30 | 30 | | office of literacy in the department of public instruction |
---|
31 | 31 | | have the meaning of “bureau” under this subsection. |
---|
32 | 32 | | SECTION 2. 15.374 (2) of the statutes is created to |
---|
33 | 33 | | read: |
---|
34 | 34 | | 15.374 (2) OFFICE OF LITERACY. There is created an |
---|
35 | 35 | | office of literacy, to be known as the Wisconsin Reading |
---|
36 | 36 | | Center, in the department of public instruction. The |
---|
37 | 37 | | director of the office shall be nominated by the state |
---|
38 | 38 | | superintendent of public instruction after consultation |
---|
39 | 39 | | with the council on early literacy curricula, and with the |
---|
40 | 40 | | advice and consent of the senate appointed, to serve at the |
---|
41 | 41 | | pleasure of the state superintendent of public instruction. |
---|
42 | 42 | | SECTION 3. 15.374 (2) of the statutes, as created by |
---|
43 | 43 | | 2023 Wisconsin Act .... (this act), is repealed. |
---|
44 | 44 | | SECTION 4. 15.377 (9) of the statutes is created to |
---|

---|
47 | 47 | | (a) There is created in the department of public instruc- |
---|
48 | 48 | | tion a council on early literacy curricula composed of 9 |
---|
49 | 49 | | members who have knowledge of or experience with sci- |
---|
50 | 50 | | ence−based early literacy instruction, as defined in s. |
---|
51 | 51 | | 118.015 (1c) (b), and literacy curricula for pupils in |
---|
52 | 52 | | grades kindergarten to 3. The members of the council |
---|
53 | 53 | | * Section 991.11, WISCONSIN STATUTES: Effective date of acts. “Every act and every portion of an act enacted by the legislature over the governor’s |

55 | 55 | | shall be appointed for staggered 3−year terms, as fol- |
---|
56 | 56 | | lows:. |

---|
59 | 59 | | 2. Three members appointed by the senate majority |
---|
60 | 60 | | leader. |
---|

63 | 63 | | (b) An individual may not serve as a member of the |
---|
64 | 64 | | council under this subsection if any of the following |
---|
65 | 65 | | applies: |
---|
66 | 66 | | 1. The individual has a financial interest in an entity |
---|
67 | 67 | | that develops, sells, or markets a product to assess read- |
---|
68 | 68 | | ing ability. |
---|
69 | 69 | | 2. The individual has a financial interest in an entity |
---|
70 | 70 | | that develops, sells, or markets a product specifically |
---|
71 | 71 | | intended to be used to teach reading. |
---|
72 | 72 | | 3. The individual has a financial interest in an entity |
---|
73 | 73 | | that develops, sells, or markets a product to treat reading |
---|
74 | 74 | | difficulties. |
---|
75 | 75 | | (c) For purposes of par. (b), “financial interest in an |
---|
76 | 76 | | entity” includes all of the following: |
---|
77 | 77 | | 1. A direct or indirect ownership interest in the entity. |
---|
78 | 78 | | 2. Receiving income from the entity during the 12 |
---|
79 | 79 | | months preceding the consideration for appointment |
---|
80 | 80 | | under par. (a). |
---|
81 | 81 | | SECTION 5. 115.28 (7) (a) of the statutes is amended |
---|
82 | 82 | | to read: |

83 | 83 | | 115.28 (7) (a) License all teachers for the public |
---|
84 | 84 | | schools of the state; make rules establishing standards of |
---|
85 | 85 | | attainment and procedures for the examination and |

95 | 95 | | ence−based early reading instruction, as defined in s. |

96 | 96 | | 118.015 (1c) (b), and does not provide instruction on |
---|
97 | 97 | | teaching reading and language arts that incorporates |
---|
98 | 98 | | 3−cueing, as defined in s. 118.015 (1c) (c), and a require- |
---|
99 | 99 | | ment that, beginning on July 1, 2012, and annually there- |
---|
100 | 100 | | after, each teacher preparatory program located in this |
---|
101 | 101 | | state shall submit to the department a list of individuals |
---|
102 | 102 | | who have completed the program and who have been rec- |
---|
103 | 103 | | ommended by the program for licensure under this sub- |
---|
104 | 104 | | section, together with each individual’s date of program |
---|
105 | 105 | | completion, from each term or semester of the program’s |
---|
106 | 106 | | most recently completed academic year; file in the state |
---|
107 | 107 | | superintendent’s office all papers relating to state teach- |
---|
108 | 108 | | ers’ licenses; and register each such license. |
---|
109 | 109 | | SECTION 6. 115.38 (1) (a) of the statutes is amended |
---|
110 | 110 | | to read: |

