The bill
5858 specifies that the criteria must give priority to projects that are capable of offering
5959 service at actual download speeds of 100 megabits per second or greater and upload
6060 speeds of 100 megabits per second or greater, and higher priority to projects capable
6161 of exceeding the minimum speeds just described.
6262 Current law requires PSC to consider certain factors when evaluating an
6363 application under the broadband expansion grant program.  This bill adds that PSC
6464 must consider whether the applicant offers a low-cost broadband service option in
6565 order to be eligible for funding under the federal Broadband Equity, Access, and
6666 Deployment program or participates in the FCC's Affordable Connectivity Program
6767 or any federally mandated successor program.
6868 The bill adds a procedure by which an ISP in or near a project area proposed
6969 in an application for a broadband expansion grant may challenge the awarding of
7070 that grant.  An ISP may challenge the grant if that ISP currently provides available
7171 and reliable fixed wireless or wired broadband service to the project area at
7272 minimum download and upload speeds or if that ISP commits to completing
7373 construction of broadband infrastructure and providing available and reliable
7474 broadband service to the project area at minimum download and upload speeds no
7575 later than 24 months after the date of the PSC order awarding grants.  The bill
7676 requires PSC to evaluate the challenge and prohibits it from funding any portion of
7777 a project relating to the area that is the subject of the challenge if it determines as
7878 credible the challenging ISP's commitment to provide broadband service that meets
7979 the requirements.  If PSC denies funding as a result of such a challenge and the ISP
8080 does not fulfill its commitment, PSC is prohibited from awarding grant funding to
8181 that ISP and the ISP is prohibited from participating in the challenge process for the

8888 The people of the state of Wisconsin, represented in senate and assembly, do
8989 enact as follows:
9090 SECTION 1. 13.48 (30) (a) (intro.) and 2. of the statutes are consolidated,
9191 renumbered 13.48 (30) (a) and amended to read:
9292 13.48 (30) (a)  In this section: 2.  “Unserved, “unserved area” has the meaning
9393 given in s. 196.504 (1) (c).
9494 SECTION 2. 13.48 (30) (a) 1. of the statutes is repealed.
9595 SECTION 3. 13.48 (30) (b) of the statutes is amended to read:
9696 13.48 (30) (b)  The legislature finds and determines that the provision of
9797 broadband Internet access is essential to the welfare of the citizens of this state and
9898 to economic development in this state, and therefore the provision of broadband
9999 Internet access is a government function and a statewide responsibility of statewide
100100 dimension.  The legislature further determines that sufficient private capital has
101101 been and continues to be unavailable to fulfill the need for the development of
102102 broadband Internet access in underserved and unserved areas in this state.  It is
103103 therefore in the public interest, and it is the public policy of this state, to assist the
104104 public service commission in making broadband expansion grants under s. 196.504
105105 (2) (a) for the purpose of constructing broadband infrastructure in underserved and
106106 unserved areas of this state.
107107 SECTION 4. 24.40 (3) of the statutes is amended to read:
108108 24.40 (3)  Notwithstanding s. 28.02 (5) or any contrary rule promulgated by the
109109 department, if the department grants an easement under sub. (1r) for the
110110 construction of broadband infrastructure in underserved unserved areas, as

135135 or the payment of any fee to grant the easement.
136136 SECTION 5. 86.16 (6) of the statutes is amended to read:
137137 86.16 (6)  If the department consents under sub. (1) to the construction of
138138 broadband infrastructure in underserved unserved areas, as designated under s.
139139 196.504 (2) (d) (e), the department may not charge any fee for the initial issuance of
140140 any permit necessary to construct broadband infrastructure along, across, or within
141141 the limits of a highway.
142142 SECTION 6. 196.504 (1) (b) of the statutes is repealed.
143143 SECTION 7. 196.504 (1) (c) 2. of the statutes is renumbered 196.504 (1) (c) 2. a.
144144 and amended to read:
145145 196.504 (1) (c) 2. a.  Provided at actual speeds of at least 20 percent of the upload
146146 and download speeds for advanced telecommunications capability as designated by
147147 the federal communications commission in its inquiries regarding advanced
148148 telecommunications capability under 47 USC 1302 (b) download speeds of 100
149149 megabits per second or greater and upload speeds of 20 megabits per second or
150150 greater.
151151 SECTION 8. 196.504 (1) (c) 2. b. of the statutes is created to read:
152152 196.504 (1) (c) 2. b.  Beginning on July 1 of the 2nd calendar year beginning
153153 after the effective date of this subd. 2. b. .... [LRB inserts date], and on July 1 of each
154154 successive odd-numbered year thereafter, the commission may, by rule, adjust the
155155 threshold speeds designated in subd. 2. a. if, upon review, it determines there is good
156156 cause to do so in order to align with changes in technology and actual market
157157 conditions.  If the commission adjusts these threshold speeds, it shall publicize the
158158 adjusted speed thresholds on its website.

