88 AN ACT to amend 20.370 (4) (hq) and 287.21 (intro.); and to create 287.25 of the
99 statutes; relating to: education about rechargeable batteries and providing
1010 grants for collecting and recycling rechargeable batteries.
1111 Analysis by the Legislative Reference Bureau
1212 Current law requires the Department of Natural Resources to prepare
1313 educational materials about municipal and county solid waste management
1414 programs.  This bill requires DNR to also prepare educational materials to inform
1515 the public about the dangers of rechargeable batteries in the waste and recycling
1616 streams and about existing options for properly recycling rechargeable batteries.
1717 The bill also requires DNR to provide grants to responsible units,
1818 municipalities, businesses, tribal governments, and nonprofit organizations for the
1919 purpose of expanding rechargeable battery collection and recycling operations,
2020 creating new sites for the collection or recycling of rechargeable batteries,
2121 purchasing rechargeable battery collection and shipping kits and equipment for
2222 handling damaged or defective rechargeable batteries, and transporting
2323 rechargeable batteries to third-party collection and recycling facilities.  DNR may
2424 provide more than one grant to a single responsible unit, municipality, business,
2525 tribal government, or nonprofit organization; however, DNR may not provide a total
2626 amount of more than $20,000 to a single collection site.
2727 Under the bill, DNR must also provide grants to solid waste facilities and
2828 materials recovery facilities for the purpose of installing, upgrading, or expanding
2929 fire detection and suppression systems to address the increased risk of fire due to the

3535 presence of rechargeable batteries in the waste and recycling streams.  DNR may
3636 provide more than one grant to a single solid waste facility or materials recovery
3737 facility; however, DNR may not provide a total amount of more than $50,000 to a
3838 single solid waste facility or materials recovery facility.
3939 In addition, current law provides an appropriation to DNR from the segregated
4040 environmental fund for various environmental programs and for the administration
4141 of this state's solid waste reduction, recovery, and recycling programs.  The bill allows
4242 this appropriation to be used for the existing statewide program to educate
4343 government employees, businesses, and the general public about the dangers of
4444 rechargeable batteries in the waste and recycling streams and about existing options
4545 for proper recycling of such batteries.
4646 Finally, under the bill, DNR must submit a request to the Joint Committee on
4747 Finance for supplemental funding, not to exceed $10,000,000, for these purposes.

4949 printed as an appendix to this bill.
5050 The people of the state of Wisconsin, represented in senate and assembly, do
5151 enact as follows:
5252 SECTION 1. 20.370 (4) (hq) of the statutes is amended to read:
5353 20.370 (4) (hq)  Recycling; administration.  From the environmental fund, the
5454 amounts in the schedule for the administration of subch. II of ch. 287, other than ss.
5555 287.21 and s. 287.23.
5656 SECTION 2. 287.21 (intro.) of the statutes is amended to read:
5757 287.21  Statewide education program.  (intro.)  The department shall
5858 collect, prepare, and disseminate information and conduct educational and training
5959 programs designed to assist in the implementation of solid waste management and
6060 recycling programs under ss. 287.01 to 287.27,; enhance municipal and county solid
6161 waste management and recycling programs under s. 287.09 (2) (a) and; inform the
6262 public of the relationship among an individual's consumption of goods and services,
6363 the generation of different types and quantities of solid waste, and the
6464 implementation of the solid waste management and recycling priorities in s. 287.05
6565 (12); and inform the public about the dangers of rechargeable batteries in the waste

8484 and recycling streams and about existing options for proper recycling of such
8585 batteries.  The department shall prepare the information and programs on a
8686 statewide basis for the following groups:
8787 SECTION 3. 287.25 of the statutes is created to read:
8888 287.25  Grants for rechargeable battery recycling.  (1)  In this section,
8989 “rechargeable battery” means a battery that contains one or more voltaic or galvanic
9090 cells, electrically connected to produce electric energy, and that is designed to be
9191 recharged, including lithium-ion batteries.
9292 (2) (a)  The department shall create and administer a program to provide grants
9393 to expand rechargeable battery recycling and recovery programs.  The department
9494 shall provide grants under this subsection to responsible units, municipalities,
9595 businesses, tribal governments, and nonprofit organizations for any of the following
9696 purposes:
9797 1.  For grant recipients that collect and recycle rechargeable batteries,
9898 expanding operations and ensuring continued operations.
9999 2.  Creating new sites for the collection or recycling of rechargeable batteries.
100100 3.  Purchasing rechargeable battery collection and shipping kits and equipment
101101 for handling damaged or defective rechargeable batteries.
102102 4.  Transporting rechargeable batteries to 3rd-party collection and recycling
103103 facilities.
104104 (b)  The department may provide more than one grant under this subsection to
105105 a single responsible unit, municipality, business, tribal government, or nonprofit
106106 organization in the same grant cycle.  The department may not provide grants under
107107 this subsection to a single collection site in a total amount greater than $20,000 in
108108 the same grant cycle.

136136 (3) (a)  The department shall create and administer a program to provide grants
137137 to solid waste facilities and materials recovery facilities for the purpose of installing,

139139 increased risk of fire due to the presence of rechargeable batteries in the waste and
140140 recycling streams.
141141 (b)  The department may not provide grants under this subsection to a single
142142 solid waste facility or materials recovery facility in a total amount greater than
143143 $50,000 in the same grant cycle.
144144 SECTION 4.0Nonstatutory provisions.
145145 (1)  SUPPLEMENTAL FUNDING REQUESTS.
146146 (a)  In the 2023-25 fiscal biennium, the department of natural resources shall
147147 request under s. 13.101 (3) that the joint committee on finance supplement the
148148 appropriation under s. 20.370 (4) (hq) with sufficient funds from the environmental
149149 fund for the purpose of providing education to the public under s. 287.21 about the
150150 dangers of rechargeable batteries in the waste and recycling streams and about
151151 existing options for proper recycling of such batteries.  The department shall submit
152152 additional such requests as needed for this purpose after the 2023-25 fiscal
153153 biennium.
154154 (b)  In the 2023-25 fiscal biennium, the department of natural resources shall
155155 request under s. 13.101 (3) that the joint committee on finance supplement the
156156 appropriation under s. 20.370 (4) (hq) with sufficient funds from the environmental
157157 fund for the purpose of providing grants under s. 287.25.  The department shall
158158 submit additional such requests as needed for this purpose after the 2023-25 fiscal
159159 biennium.

188188 (c)  The joint committee on finance may not provide supplements under this
189189 subsection in a total amount greater than $10,000,000.  The committee may provide
190190 supplements under this subsection without finding that an emergency exists under
191191 s. 13.101 (3) (a) 1.