111 | 111 | | 115.38 (1) (a) Indicators of academic achievement, |
---|
112 | 112 | | including the performance of pupils on the tests adminis- |
---|

126 | 126 | | 115.39 Literacy coaching program. (1) DEFINI- |
---|
127 | 127 | | TIONS. In this section: |
---|
128 | 128 | | (a) “CESA region” means the geographic territory |
---|
129 | 129 | | within the boundaries of a cooperative educational ser- |
---|
130 | 130 | | vice agency. |
---|
131 | 131 | | (b) “Eligible school” means any of the following that |
---|
132 | 132 | | does not provide instruction that incorporates 3−cueing, |
---|
133 | 133 | | as defined in s. 118.015 (1c) (c), in the core reading cur- |
---|
134 | 134 | | riculum for grades kindergarten to 3: |
---|
135 | 135 | | 1. A public school, including a charter school estab- |
---|
136 | 136 | | lished under s. 118.40 (2r) or (2x). |
---|
137 | 137 | | 2. A private school participating in a program under |
---|
138 | 138 | | s. 118.60 or 119.23. |
---|
139 | 139 | | (c) “Office” means the office of literacy in the depart- |
---|
140 | 140 | | ment. |
---|
141 | 141 | | (2) LITERACY COACHING PROGRAM. The office shall |
---|
142 | 142 | | establish and supervise an early literacy coaching pro- |
---|
143 | 143 | | gram to improve literacy outcomes in this state. As part |
---|
144 | 144 | | of the early literacy coaching program established under |
---|
145 | 145 | | this subsection, the office shall, in consultation with |
---|
146 | 146 | | cooperative educational service agencies, do all of the |
---|
147 | 147 | | following: |
---|
148 | 148 | | (a) Contract with individuals who demonstrate |
---|
149 | 149 | | knowledge and expertise in science−based early literacy |
---|
150 | 150 | | instruction and instructional practices, and have instruc- |
---|
151 | 151 | | tional experience in grades kindergarten to 12 to serve as |
---|
152 | 152 | | literacy coaches. The office may not contract for more |
---|
153 | 153 | | than 64 full−time equivalent positions under this para- |
---|
154 | 154 | | graph. |
---|
155 | 155 | | (b) Provide ongoing training on science−based early |
---|
156 | 156 | | literacy instruction and instructional practices and super- |
---|
157 | 157 | | vision to individuals with whom the office contracts |
---|
158 | 158 | | under par. (a). |
---|
159 | 159 | | (c) Prohibit literacy coaches from using or promoting |
---|
160 | 160 | | instruction that includes 3−cueing, as defined in s. |
---|
161 | 161 | | 118.015 (1c) (c). |
---|
162 | 162 | | (3) PARTICIPATION; SCHOOLS AND SCHOOL DISTRICTS. |
---|
163 | 163 | | (a) The office shall assign one−half of the number of lit- |
---|
164 | 164 | | eracy coaches under sub. (2) (a) as follows: |
---|
165 | 165 | | 1. Based on scores of the standardized reading test |
---|
167 | 167 | | s. 121.02 (1) (r), the office shall identify the 50 eligible |
---|
168 | 168 | | schools that had the lowest percentage of pupils score as |
---|
169 | 169 | | proficient in reading at grade level and the 50 eligible |
---|
170 | 170 | | schools that had the largest gap in pupils who scored as |
---|
171 | 171 | | proficient in reading at grade level. |
---|
172 | 172 | | 2. a. Subject to par. (c) and subd. 2. b., from the eligi- |
---|
173 | 173 | | ble schools identified under subd. 1., the office shall |
---|
174 | 174 | | select the eligible schools that the office determines have |
---|
175 | 175 | | the greatest need for early literacy instructional coaching |
---|
