AN ACT to amend 66.1014 (2) (d) 1.; and to create 97.605 (1g) of the statutes;
relating to: the operation of tourist rooming houses.
Analysis by the Legislative Reference Bureau
This bill prohibits a person from conducting, maintaining, managing, or
operating a tourist rooming house for more than 90 days in a year.
Under current law, no person may conduct, maintain, or operate a tourist
rooming house if the person has not been issued an annual license by the Department
of Agriculture, Trade and Consumer Protection or a local health department acting
for the department. A “tourist rooming house” is defined as any lodging place or
tourist cabin or cottage where sleeping accommodations are offered for pay to
tourists or transients. The definition does not include hotels or bed and breakfast
establishments.
Also under current law, a political subdivision may limit the total number of
days within any consecutive 365-day period that a residential dwelling may be
rented to no fewer than 180 days. This bill prohibits political subdivisions from
limiting the total number days that a residential dwelling may be rented to no more
than 90 days.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1. 66.1014 (2) (d) 1. of the statutes is amended to read:

66.1014 (2) (d) 1. If a residential dwelling is rented for periods of more than 6
but fewer than 30 consecutive days, a political subdivision may limit the total
number of days within any consecutive 365-day period that the dwelling may be
rented to no fewer more than 180 90 days. The political subdivision may not specify
the period of time during which the residential dwelling may be rented, but the
political subdivision may require that the maximum number of allowable rental days
within a 365-day period must run consecutively. A person who rents the person's
residential dwelling shall notify the clerk of the political subdivision in writing when
the first rental within a 365-day period begins.
SECTION 2. 97.605 (1g) of the statutes is created to read:
97.605 (1g) No person may conduct, maintain, manage, or operate a tourist
rooming house for more than 90 days in a year.