192192 196.504 (2) (a)  To make broadband expansion grants to eligible applicants for
193193 the purpose of constructing broadband infrastructure in underserved unserved
194194 areas designated under par. (d) (e).  Grants awarded under this section shall be paid
195195 from the appropriations under ss. 20.155 (3) (r) and (rm) and 20.866 (2) (z), in the
196196 amount allocated under s. 20.866 (2) (z) 5.
197197 SECTION 11. 196.504 (2) (c) of the statutes is renumbered 196.504 (2) (c) 1.
198198 (intro.) and amended to read:
199199 196.504 (2) (c) 1. (intro.)  To establish criteria for evaluating applications and
200200 awarding grants under this section, which shall require applicants to participate in
201201 the federal communications commission's affordable connectivity program or any
202202 federally mandated successor program.  The criteria shall prohibit grants that have
203203 the effect of subsidizing the expenses of a provider of telecommunications service, as
204204 defined in s. 182.017 (1g) (cq), or the monthly bills of customers of those providers.
205205 The criteria shall give priority to projects all of the following:
206206 a.  Projects that include at least 40 percent matching funds, and shall give
207207 higher priority to projects with more than 40 percent matching funds.
208208 b.  Projects that involve public-private partnerships, that affect unserved
209209 areas,.
210210 c.  Projects that are scalable,.
211211 d.  Projects that promote economic development,.

238238 e.  Projects that will not result in delaying the provision of broadband service
239239 to areas neighboring areas to be served by the proposed project, or.
240240 f.  Projects that affect a large geographic area that is difficult to connect or a
241241 large number of underserved unserved individuals or communities.
242242 2.  When evaluating grant applications under this section, the commission shall
243243 consider the all of the following:
244244 a.  The degree to which the proposed projects would duplicate existing
245245 broadband infrastructure, information about the presence of which is provided to the
246246 commission by the applicant or another person within a time period designated by
247247 the commission; the.
248248 b.  The impacts of the proposed projects on the ability of individuals to access
249249 health care services from home and the cost of those services; and the.
250250 c.  The impacts of the proposed projects on the ability of students to access
251251 educational opportunities from home.
252252 SECTION 12. 196.504 (2) (c) 1. g. of the statutes is created to read:
253253 196.504 (2) (c) 1. g.  Projects that are capable of offering service at actual
254254 download speeds of 100 megabits per second or greater and upload speeds of 100
255255 megabits per second or greater.  Projects that are capable of exceeding the minimum
256256 speeds described in this subd. 1. g. shall be given higher priority than projects that
257257 are capable only of meeting the minimum speeds.
258258 SECTION 13. 196.504 (2) (c) 2. d. of the statutes is created to read:
259259 196.504 (2) (c) 2. d.  Whether the applicant offers a low-cost broadband service
260260 option in order to be eligible for funding under the broadband equity, access, and
261261 deployment program administered by the federal department of commerce or

292292 SECTION 14. 196.504 (2) (d) of the statutes is repealed.
293293 SECTION 15. 196.504 (2t) of the statutes is created to read:
294294 196.504 (2t) (a)  Within 10 days of the close of the broadband expansion grant
295295 application process, the commission shall publish on its website the proposed
296296 geographic broadband service area and the proposed broadband service speeds for
297297 each application for a broadband expansion grant submitted.
298298 (b)  An Internet service provider in or proximate to the proposed project area
299299 may, within 30 days of publication of the information under par. (a), submit in writing
300300 to the commission a challenge to an application. A challenge shall contain
301301 information demonstrating one of the following:
302302 1.  The provider currently provides available and reliable fixed wireless or
303303 wired broadband service to the proposed project area at download speeds of 100
304304 megabits per second or greater and upload speeds of 20 megabits per second or
305305 greater.
306306 2.  The provider commits to complete construction of broadband infrastructure
307307 and to provide available and reliable fixed wireless or wired broadband service to the
308308 proposed project area at speeds equal to or greater than the speeds described under
309309 subd. 1. no later than 24 months after the date of the commission's order awarding
310310 broadband expansion grants.  The provider shall submit documentation showing
311311 this commitment to the satisfaction of the commission, which may include
312312 engineering plans, invoices related to project materials, permit applications, and a
313313 project timeline.

340340 (c)  The commission shall evaluate an Internet service provider's challenge
341341 under this subsection, and is prohibited from funding any portion of a project relating
342342 to the area that is the subject of the challenge if the commission determines that the
343343 challenger's provision of or commitment to provide broadband service that meets the
344344 requirements of par. (b) in that area is credible.
345345 (d)  If the commission denies funding to an applicant as a result of an Internet
346346 service provider's challenge made under this subsection and the Internet service
347347 provider does not fulfill its commitment to provide available and reliable broadband
348348 service in the area that is the subject of the challenge, the commission is prohibited
349349 from awarding grant funding to that Internet service provider for the following 2
350350 grant cycles and that Internet service provider is prohibited from participating in the
351351 challenge process under par. (b) for the following 2 grant cycles, unless the
352352 commission determines that the Internet service provider's failure to fulfill its
353353 commitment was the result of factors beyond the Internet service provider's control.
354354 The commission shall give priority scoring treatment to an application targeting a
355355 grant project area that remains unserved as a result of a successful challenge and
356356 an unfulfilled commitment.
357357 SECTION 16. 196.504 (3) (intro.) of the statutes is amended to read:
358358 196.504 (3) (intro.)  The commission shall encourage the development of
359359 broadband infrastructure in underserved unserved areas of the state and do all of the
360360 following:
361361 SECTION 17.0Initial applicability.
362362 (1)  BROADBAND EXPANSION GRANT PROGRAM.  This act first applies to an
363363 application for a broadband expansion grant submitted pursuant to s. 196.504