176 | 176 | | and shall assign at least one but no more than 3 eligible |
---|
177 | 177 | | schools selected under this subdivision to each full−time |
---|
178 | 178 | | equivalent literacy coach. |
---|
179 | 179 | | b. From the eligible schools identified under subd. 1., |
---|
180 | 180 | | the office shall select at least two eligible schools that are |
---|
181 | 181 | | private schools participating in a program under s. 118.60 |
---|
182 | 182 | | or 119.23. |
---|
183 | 183 | | (b) The office shall assign one−half of the number of |
---|
184 | 184 | | literacy coaches under sub. (2) (a), in consultation with |
---|
185 | 185 | | cooperative educational service agencies, to eligible |
---|
186 | 186 | | schools that request early literacy support. The office |
---|
187 | 187 | | shall assign literacy coaches under this paragraph in a |
---|
188 | 188 | | manner that allocates the literacy coaches evenly across |
---|
189 | 189 | | CESA regions. |
---|
190 | 190 | | (c) 1. The total number of full−time equivalent liter- |
---|
191 | 191 | | acy coaches assigned under pars. (a) and (b) to eligible |
---|
192 | 192 | | schools located within the geographical boundaries of a |
---|
193 | 193 | | school district may not exceed the following: |
---|
194 | 194 | | a. For a first class city school district, 10. |
---|
195 | 195 | | b. For a school district other than a first class city |
---|
196 | 196 | | school district, 4. |
---|
197 | 197 | | 2. The total number of full−time equivalent literacy |
---|
198 | 198 | | coaches assigned under pars. (a) and (b) to eligible |
---|
199 | 199 | | schools located within a CESA region may not be fewer |
---|
200 | 200 | | than 3. |
---|
201 | 201 | | (d) The office shall ensure that a school assigned a lit- |
---|
202 | 202 | | eracy coach under par. (a) or (b) does not request or |
---|
203 | 203 | | require that the literacy coach perform duties outside the |
---|
204 | 204 | | individual’s role as a literacy coach. For purposes of this |
---|
205 | 205 | | paragraph, the role of a literacy coach is to provide sup- |
---|
206 | 206 | | port to administrators, school−based literacy coaches, |
---|
207 | 207 | | principals, and teachers to build teacher and school |
---|
208 | 208 | | capacity to teach reading and language arts using sci- |
---|
209 | 209 | | ence−based early reading instruction, as defined in s. |
---|
210 | 210 | | 118.015 (1c) (b), in order to increase the percentage of |
---|
211 | 211 | | pupils who are reading at grade level by the end of grade |
---|
212 | 212 | | 3. |
---|
213 | 213 | | (4) REPORT. By October 15, 2024, and by each Octo- |
---|
214 | 214 | | ber 15 thereafter, the office shall submit a report to the |
---|
215 | 215 | | joint committee on finance that includes at least all of the |
---|
216 | 216 | | following for the previous school year: |
---|
217 | 217 | | (a) The number of literacy coaches assigned to |
---|
218 | 218 | | schools under sub. (3) (a) and (b). |
---|
219 | 219 | | (b) The number of schools that were assigned a liter- |
---|
220 | 220 | | acy coach under sub. (3) (a) and the number of schools |
---|
221 | 221 | | that were assigned a literacy coach under sub. (3) (b). |
---|
222 | 222 | | (c) The number of contracts that the office entered |
---|
223 | 223 | | into under sub. (2) (a) and the number of contracts under |
---|
224 | 224 | | sub. (2) (a) that were terminated. |
---|
225 | 225 | | (d) The number of requests submitted for a literacy |

