2222 This bill amends current law authority related to the possession,
2323 administration, and dispensing of epinephrine auto-injectors and prefilled syringes
2424 of epinephrine to instead include all epinephrine delivery systems.  Under the bill,
2525 “epinephrine delivery system” is defined to mean a device that is approved by the
2626 federal Food and Drug Administration, that contains a dose of epinephrine, and that

3939 is used to administer epinephrine into the human body to prevent or treat a
4040 life-threatening allergic reaction.
4141 Current law allows designated school personnel, school nurses, and other
4242 authorized entities and individuals who have completed a training program to
4343 provide or administer epinephrine auto-injectors and prefilled syringes to pupils
4444 and other individuals.  “Authorized entities” are those entities or organizations that
4545 operate or participate in a business, activity, or event where anaphylaxis-causing
4646 allergens may be present.  Authorized entities include restaurants, camps,
4747 institutions of higher education, places of employment, amusement parks, and
4848 sports leagues and arenas.  The bill allows the same individuals and entities to
4949 provide or administer any epinephrine delivery system.
5050 Under current law, pupils are also allowed to possess and use an epinephrine
5151 auto-injector or a prefilled syringe in certain circumstances while in school,
5252 participating in a school-sponsored activity, or under supervision by a school.  Under
5353 the bill, pupils are allowed to possess and use any epinephrine delivery system under
5454 those same circumstances.
5555 In addition, current law allows prescribers to prescribe epinephrine
5656 auto-injectors and prefilled syringes in the name of the school or the name of the
5757 authorized entity or individual.  The bill provides prescribing authority for any
5858 epinephrine delivery system.
5959 Finally, current law allows any prescriber to issue a standing order or a
6060 statewide standing order for the dispensing of epinephrine auto-injectors or
6161 prefilled syringes for use by trained individuals.  The bill allows prescribers to issue
6262 a standing order or statewide standing orders for any epinephrine delivery system
6363 for use by trained individuals.
6464 For further information see the state and local fiscal estimate, which will be
6565 printed as an appendix to this bill.
6666 The people of the state of Wisconsin, represented in senate and assembly, do
6767 enact as follows:
6868 SECTION 1. 118.29 (1) (bm) of the statutes is repealed.
6969 SECTION 2. 118.29 (1) (br) of the statutes is created to read:
7070 118.29 (1) (br)  “Epinephrine delivery system” means a device that is approved
7171 by the federal food and drug administration, that contains a dose of epinephrine, and
7272 that is used to administer epinephrine into the human body to prevent or treat a
7373 life-threatening allergic reaction.
7474 SECTION 3. 118.29 (2) (a) 2m. of the statutes is amended to read:

8686 118.29 (2) (a) 2m.  Except for epinephrine administered under subd. 2., may use
8787 an epinephrine auto-injector, or prefilled syringe, as defined in s. 118.292 (1g) (bm),
8888 epinephrine delivery system to administer epinephrine to any pupil who appears to
8989 be experiencing a severe allergic reaction if, as soon as practicable, the school bus
9090 operator, employee or volunteer reports the allergic reaction by dialing the telephone
9191 number “911" or, in an area in which the telephone number “911" is not available, the
9292 telephone number for an emergency medical service provider.
9393 SECTION 4. 118.292 (1g) (b) of the statutes is repealed.
9494 SECTION 5. 118.292 (1g) (bg) of the statutes is created to read:
9595 118.292 (1g) (bg)  “Epinephrine delivery system” means a device that is
9696 approved by the federal food and drug administration, that contains a dose of
9797 epinephrine, and that is used to administer epinephrine into the human body to
9898 prevent or treat a life-threatening allergic reaction.
9999 SECTION 6. 118.292 (1g) (bm) of the statutes is repealed.
100100 SECTION 7. 118.292 (1r) (intro.) of the statutes is amended to read:
101101 118.292 (1r) (intro.)  While in school, at a school-sponsored activity or under
102102 the supervision of a school authority, a pupil may possess and use an epinephrine
103103 auto-injector or prefilled syringe epinephrine delivery system if all of the following
104104 are true:
105105 SECTION 8. 118.292 (1r) (a) of the statutes is amended to read:
106106 118.292 (1r) (a)  The pupil uses the epinephrine auto-injector or prefilled
107107 syringe epinephrine delivery system to prevent the onset or alleviate the symptoms
108108 of an emergency situation.

