45 | 45 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
46 | 46 | | enact as follows: |

47 | 47 | | SECTION 1. 5.02 (4v) of the statutes is created to read: |
---|
48 | 48 | | 5.02 (4v) For purposes of chs. 5 to 10 and 12, “filing officer” means the following: |
---|
49 | 49 | | (a) For a candidate for state office, as defined in s. 5.02 (23), the elections |
---|
50 | 50 | | commission. |
---|
51 | 51 | | (b) For a candidate seeking local office, the clerk of the most populous |
---|
52 | 52 | | jurisdiction for which the candidate seeks office. |
---|
53 | 53 | | (c) For a candidate for municipal judge elected under s. 755.01 (4), the county |
---|
54 | 54 | | clerk or board of election commissioners of the county having the largest portion of |
---|
55 | 55 | | the population in the jurisdiction served by the judge. |

56 | 56 | | (d) For a candidate for school board member, the school district clerk. |

57 | 57 | | SECTION 2. 11.0101 (1) (a) 1. of the statutes is amended to read: |

100 | 100 | | a filing fee of $100 to the commission. The commission may accept payment under |

101 | 101 | | this subsection by credit card, debit card, or other electronic payment mechanism, |

102 | 102 | | and may charge a surcharge to that committee to recover the actual costs associated |
---|
103 | 103 | | with the acceptance of that electronic payment. |

104 | 104 | | SECTION 9. 11.0102 (2) (b) of the statutes is amended to read: |
---|
105 | 105 | | 11.0102 (2) (b) A committee that is subject to par. (a) shall pay the fee specified |
---|
106 | 106 | | in par. (a) together with the report filed by that committee on the 15th day of the |
---|
107 | 107 | | month of January in each year. If a committee that is subject to par. (a) registers |
---|
108 | 108 | | under this chapter or changes status so that par. (a) becomes applicable to the |
---|
109 | 109 | | committee during a calendar year, the committee shall pay the fee for that year with |
---|
110 | 110 | | the filing of the committee's registration statement or at any time before the change |
---|
111 | 111 | | in status becomes effective. |

144 | 144 | | SECTION 11. 11.0103 (1) (b) of the statutes is amended to read: |

148 | 148 | | SECTION 12. 11.0103 (3) (b) of the statutes is amended to read: |

149 | 149 | | 11.0103 (3) (b) Each committee shall ensure that each report is filed with the |

150 | 150 | | appropriate filing officer commission on the dates designated in this chapter. In the |
---|
151 | 151 | | event that any report is required to be filed under this chapter on a nonbusiness day, |

152 | 152 | | a committee may file the report on the next business day thereafter. |

153 | 153 | | SECTION 13. 11.0104 (1) (a) of the statutes is amended to read: |
---|
154 | 154 | | 11.0104 (1) (a) Except as provided in par. (bm), any committee which does not |
---|
155 | 155 | | anticipate accepting or making contributions, making disbursements, or incurring |
---|
156 | 156 | | obligations, and any conduit which does not anticipate accepting or releasing |
---|
157 | 157 | | contributions, in an aggregate amount exceeding $2,500 in a calendar year may |

158 | 158 | | claim an exemption from filing campaign finance reports by filing a registration |

200 | 200 | | SECTION 15. 11.0104 (2) of the statutes is amended to read: |

201 | 201 | | 11.0104 (2) Upon receipt of a properly executed registration statement or |

202 | 202 | | amended registration statement by a committee or conduit, the appropriate filing |
---|
203 | 203 | | officer commission shall suspend the requirement imposed upon that committee or |
---|
204 | 204 | | conduit by this chapter to file campaign finance reports. An exemption under this |
---|
205 | 205 | | section is effective as provided under sub. (1) (bm) unless the committee or conduit |
---|
206 | 206 | | alters its status by filing an amended registration statement before the end of such |
---|
207 | 207 | | year or by filing a termination report under s. 11.0105. |
---|
208 | 208 | | SECTION 16. 11.0105 (1) (a) of the statutes is amended to read: |
---|
209 | 209 | | 11.0105 (1) (a) Except as provided in par. (b), whenever any committee or |
---|
210 | 210 | | conduit dissolves or determines that obligations will no longer be incurred, |
---|
211 | 211 | | contributions will no longer be received or, in the case of a conduit, accepted and |
---|
212 | 212 | | released, and disbursements will no longer be made during a calendar year, and the |
---|
213 | 213 | | committee has no outstanding incurred obligations, the committee or conduit shall |
---|
214 | 214 | | file with the appropriate filing officer commission a termination report that indicates |

215 | 215 | | a cash balance of zero at the end of the reporting period. The committee or conduit |
