6-The people of the state of Wisconsin, represented in
7-senate and assembly, do enact as follows:
8-SECTION 2. Trans 105.06 (5) (b) of the administrative
9-code is amended to read:
10-Trans 105.06 (5) (b)  The municipality where the
11-department office is located has a population less than
12-10,000 and the business district in which the office is
13-located is less than 1500 feet long 15,000.
14-SECTION 3.0Effective date.
15-(1)  Notwithstanding s. 227.265, this act takes effect
16-on the day after publication.

9+AN ACT to amend 343.61 (4) (b) of the statutes; relating to: the location and
10+operation of driver schools.
11+Analysis by the Legislative Reference Bureau
12+Current law provides that a driver school may not be established within 1,500
13+feet of a Department of Transportation office where operator's licenses are issued or
14+official driving skills tests are given. This bill eliminates that prohibition.
15+Current Department of Transportation administrative rules prohibit a driver
16+school from soliciting business within 1,500 feet of a DOT office where operator's
17+driving skills tests are given. This prohibition does not apply if the municipality
18+where the DOT office is located has a population less than 10,000 and the business
19+district in which the DOT office is located is less than 1,500 feet long. This bill
20+modifies that exception to provide that the prohibition does not apply if the
21+municipality where the DOT office is located has a population less than 15,000 and
22+eliminates any requirement relating to the size of the business district were the DOT
23+office is located.
24+The people of the state of Wisconsin, represented in senate and assembly, do
25+enact as follows:
26+SECTION 1. 343.61 (4) (b) of the statutes is amended to read:
27+343.61 (4) (b) The location of each driver school office shall be identified in the
28+license. Except as provided by the department by rule, no licensee may establish any

36+driver school office within 1,500 feet of a department office where operator's licenses
37+are issued, nor within 1,500 feet of any headquarters where official driving skills
38+tests are given. Any change in address of any driver school office or driver school
39+classroom must be reported to and approved by the department. A driver school may
40+maintain driver school classrooms at locations other than the driver school office.
41+A driver school may provide driver training instruction by means of the Internet in
42+addition to providing instruction at a driver school classroom or, if the driver school
43+also offers behind-the-wheel instruction in this state, instead of providing
44+instruction at a driver school classroom.
45+SECTION 2. Trans 105.06 (5) (b) of the administrative code is amended to read:
