23	23	Analysis by the Legislative Reference Bureau
24	24	Under current law it is a Class D felony to traffick an adult for the purpose of
25	25	commercial sex acts and it is a Class C felony to traffick a child for the purpose of
26	26	commercial sex acts. This bill increases the felony classification to a Class C felony
27	27	for trafficking an adult for the purpose of commercial sex acts if the adult is an adult

41	41	at risk. Under the bill, an “adult at risk” is defined as an adult who has a physical
42	42	or mental condition that substantially impairs his or her ability to care for his or her
43	43	needs and who has experienced, is currently experiencing, or is at risk of
44	44	experiencing abuse, neglect, self-neglect, or financial exploitation.
45	45	Because this bill creates a new crime or revises a penalty for an existing crime,
46	46	the Joint Review Committee on Criminal Penalties may be requested to prepare a
47	47	report.
48	48	The people of the state of Wisconsin, represented in senate and assembly, do
49	49	enact as follows:
50	50	SECTION 1. 48.371 (3) (d) of the statutes is amended to read:
51	51	48.371 (3) (d) Any involvement of the child, whether as victim or perpetrator,
52	52	in sexual intercourse or sexual contact in violation of s. 940.225, 948.02, 948.025, or
53	53	948.085, prostitution in violation of s. 944.30 (1m), trafficking in violation of s.
54	54	940.302 (2) if s. 940.302 (2) (a) 1. b. applies or in violation of s. 940.303, sexual
55	55	exploitation of a child in violation of s. 948.05, trafficking of a child in violation of s.
56	56	948.051, or causing a child to view or listen to sexual activity in violation of s.
57	57	948.055, if the information is necessary for the care of the child or for the protection
58	58	of any person living in the foster home, group home, or residential care center for
59	59	children and youth or in the home of the relative.
60	60	SECTION 2. 103.10 (1m) (b) 6. of the statutes is amended to read:
61	61	103.10 (1m) (b) 6. “Sexual abuse" means conduct that is in violation of s.
62	62	940.225, 940.303, 944.30 (1m), 948.02, 948.025, 948.05, 948.051, 948.055, 948.06,
63	63	948.085, 948.09, or 948.10 or that is in violation of s. 940.302 (2) if s. 940.302 (2) (a)

298	298	SECTION 25. 940.302 (2) (a) (intro.) of the statutes is amended to read:
299	299	940.302 (2) (a) (intro.) Except as provided in s. 940.303 or 948.051, whoever
300	300	knowingly engages in trafficking is guilty of a Class D felony if all of the following

303	303	940.303 Trafficking of an adult at risk. (1) In this section:
304	304	(a) “Adult at risk” has the meaning given in s. 55.01 (1e).
305	305	(b) “Commercial sex act” has the meaning given in s. 940.302 (1) (a).
306	306	(2) Whoever knowingly recruits, entices, provides, obtains, harbors,
307	307	transports, patronizes, or solicits or knowingly attempts to recruit, entice, provide,
308	308	obtain, harbor, transport, patronize, or solicit an adult at risk for the purpose of
309	309	commercial sex acts is guilty of a Class C felony.
310	310	(3) Whoever benefits in any manner from a violation of sub. (2) is guilty of a
311	311	Class C felony if the person knows that the benefits come from an act described in
312	312	sub. (2).
313	313	(4) Any person who incurs an injury or death as a result of a violation of sub.
314	314	(2) or (3) may bring a civil action against the person who committed the violation.
315	315	In addition to actual damages, the court may award punitive damages to the injured
316	316	party, not to exceed treble the amount of actual damages incurred, and reasonable
317	317	attorney fees.
318	318	SECTION 27. 941.29 (1g) (a) of the statutes, as affected by 2023 Wisconsin Act
319	319	10, is amended to read:
320	320	941.29 (1g) (a) “Violent felony" means any felony under s. 943.23 (1m), 1999
