13	13	AN ACT relating to: modifying administrative rules regarding the number of
14	14	child care workers and children in group child care centers.
15	15	Analysis by the Legislative Reference Bureau
16	16	This bill changes the administrative code to increase 1) the number of children
17	17	in the ratio of minimum number of child care workers to children in a group child care
18	18	center and 2) the maximum number of children per age who can be in a group child
19	19	care center.
20	20	The bill also provides that a group child care center may adjust its ratio of child
21	21	care workers to children to match the average ratio of teachers to pupils in the school
22	22	district where the group child care center is located.
23	23	The people of the state of Wisconsin, represented in senate and assembly, do
24	24	enact as follows:
25	25	SECTION 1. DCF 251.055 (2) (b) of the administrative code is amended to read:
26	26	DCF 251.055 (2) (b) The Except as provided in par. (n), the ratio of child care
27	27	workers to children may not be less than the minimum number of child care workers
28	28	to children specified in Table 251.055.
29	29	SECTION 2. DCF 251.055 (2) (n) of the administrative code is created to read:

39	39	DCF 251.055 (2) (n) 1. If the center is located in a school district where, in
40	40	4-year-old kindergarten, the average ratio of teachers to pupils is lower than the
41	41	number specified in Table DCF 251.055 for children ages 4 years to 5 years, the
42	42	center may lower its ratio of child care workers to children for children ages 4 years
43	43	to 5 years to match the average ratio in 4-year-old kindergarten in the school
44	44	district.
45	45	2. If the center is located in a school district where, in 5-year-old kindergarten
46	46	to 5th grade, the average ratio of teachers to pupils is lower than the number
47	47	specified in Table DCF 251.055 for children ages 5 years and older, the center may
48	48	lower its ratio of child care workers to children for children ages 5 years and older
49	49	to match the average ratio in 5-year-old kindergarten to 5th grade in the school
50	50	district.