153153 118.2925 (3)  PRESCRIPTIONS FOR SCHOOLS.  A physician, an advanced practice
154154 nurse prescriber, or a physician assistant may prescribe epinephrine auto-injectors
155155 or prefilled syringes epinephrine delivery systems in the name of a school that has
156156 adopted a plan under sub. (2) (a), to be maintained by the school for use under sub.
157157 (4).
158158 SECTION 16. 118.2925 (4) (a), (b) and (c) of the statutes are amended to read:

191191 prescription specific to the pupil that is on file with the school.
192192 (b)  Administer an epinephrine auto-injector or prefilled syringe epinephrine
193193 delivery system to a pupil in accordance with a prescription specific to the pupil that
194194 is on file with the school.
195195 (c)  Administer an epinephrine auto-injector or prefilled syringe epinephrine
196196 delivery system to a pupil or other person who the school nurse or designated school
197197 personnel in good faith believes is experiencing anaphylaxis in accordance with a
198198 standing protocol from a physician, an advanced practice nurse prescriber, or a
199199 physician assistant, regardless of whether the pupil or other person has a
200200 prescription for an epinephrine auto-injector or prefilled syringe epinephrine
201201 delivery system.  If the pupil or other person does not have a prescription for an
202202 epinephrine auto-injector or prefilled syringe, epinephrine delivery system, or the
203203 person who administers the epinephrine auto-injector or prefilled syringe
204204 epinephrine delivery system does not know whether the pupil or other person has a
205205 prescription for an epinephrine auto-injector or prefilled syringe epinephrine
206206 delivery system, the person who administers the epinephrine auto-injector or
207207 prefilled syringe epinephrine delivery system shall, as soon as practicable, report the
208208 administration by dialing the telephone number “911" or, in an area in which the
209209 telephone number “911" is not available, the telephone number for an emergency
210210 medical service provider.
211211 SECTION 17. 118.2925 (4m) (a) of the statutes is amended to read:
212212 118.2925 (4m) (a)  The authority to self-administer an epinephrine
213213 auto-injector or prefilled syringe epinephrine delivery system under sub. (4) (a) is

242242 SECTION 18. 118.2925 (4m) (b) of the statutes is amended to read:
243243 118.2925 (4m) (b)  The authority to administer an epinephrine auto-injector or
244244 prefilled syringe epinephrine delivery system under sub. (4) (b) and (c) is
245245 independent of the authority to administer an epinephrine auto-injector
246246 epinephrine delivery system under s. 118.29 (2) (a) 2. and 2m.
247247 SECTION 19. 118.2925 (5) of the statutes is amended to read:
248248 118.2925 (5)  IMMUNITY FROM CIVIL LIABILITY; EXEMPTION FROM PRACTICE OF
249249 MEDICINE.  A school and its designated school personnel, and a physician, advanced
250250 practice nurse prescriber, or physician assistant who provides a prescription or
251251 standing protocol for school epinephrine auto-injectors or prefilled syringes
252252 epinephrine delivery systems, are not liable for any injury that results from the
253253 administration or self-administration of an epinephrine auto-injector or prefilled
254254 syringe epinephrine delivery system under this section, regardless of whether
255255 authorization was given by the pupil's parent or guardian or by the pupil's physician,
256256 physician assistant, or advanced practice nurse prescriber, unless the injury is the
257257 result of an act or omission that constitutes gross negligence or willful or wanton
258258 misconduct.  The immunity from liability provided under this subsection is in
259259 addition to and not in lieu of that provided under s. 895.48.
260260 SECTION 20. 255.07 (1) (c) of the statutes is repealed.
261261 SECTION 21. 255.07 (1) (cm) of the statutes is created to read:
262262 255.07 (1) (cm)  “Epinephrine delivery system” means a device that is approved
263263 by the federal food and drug administration, that contains a dose of epinephrine, and

294294 SECTION 22. 255.07 (1) (e) of the statutes is repealed.
295295 SECTION 23. 255.07 (2) (a) of the statutes is amended to read:
296296 255.07 (2) (a)  A health care practitioner may prescribe an epinephrine
297297 auto-injector or prefilled syringe epinephrine delivery system in the name of an
298298 authorized entity or an authorized individual for use in accordance with this section.
299299 A health care practitioner may issue to one or more persons a standing order
300300 authorizing the dispensing of epinephrine auto-injectors or prefilled syringes
301301 epinephrine delivery systems for use under sub. (4) by an authorized individual or
302302 by an employee or agent of an authorized entity who has completed the training
303303 required by sub. (5).
304304 SECTION 24. 255.07 (2) (b) of the statutes is amended to read:
305305 255.07 (2) (b)  A health care provider with prescribing authority who is
306306 employed by or under contract with the department may issue a statewide standing
307307 order for the dispensing of epinephrine auto-injectors or prefilled syringes
308308 epinephrine delivery systems for use under sub. (4) by authorized individuals or by
309309 employees or agents of authorized entities who have completed the training required
310310 by sub. (5).
311311 SECTION 25. 255.07 (3) of the statutes is amended to read:
312312 255.07 (3)  AUTHORIZED ENTITIES OR INDIVIDUALS PERMITTED TO MAINTAIN SUPPLY.
313313 An authorized entity or an authorized individual may acquire and maintain a supply
314314 of epinephrine auto-injectors and prefilled syringes epinephrine delivery systems
315315 pursuant to a prescription issued in accordance with this section.  The authorized
316316 entity or authorized individual shall store an epinephrine auto-injector or prefilled