289 | 289 | | receives recommendations under par. (a), the department |
---|
290 | 290 | | shall submit to the joint committee on finance proposed |
---|
291 | 291 | | recommendations on early literacy curricula and instruc- |
---|
292 | 292 | | tional materials that satisfy the criteria under par. (a) 1. |
---|
293 | 293 | | and 2. for use in the following school year. If the cochair- |
---|
294 | 294 | | persons of the joint committee on finance do not notify |
---|
295 | 295 | | the department within 14 working days after the date of |
---|
296 | 296 | | the submittal of the proposed recommendations that the |
---|
297 | 297 | | committee has scheduled a meeting to review the pro- |
---|
298 | 298 | | posed recommendations, the department shall adopt the |
---|
299 | 299 | | proposed recommendations for use in the following |
---|
300 | 300 | | school year. If, within 14 working days after the date of |
---|
301 | 301 | | the submittal of the proposed recommendations, the |
---|
302 | 302 | | cochairpersons of the committee notify the department |
---|
303 | 303 | | that the committee has scheduled a meeting to review the |
---|

314 | 314 | | (c) The department shall award grants to reimburse |
---|
315 | 315 | | school boards, operators of charter schools, and govern- |
---|
316 | 316 | | ing bodies of private schools participating in a program |
---|
317 | 317 | | under s. 118.60 or 119.23 that adopt a literacy curriculum |
---|
318 | 318 | | from the recommendations adopted under par. (b) after |
---|
319 | 319 | | January 1, 2024. A grant under this paragraph shall be an |
---|
320 | 320 | | amount equal to one−half of the costs of purchasing the |
---|
321 | 321 | | literacy curriculum and instructional materials adopted |
---|
322 | 322 | | from the recommendations adopted under par. (b). If the |
---|
323 | 323 | | amount appropriated for this purpose is insufficient to |
---|
324 | 324 | | pay the full amount to all grant recipients under this para- |
---|
325 | 325 | | graph, the department shall prorate the grant awards |
---|
326 | 326 | | among all grant recipients. |
---|
327 | 327 | | (d) Beginning on the effective date of this paragraph |
---|

---|
386 | 386 | | 3. Often unexpected in relation to other cognitive |

388 | 388 | | (d) “Family history survey” means a questionnaire |

389 | 389 | | that includes questions about previous recommendations |
---|
390 | 390 | | for summer reading support or outside tutoring, general |
---|
391 | 391 | | interest in reading and books, family history of character- |
---|
392 | 392 | | istics of dyslexia, and any known family struggles in |

394 | 394 | | (e) “Fidelity” means to perform in the manner that the |

---|
398 | 398 | | sesses phonemic awareness and letter sound knowledge. |

399 | 399 | | (g) “Inadequate rate of progress” means a pupil’s rate |
---|
400 | 400 | | of improvement that is minimal and that with continued |
---|
401 | 401 | | intervention the pupil is unlikely to demonstrate grade− |
---|
402 | 402 | | level skills by the end of the school year. |
---|
403 | 403 | | (h) “Independent charter school” means a charter |
---|
404 | 404 | | school established under s. 118.40 (2r) or (2x). |
---|
405 | 405 | | (i) “Intervention” means an intervention that is all of |
---|
406 | 406 | | the following: |
---|
407 | 407 | | 1. Explicit, direct instruction that is systematic, |
---|
408 | 408 | | sequential, and cumulative and follows a logical plan of |
---|
409 | 409 | | presenting the area of deficit that targets the specific |
---|
410 | 410 | | needs of the pupil without presuming prior skills or |
---|
411 | 411 | | knowledge of the pupil. |
---|
412 | 412 | | 2. Individualized instruction to meet the specific |
---|
413 | 413 | | needs of a pupil in a setting that uses intensive, highly |
---|
414 | 414 | | concentrated instruction methods and materials that |
---|
415 | 415 | | maximize pupil engagement. |
---|
416 | 416 | | 3. Instruction that incorporates the simultaneous use |
---|
417 | 417 | | of 2 or more sensory pathways during teacher presenta- |
---|
418 | 418 | | tions and pupil practice. |
---|
419 | 419 | | (j) “Parent” has the meaning given in s. 115.76 (12) |
---|

---|
421 | 421 | | (k) “Reading readiness assessment” means a funda- |
---|
422 | 422 | | mental skills screening assessment, universal screening |
---|
423 | 423 | | assessment, or diagnostic assessment. |

