| 6 | 6 | | The people of the state of Wisconsin, represented in |

| 7 | 7 | | senate and assembly, do enact as follows: |
|---|
| 8 | 8 | | SECTION 1. 346.65 (1) (a) of the statutes is amended |
|---|
| 9 | 9 | | to read: |
|---|
| 10 | 10 | | 346.65 (1) (a) May be required to forfeit not less than |
|---|
| 11 | 11 | | $25 $50 nor more than $200 $400, except as provided in |
|---|
| 12 | 12 | | par. (b). |

| 13 | 13 | | SECTION 2. 346.65 (1) (b) of the statutes is amended |
|---|
| 14 | 14 | | to read: |
|---|
| 15 | 15 | | 346.65 (1) (b) May be fined not less than $50 $100 |
|---|
| 16 | 16 | | nor more than $500 $1,000 or imprisoned for not more |
|---|
| 17 | 17 | | than one year in the county jail or both if the total of con- |
|---|
| 18 | 18 | | victions under s. 346.62 (2) or a local ordinance in con- |
|---|
| 19 | 19 | | formity therewith or a law of a federally recognized |
|---|
| 20 | 20 | | American Indian tribe or band in this state in conformity |
|---|
| 21 | 21 | | with s. 346.62 (2) equals 2 or more in a 4−year period. |

| 22 | 22 | | The 4−year period shall be measured from the dates of the |
|---|
| 23 | 23 | | violations which resulted in the convictions for a 2nd or |
|---|
| 24 | 24 | | subsequent violation. |

| 25 | 25 | | SECTION 3. 346.65 (3) of the statutes is amended to |
|---|
| 26 | 26 | | read: |
|---|
| 27 | 27 | | 346.65 (3) Except as provided in sub. (5m), any per- |
|---|
| 28 | 28 | | son violating s. 346.62 (3) shall be fined not less than |
|---|
| 29 | 29 | | $300 $600 nor more than $2,000 $4,000 and may be |
|---|
| 30 | 30 | | imprisoned for not less than 30 60 days nor more than one |
|---|
| 31 | 31 | | year 2 years in the county jail. |

| 32 | 32 | | SECTION 4. 346.65 (4m) of the statutes is amended to |
|---|

| 34 | 34 | | 346.65 (4m) Except as provided in sub. (5m), any |
|---|
| 35 | 35 | | person violating s. 346.62 (2m) shall forfeit not less than |
|---|
| 36 | 36 | | $300 $600 nor more than $1,000 $2,000. |

| 37 | 37 | | SECTION 5. 346.65 (5) of the statutes is amended to |
|---|
| 38 | 38 | | read: |

| 39 | 39 | | 346.65 (5) Except as provided in sub. (5m), any per- |
|---|
| 40 | 40 | | son violating s. 346.62 (4) is guilty of a Class I H felony. |
|---|
| 41 | 41 | | SECTION 6. 346.655 (1) of the statutes is amended to |
|---|
| 42 | 42 | | read: |
|---|
| 43 | 43 | | 346.655 (1) If a court imposes a fine or a forfeiture |
|---|
| 44 | 44 | | for a violation of s. 346.62 or 346.63 (1) or (5), or a local |
|---|
| 45 | 45 | | ordinance in conformity therewith, or s. 346.63 (2) or (6) |
|---|
| 46 | 46 | | or 940.25, or s. 940.09 where the offense involved the use |
|---|
| 47 | 47 | | of a vehicle, it shall impose a driver improvement sur- |
|---|
| 48 | 48 | | charge under ch. 814 in an amount of $435 in addition to |
|---|
| 49 | 49 | | the fine or forfeiture, plus costs, fees, and other sur- |
|---|
| 50 | 50 | | charges imposed under ch. 814. |
|---|
| 51 | 51 | | SECTION 7. 346.657 (1) of the statutes is amended to |
|---|
| 52 | 52 | | read: |
|---|
| 53 | 53 | | 346.657 (1) If a court imposes a fine or a forfeiture |
|---|
| 54 | 54 | | for a violation of s. 346.62 or 346.63 (1) or (5), or a local |
|---|
