12	12	AN ACT to create 106.13 (2m) (q), 256.12 (5) (c), 256.15 (6) (d) and 256.15 (8) (dm)
13	13	of the statutes; relating to: eligibility of certain minors for licensure as
14	14	emergency medical services practitioners and certification as emergency
15	15	medical responders, providing an exemption from emergency rule procedures,
16	16	and extending the time limit for emergency rule procedures.
17	17	Analysis by the Legislative Reference Bureau
18	18	This bill allows individuals who are 17 years of age to apply for licensure as
19	19	emergency medical services practitioners and for certification as emergency medical
20	20	responders if the individuals meet certain requirements specified in the bill. Under
21	21	current law, no person under the age of 18 may apply for licensure as an emergency
22	22	medical services practitioner or for certification as an emergency medical responder.
23	23	“Emergency medical services practitioner” is defined under current law to mean an
24	24	emergency medical technician, an advanced emergency medical technician, an
25	25	emergency medical technician — intermediate, or a paramedic. Further, under the
26	26	bill, the Department of Health Services may reimburse a school district, charter
27	27	school, or tribal school for any costs to administer an examination necessary for a
28	28	student to become licensed as an emergency medical services practitioner or certified
29	29	as an emergency medical responder. Finally, the bill includes emergency medical
30	30	services as an approved occupational area in the youth apprenticeship program. The
31	31	youth apprenticeship program integrates school-based and work-based learning for
32	32	students in certain industries in the state. Under current law, the Department of

40	40	Workforce Development is required to develop curricula for the youth apprenticeship
41	41	program for all approved occupational areas.

44	44	The people of the state of Wisconsin, represented in senate and assembly, do
45	45	enact as follows:
46	46	SECTION 1. 106.13 (2m) (q) of the statutes is created to read:
47	47	106.13 (2m) (q) Emergency medical services.
48	48	SECTION 2. 256.12 (5) (c) of the statutes is created to read:
49	49	256.12 (5) (c) From the appropriation under s. 20.435 (1) (ch), the department
50	50	may reimburse a school district, a charter school, as defined under s. 115.001 (1), or
51	51	a tribal school, as defined under s. 115.001 (15m), for any costs that the school
52	52	district, charter school, or tribal school incurs to pay for the administration of an
53	53	examination required for licensure as an emergency medical services practitioner
54	54	under s. 256.15 (6) (a) 3. or certification as an emergency medical responder under
55	55	s. 256.15 (8). The department may not reimburse a school district, charter school,
56	56	or tribal school in a school year for any costs that the school district, charter school,
57	57	or tribal school incurs to administer an examination for a student who has already
58	58	completed an examination under this paragraph in that school year.
59	59	SECTION 3. 256.15 (6) (d) of the statutes is created to read:
60	60	256.15 (6) (d) Notwithstanding par. (a) 1., an individual who is 17 years of age
61	61	is eligible for an initial license as an emergency medical services practitioner if the
62	62	individual satisfies all of the following:
63	63	1. The individual meets all the requirements under par. (a) that are not related
64	64	to the individual's age.
65	65	2. The individual maintains school attendance in compliance with s. 118.15.

90	90	3. The individual provides the department with a letter signed by the
91	91	individual's parent or guardian indicating the consent of the individual's parent or
92	92	guardian for the individual to work as an emergency medical services practitioner.
93	93	4. The individual provides the department with a letter of endorsement from
94	94	a sponsoring organization that provides emergency medical services.
95	95	5. The individual agrees, in a manner approved by the department, to comply
96	96	with any applicable federal and state laws, rules, and regulations.
97	97	SECTION 4. 256.15 (8) (dm) of the statutes is created to read:
98	98	256.15 (8) (dm) Notwithstanding par. (b) 1., an individual who is 17 years of
99	99	age is eligible for an initial certification as an emergency medical responder if the
100	100	individual satisfies all of the following:
101	101	1. The individual meets all the requirements under par. (b) that are not related
102	102	to the individual's age.
103	103	2. The individual maintains school attendance in compliance with s. 118.15.
104	104	3. The individual provides the department with a letter signed by the
105	105	individual's parent or guardian indicating the consent of the individual's parent or
106	106	guardian for the individual to work as an emergency medical responder.
107	107	4. The individual provides the department with a letter of endorsement from
108	108	a sponsoring organization that provides emergency medical services.
109	109	5. The individual agrees, in a manner approved by the department, to comply
110	110	with any applicable federal and state laws, rules, and regulations.
111	111	SECTION 5.0Nonstatutory provisions.
112	112	(1) The department of health services may promulgate emergency rules under
113	113	s. 227.24 to implement s. 256.15 (5) (c), (6) (d), and (8) (dm). Notwithstanding s.
114	114	227.24 (1) (c) and (2), emergency rules promulgated under this subsection remain in

142	142	effect until January 1, 2026, or the date on which permanent rules take effect,
143	143	whichever is sooner. Notwithstanding s. 227.24 (1) (a) and (3), the department is not
144	144	required to provide evidence that promulgating a rule under this subsection as an
145	145	emergency rule is necessary for the preservation of the public peace, health, safety,
146	146	or welfare and is not required to provide a finding of emergency for a rule
147	147	promulgated under this subsection.