425 | 425 | | assessment that evaluates a pupil’s skill in all of the fol- |

432 | 432 | | (2) FOUR−YEAR−OLD KINDERGARTEN; SCREENING |
---|
433 | 433 | | REQUIREMENT. Each school board and the operator of |
---|
434 | 434 | | each independent charter school shall annually assess the |
---|
435 | 435 | | early literacy skills of each pupil enrolled in 4−year−old |
---|
436 | 436 | | kindergarten in the school district or in the independent |
---|
437 | 437 | | charter school at least 2 times during the school year |
---|
438 | 438 | | using a fundamental skills screening assessment selected |
---|
439 | 439 | | by the department. The school board or operator of the |
---|
440 | 440 | | independent charter school shall ensure that the first |
---|
441 | 441 | | screening assessment is administered before the 45th day |
---|
442 | 442 | | after the first day of the school term and that the 2nd |
---|
443 | 443 | | screening assessment is administered by the date that is |
---|
444 | 444 | | 45 days before the last day of the school term. The school |
---|
445 | 445 | | board or operator of the independent charter school shall |
---|
446 | 446 | | ensure that assessments required under this subsection |
---|
447 | 447 | | are administered with fidelity. |
---|
448 | 448 | | (3) EARLY LITERACY ASSESSMENTS; 5−YEAR−OLD |
---|
449 | 449 | | KINDERGARTEN TO 3RD GRADE. Each school board and the |
---|
450 | 450 | | operator of each independent charter school shall annu- |
---|
451 | 451 | | ally assess the early literacy skills of each pupil enrolled |
---|
452 | 452 | | in 5−year−old kindergarten to 3rd grade in the school dis- |
---|
453 | 453 | | trict or in the independent charter school as follows: |
---|
454 | 454 | | (a) Universal screenings. Screen the pupil at least 3 |
---|
455 | 455 | | times during the school year using a universal screening |
---|
456 | 456 | | assessment selected by the department. The school board |
---|
457 | 457 | | or operator of the independent charter school shall ensure |
---|
458 | 458 | | that the universal screening assessments are adminis- |
---|
459 | 459 | | tered at the following times during the school year: |
---|
460 | 460 | | 1. The first universal screening assessment is admin- |
---|
461 | 461 | | istered before the 45th day after the first day of the school |
---|
462 | 462 | | term. |
---|
463 | 463 | | 2. The 2nd universal screening assessment is admin- |
---|
464 | 464 | | istered in the middle of the school term, as determined by |
---|
465 | 465 | | the school board or operator of the independent charter |
---|
466 | 466 | | school. |
---|
467 | 467 | | 3. The 3rd universal screening assessment is admin- |
---|
468 | 468 | | istered by the date that is 45 days before the last day of the |
---|
469 | 469 | | school term. |
---|
470 | 470 | | (b) Diagnostic assessment. Assess a pupil using a |
---|
471 | 471 | | diagnostic assessment as follows: |
---|
472 | 472 | | 1. No later than the 2nd Friday of November if a uni- |
---|
473 | 473 | | versal screening assessment administered under par. (a) |
---|
474 | 474 | | 1. indicates that the pupil is at−risk. |
---|
475 | 475 | | 2. Within 10 days after a universal screening assess- |
---|
476 | 476 | | ment is administered under par. (a) 2. if the universal |
---|
477 | 477 | | screening assessment indicates that the pupil is at−risk. |
---|
478 | 478 | | 3. Within 20 days after a teacher or parent who sus- |
---|
479 | 479 | | pects that the pupil has characteristics of dyslexia sub- |
---|
480 | 480 | | mits a request for a diagnostic assessment. |
---|
481 | 481 | | (c) Administering assessments with fidelity. Ensure |
---|
482 | 482 | | that each assessment required under this subsection is |
---|
483 | 483 | | administered with fidelity. |
---|
484 | 484 | | (4) PARENTAL NOTIFICATION. (a) Assessment results. |
---|
485 | 485 | | A school board or operator of an independent charter |
---|
486 | 486 | | school shall provide the results of a reading readiness |
---|
487 | 487 | | assessment, in writing, to a pupil’s parent no later than 15 |
---|
488 | 488 | | days after the reading readiness assessment is scored. For |
---|
489 | 489 | | purposes of providing results of a reading readiness |
---|
490 | 490 | | assessment under this paragraph, a school board or opera- |
---|
491 | 491 | | tor of an independent charter school shall provide at least |
---|
492 | 492 | | all of the following to a pupil’s parent in the native lan- |
---|
493 | 493 | | guage of the pupil’s parent: |
---|
494 | 494 | | 1. The pupil’s score on the reading readiness assess- |
---|
495 | 495 | | ment. |
---|
496 | 496 | | 2. The pupil’s score in each early literacy skill cate- |
---|
497 | 497 | | gory assessed by the reading readiness assessment. |
---|
498 | 498 | | 3. The pupil’s percentile rank score on the reading |
---|
500 | 500 | | 4. The definition of “at−risk” and the score on the |
---|
501 | 501 | | reading readiness assessment that would indicate that a |
---|
502 | 502 | | pupil is at−risk. |
---|
503 | 503 | | 5. A plain language description of the literacy skills |
---|
504 | 504 | | the reading readiness assessment is designed to measure. |
---|
505 | 505 | | (b) Special education information. If a diagnostic |
