11	11	AN ACT to create 97.50 of the statutes; relating to: labeling a food product as
12	12	containing lab-grown animal cells, providing an exemption from emergency
13	13	rule procedures, and providing a penalty.

15	15	Under this bill, no person may sell or offer for sale a food product that contains
16	16	cultured animal cells or cultured animal tissue derived from cultured animal cells
17	17	unless the food product is labeled as containing lab-grown animal cells. The bill
18	18	defines “animal” as a mammal, bird, reptile, amphibian, or mollusk. The bill also
19	19	requires the Department of Agriculture, Trade and Consumer Protection to
20	20	promulgate emergency rules to implement the prohibition in the bill.
21	21	For further information see the state fiscal estimate, which will be printed as
22	22	an appendix to this bill.
23	23	The people of the state of Wisconsin, represented in senate and assembly, do
24	24	enact as follows:
25	25	SECTION 1. 97.50 of the statutes is created to read:
26	26	97.50 Labeling food products that contain cultured animal cells or
27	27	tissue. (1) In this section, “animal” means a mammal, bird, reptile, amphibian, or
28	28	mollusk.

38	38	(2) No person may sell or offer for sale a food product that contains cultured
39	39	animal cells or cultured animal tissue derived from cultured animal cells unless the
40	40	food product is labeled as containing lab-grown animal cells.
41	41	(3) A person who violates sub. (2) may be fined not less than $100 nor more than
42	42	$500 or imprisoned for not more than 3 months, or both, for a first offense, and may
43	43	be fined not less than $500 nor more than $1,000 or imprisoned for not less than 6
44	44	months nor more than one year, or both, for each subsequent offense.
45	45	SECTION 2.0Nonstatutory provisions.
46	46	(1) EMERGENCY RULEMAKING. The department of agriculture, trade and
47	47	consumer protection shall promulgate emergency rules under s. 227.24 necessary to
48	48	implement s. 97.50. Notwithstanding s. 227.24 (1) (a) and (3), the department is not
49	49	required to provide evidence that promulgating a rule under this subsection as an
50	50	emergency rule is necessary for the preservation of the public peace, health, safety,
51	51	or welfare and is not required to provide a finding of emergency for a rule
52	52	promulgated under this subsection.
53	53	SECTION 3.0Effective dates. This act takes effect on the day after publication,
54	54	except as follows:
55	55	(1) The treatment of s. 97.50 takes effect on the first day of the 7th month
56	56	beginning after publication.
