2023 ASSEMBLY BILL 79 
2023 Assembly Bill 79 creates a $5,000 prostitution crime surcharge that must be paid by a person 
convicted of any the following offenses: (1) patronizing prostitutes; (2) soliciting prostitutes; (3) 
pandering; and (4) keeping a place of prostitution.  
Of the moneys received from the surcharge, one-half of the money must be paid to the Department of 
Children and Families for treatment and services for sex-trafficking victims. The other half must be paid 
to the Department of Justice for criminal investigative operations and law enforcement relating to 
internet crimes against children, prosecution of internet crimes against children, and activities of state 
and local internet crimes against children task forces. 
ASSEMBLY AMENDMENT 1 
Assembly Amendment 1 adds two offenses to which the prostitution crime surcharge is applicable: (1) 
soliciting a child for prostitution; and (2) patronizing a child.

Representative Bodden introduced Assembly Amendment 1 on May 1, 2023. On May 18, 2023, the 
Assembly Committee on Criminal Justice and Public Safety voted to recommend adoption of Assembly 
Amendment 1 on a vote of Ayes, 13; Noes, 0; and voted to recommend passage of the bill, as amended, 
on a vote of Ayes, 11; Noes, 2.