---|
506 | 506 | | assessment indicates that a pupil is at−risk, a school board |
---|
507 | 507 | | or operator of an independent charter school shall include |
---|
508 | 508 | | information about how to make a special education refer- |
---|
509 | 509 | | ral under s. 115.777 with the diagnostic assessment |
---|
510 | 510 | | results provided to the parent under par. (a). |
---|
511 | 511 | | (c) Dyslexia information; certain pupils. If a school |
---|
512 | 512 | | board or operator of an independent charter school is |
---|
513 | 513 | | required to assess a pupil’s early literacy skills using a |
---|
514 | 514 | | diagnostic assessment, a school board or operator of an |
---|
515 | 515 | | independent charter school shall provide all of the fol- |
---|
516 | 516 | | lowing, in writing, to the pupil’s parent: |
---|
517 | 517 | | 1. A description of the common indicators and char- |
---|
518 | 518 | | acteristics of dyslexia. |
---|
519 | 519 | | 2. Information about appropriate interventions and |
---|
520 | 520 | | accommodations for pupils with characteristics of dys- |
---|
521 | 521 | | lexia. |
---|
522 | 522 | | (d) Early literacy remediation plan; availability. A |
---|
523 | 523 | | school board or operator of an independent charter school |
---|
524 | 524 | | shall post its early literacy remediation plan, as estab- |
---|
525 | 525 | | lished under sub. (6), on the school district’s or indepen- |
---|
526 | 526 | | dent charter school’s website. |
---|
527 | 527 | | (5) INTERVENTIONS; AT−RISK PUPILS. (a) Personal |
---|
528 | 528 | | reading plans. If a pupil enrolled in 5−year−old kinder- |
---|
529 | 529 | | garten to 3rd grade is identified as at−risk based on a uni- |
---|
530 | 530 | | versal screening assessment or diagnostic assessment, |
---|
531 | 531 | | the school board of the school district or operator of the |
---|
532 | 532 | | independent charter school in which the pupil is enrolled |
---|
533 | 533 | | shall do all of the following: |
---|
534 | 534 | | 1. Create a personal reading plan for the pupil that |
---|
535 | 535 | | includes at least all of the following: |
---|
536 | 536 | | a. The pupil’s specific early literacy skill deficien- |
---|
537 | 537 | | cies, as identified by the applicable assessment. |
---|
538 | 538 | | b. Goals and benchmarks for the pupil’s progress |
---|
539 | 539 | | toward grade−level literacy skills. |
---|
540 | 540 | | c. How the pupil’s progress will be monitored. |
---|
541 | 541 | | d. A description of the interventions and any addi- |
---|
542 | 542 | | tional instructional services that will be provided to the |
---|
543 | 543 | | pupil to address the pupil’s early literacy skill deficien- |
---|
544 | 544 | | cies. |
---|
545 | 545 | | e. The programming using science−based early read- |
---|
546 | 546 | | ing instruction, as defined in s. 118.015 (1c) (b), that the |
---|
547 | 547 | | pupil’s teacher will use to provide reading instruction to |
---|
548 | 548 | | the pupil, addressing the areas of phonemic awareness, |
---|
549 | 549 | | phonics, fluency, vocabulary, and comprehension. |
---|
550 | 550 | | f. Strategies the pupil’s parent is encouraged to use |
---|
551 | 551 | | to help the pupil achieve grade−level literacy skills. |
---|
552 | 552 | | g. Any additional services available and appropriate |
---|
553 | 553 | | to accelerate the pupil’s early literacy skill development. |
---|
554 | 554 | | 2. Provide the interventions described in the pupil’s |
---|
555 | 555 | | personal reading plan to the pupil, as soon as practicable. |
---|
556 | 556 | | 3. Monitor the pupil’s progress at least weekly using |
---|
557 | 557 | | the method described in the pupil’s personal reading plan |
---|
558 | 558 | | to determine whether the pupil demonstrates an inade- |
---|
559 | 559 | | quate rate of progress. |
---|
560 | 560 | | 4. Provide a copy of the pupil’s personal reading plan |
---|
561 | 561 | | to the pupil’s parent and obtain a copy of the pupil’s per- |
---|
562 | 562 | | sonal reading plan signed by the pupil’s parent. |
---|
563 | 563 | | 5. After providing the interventions described in the |
---|
564 | 564 | | pupil’s personal reading plan to the pupil for 10 weeks, |
---|
565 | 565 | | notify the pupil’s parent of the pupil’s progress, as deter- |
---|
566 | 566 | | mined under the pupil’s personal reading plan. |
---|
567 | 567 | | (b) Deadlines for plan creation. If a school board or |
---|
568 | 568 | | operator of an independent charter school is required to |
---|
569 | 569 | | create a personal reading plan for a pupil under par. (a) 1., |
---|
570 | 570 | | the school board or operator shall prepare the personal |
---|
571 | 571 | | reading plan as follows: |
---|
572 | 572 | | 1. If the pupil is identified as at−risk based on a uni- |
---|
573 | 573 | | versal screening assessment administered under sub. (3) |
---|
574 | 574 | | (a) 1. or based on a diagnostic assessment administered |
---|
575 | 575 | | under sub. (3) (b) 1., no later than the 3rd Friday of |
---|
576 | 576 | | November. |
---|
577 | 577 | | 2. If the pupil is identified as at−risk based on a uni- |
---|
578 | 578 | | versal screening assessment administered under sub. (3) |