344344 syringe epinephrine delivery system in a location readily accessible in an emergency
345345 and in accordance with the epinephrine auto-injector's or prefilled syringe's
346346 epinephrine delivery system's instructions for use.  An authorized entity shall
347347 designate an employee or agent who has completed the training required in sub. (5)
348348 to be responsible for the storage, maintenance, control, and general oversight of
349349 epinephrine auto-injectors or prefilled syringes epinephrine delivery systems
350350 acquired by the authorized entity.
351351 SECTION 26. 255.07 (4) of the statutes is amended to read:
352352 255.07 (4)  USE OF EPINEPHRINE.  An employee or agent of an authorized entity
353353 who has completed the training required by sub. (5) or an authorized individual may
354354 use an epinephrine auto-injector or prefilled syringe epinephrine delivery system
355355 prescribed under sub. (2) to do any of the following:
356356 (a)  Provide one or more epinephrine auto-injectors or prefilled syringes
357357 epinephrine delivery systems to any individual who the employee, agent, or
358358 authorized individual believes in good faith is experiencing anaphylaxis, or to the
359359 parent, guardian, or caregiver of that individual for immediate administration,
360360 regardless of whether the individual has a prescription for an epinephrine
361361 auto-injector or prefilled syringe epinephrine delivery system or has previously been
362362 diagnosed with an allergy.
363363 (b)  Administer an epinephrine auto-injector or prefilled syringe epinephrine
364364 delivery system to any individual who the employee, agent, or authorized individual
365365 believes in good faith is experiencing anaphylaxis, regardless of whether the
366366 individual has a prescription for an epinephrine auto-injector or prefilled syringe
367367 epinephrine delivery system or has previously been diagnosed with an allergy.
368368 SECTION 27. 255.07 (5) (a) 2. of the statutes is amended to read:

408408 results from the administration or failure to administer an epinephrine
409409 auto-injector or prefilled syringe epinephrine delivery system under this section,
410410 unless the injury is the result of an act or omission that constitutes gross negligence
411411 or willful or wanton misconduct:
412412 SECTION 30. 255.07 (6) (a) 1., 2. and 3. of the statutes are amended to read:
413413 255.07 (6) (a) 1.  An authorized entity or authorized individual that possesses
414414 and makes available an epinephrine auto-injector or prefilled syringe epinephrine
415415 delivery system and employees, agents, and authorized individuals that store,
416416 maintain, control, oversee, provide, or use an epinephrine auto-injector or prefilled
417417 syringe epinephrine delivery system.
418418 2.  A health care practitioner who prescribes or dispenses an epinephrine
419419 auto-injector or prefilled syringe epinephrine delivery system to an authorized
420420 entity or authorized individual.

447447 or prefilled syringe epinephrine delivery system to an authorized entity or
448448 authorized individual.
449449 SECTION 31. 255.07 (6) (b) of the statutes is amended to read:
450450 255.07 (6) (b)  The use of an epinephrine auto-injector or prefilled syringe
451451 epinephrine delivery system under this section does not constitute the practice of
452452 medicine or of any other health care profession that requires a credential to practice.
453453 SECTION 32. 255.07 (6) (d) of the statutes is amended to read:
454454 255.07 (6) (d)  A person is not liable for any injuries or related damages that
455455 result from providing or administering an epinephrine auto-injector or prefilled
456456 syringe epinephrine delivery system outside of this state if the person satisfies any
457457 of the following criteria:
458458 1.  The person would not have been liable for injuries or damages if the
459459 epinephrine auto-injector or prefilled syringe epinephrine delivery system was
460460 provided or administered in this state.
461461 2.  The person is not liable for injuries or damages under the law of the state
462462 in which the epinephrine auto-injector or prefilled syringe epinephrine delivery
463463 system was provided or administered.
464464 SECTION 33. 255.07 (6) (e) of the statutes is amended to read:
465465 255.07 (6) (e)  Nothing in this section creates or imposes any duty, obligation,
466466 or basis for liability on any authorized entity, or employees, agents, or authorized
467467 individuals, to acquire or make available an epinephrine auto-injector or prefilled
468468 syringe epinephrine delivery system.
469469 SECTION 34. 255.07 (6) (f) of the statutes is amended to read:

499499 or basis for liability on any employer or any other person to supervise or exercise
500500 control over an individual's provision or administration of an epinephrine

502502 other person reasonably believes the individual is acting as an authorized individual
503503 under this section.
504504 SECTION 35. 448.03 (2) (q) of the statutes is amended to read:
505505 448.03 (2) (q)  The administration of an epinephrine auto-injector or prefilled
506506 syringe epinephrine delivery system in accordance with s. 118.2925 or 255.07.
507507 SECTION 36. 450.11 (4) (a) 5. d. of the statutes is amended to read:
508508 450.11 (4) (a) 5. d.  For an epinephrine auto-injector or prefilled syringe
509509 prescribed epinephrine delivery system under s. 118.2925 (3) or 255.07 (2), the name
510510 of the school, authorized entity, authorized individual, or other person specified
511511 under s. 255.07 (3).