579 | 579 | | (a) 2. or 3. or based on a diagnostic assessment adminis- |

582 | 582 | | (c) Inadequate rate of progress. For purposes of |

---|
584 | 584 | | rate of progress under par. (a) 3., a school board or opera- |

585 | 585 | | tor of an independent charter school shall determine |
---|
586 | 586 | | whether the pupil is likely to demonstrate grade−level |
---|
587 | 587 | | skills by the end of the school year by assessing one of the |
---|
588 | 588 | | following: |

589 | 589 | | 1. For a pupil enrolled in 5−year−old kindergarten, |
---|
590 | 590 | | nonword or nonsense word fluency and phoneme seg- |
---|
591 | 591 | | mentation fluency. |

592 | 592 | | 2. For a pupil enrolled in 1st, 2nd, or 3rd grade, oral |
---|
593 | 593 | | reading fluency. |
---|
594 | 594 | | (d) Plan completion; 3rd grade. A 3rd grade pupil |
---|
595 | 595 | | who has a personal reading plan under par. (a) 1. is con- |
---|
596 | 596 | | sidered to have completed the personal reading plan if the |
---|
597 | 597 | | pupil’s parent and the pupil’s school agree that the pupil |
---|
598 | 598 | | has met the goals outlined in the personal reading plan |
---|
599 | 599 | | and the pupil scores at grade−level in reading on a sum- |
---|
600 | 600 | | mative assessment, as defined by the department by rule. |
---|
601 | 601 | | (6) EARLY LITERACY REMEDIATION PLAN; SCHOOL DIS- |
---|
602 | 602 | | TRICT OR INDEPENDENT CHARTER SCHOOL. A school board |
---|
603 | 603 | | or operator of an independent charter school shall estab- |
---|
604 | 604 | | lish an early literacy remediation plan for grades 5−year− |
---|
605 | 605 | | old kindergarten to 3 that includes all of the following: |
---|
606 | 606 | | (a) The assessments the school board or operator of |
---|
607 | 607 | | the independent charter school uses to satisfy the require- |
---|
608 | 608 | | ments under sub. (3). |
---|
609 | 609 | | (b) A description of the interventions the school |
---|
610 | 610 | | board or operator of the independent charter school uses |
---|
612 | 612 | | (c) A description of how the school board or operator |
---|
613 | 613 | | of the independent charter school monitors pupil |
---|
614 | 614 | | progress during interventions, including the frequency of |
---|
615 | 615 | | monitoring pupil progress during interventions and any |
---|
616 | 616 | | assessment tools used to monitor pupil progress during |
---|
617 | 617 | | interventions. |
---|
618 | 618 | | (d) How the school board or operator of the indepen- |
---|
619 | 619 | | dent charter school uses results of assessments required |
---|
620 | 620 | | under sub. (3) to evaluate early literacy instruction being |
---|
621 | 621 | | provided in the school district or at the independent char- |
---|
622 | 622 | | ter school. |
---|
623 | 623 | | (e) A parent notification policy that complies with |
---|
624 | 624 | | subs. (4) and (5) (a) 4. and 5. |
---|
625 | 625 | | (7) REPORTING ASSESSMENT DATA. By no later than |
---|
626 | 626 | | July 15, 2025, and each July 15 thereafter, a school board |
---|
627 | 627 | | shall report for each school and for the school district, and |
---|
628 | 628 | | the operator of an independent charter school shall report |
---|
629 | 629 | | for the independent charter school, all of the following to |

632 | 632 | | risk as the result of a fundamental skills screening assess- |

---|

636 | 636 | | administered in the previous school year. |
---|
637 | 637 | | (c) The number of pupils who were identified as at− |
---|
638 | 638 | | risk as the result of a diagnostic assessment administered |

640 | 640 | | (d) The names of the diagnostic assessments used to |
---|

655 | 655 | | ent under sub. (4) (a). |
---|
656 | 656 | | (8) DEPARTMENT; DUTIES. (a) Selected and approved |
---|
657 | 657 | | reading readiness assessments. 1. By no later than July |
---|
658 | 658 | | 15, 2024, and subject to subd. 2., the department shall |
---|
659 | 659 | | select a fundamental skills screening assessment and a |
---|
660 | 660 | | universal screening assessment, and establish and main- |
---|
661 | 661 | | tain a list of diagnostic assessments that are approved by |
---|
662 | 662 | | the department for use under this section. |
---|
663 | 663 | | 2. The department may select or approve an assess- |
---|
664 | 664 | | ment under subd. 1. only if the assessment meets all of the |
---|
665 | 665 | | following criteria: |
---|
666 | 666 | | a. The assessment has a sensitivity rate of at least 70 |
---|
667 | 667 | | percent. |
---|
668 | 668 | | b. The assessment has a specificity rate of at least 80 |
---|
669 | 669 | | percent. |
---|
670 | 670 | | c. The assessment includes a growth measure. |
---|
671 | 671 | | 3. The department shall publish a list of the assess- |
---|
672 | 672 | | ments selected or approved under subd. 1. on its website |
---|
673 | 673 | | and submit the lists of approved assessments to the appro- |
---|
674 | 674 | | priate standing committees of the legislature under s. |
---|
675 | 675 | | 13.172 (3). If the department modifies a list under subd. |
---|
676 | 676 | | 1., the department shall submit the modified list to the |
---|
677 | 677 | | appropriate standing committees of the legislature under |
---|
678 | 678 | | s. 13.172 (3). |
---|
679 | 679 | | (b) Reports to the legislature. By November 30, |
---|
680 | 680 | | 2025, and by each November 30 thereafter, the depart- |
---|
681 | 681 | | ment shall compile the information it receives under sub. |
---|
682 | 682 | | (7) and submit a report to the appropriate standing com- |
---|
683 | 683 | | mittees of the legislature under s. 13.172 (3) that includes |
---|
684 | 684 | | the number of pupils identified as at−risk in the previous |
---|
685 | 685 | | school year, by school and by school district. |
---|
686 | 686 | | (9) STATE SUPPORT. (a) Payments and assessments. |
---|
687 | 687 | | From the appropriation under s. 20.255 (1) (f) and subject |
---|
688 | 688 | | to par. (b), the department shall pay a school board or |
---|
689 | 689 | | operator of an independent charter school the per pupil |
---|
690 | 690 | | cost of each reading readiness assessment required to be |
---|
691 | 691 | | administered under sub. (3) (b). Beginning in the |
---|
692 | 692 | | 2025−26 school year, the department may pay a school |
---|
693 | 693 | | board or operator of an independent charter school under |
---|
694 | 694 | | this paragraph only if the school board or operator of the |
---|
695 | 695 | | independent charter school does all of the following: |
---|
696 | 696 | | 1. Submits the report required under sub. (7) for the |
---|
697 | 697 | | previous school year. |
---|
698 | 698 | | 2. In the report required under sub. (7) for the previ- |
---|
699 | 699 | | ous school year, indicates that the school board or opera- |
---|
700 | 700 | | tor of the independent charter school used only reading |
---|
701 | 701 | | readiness assessments selected or approved under sub. |
---|
702 | 702 | | (8) (a) for that school year. |
---|
703 | 703 | | (b) Proration. If the appropriation under s. 20.255 |
---|
704 | 704 | | (1) (f) in any fiscal year is insufficient to pay the full |
---|
705 | 705 | | amount of aid under par. (a), the department shall prorate |
---|
706 | 706 | | state aid payments among the school boards and opera- |
---|
707 | 707 | | tors of independent charter schools entitled to the aid. |
---|
708 | 708 | | (c) Assessments. The department shall provide to |

709 | 709 | | each school board and operator of an independent charter |
---|
710 | 710 | | school the reading readiness assessments required for the |

985 | 985 | | 2. Offered by the Leadership in Literacy Institute or |

986 | 986 | | a provider that meets all of the following requirements: |

987 | 987 | | a. The provider provides evidence of at least 5 years |

988 | 988 | | of experience conducting evidence−aligned, systematic, |
---|
989 | 989 | | structured literacy trainings specifically for school prin- |

990 | 990 | | cipals, administrators, and literacy teams. |

991 | 991 | | b. The provider demonstrates that the training con- |

992 | 992 | | tent is aligned with the National Reading Panel Report |
