14 | 14 | | Under current law, certain individuals who qualify to receive payments under |

15 | 15 | | the federal Supplemental Security Income program are eligible to receive additional |
---|
16 | 16 | | payments under a supplemental payment program administered by the Department |
---|
17 | 17 | | of Health Services. This bill requires DHS to increase the payments to individuals |
---|
18 | 18 | | under the supplemental payment program based on the percentage change in the |
---|
19 | 19 | | consumer price index for all urban consumers, U.S. city average, as determined by |
---|
20 | 20 | | the federal Bureau of Labor Statistics of the U.S. Department of Labor between |
---|
21 | 21 | | December 31, 1994, and December 31, 2022, and annually thereafter based on the |
---|
22 | 22 | | percentage change in the same consumer price index between December 31 of the |
---|
23 | 23 | | preceding year and December 31 of the year before the preceding year. |

28 | 28 | | SECTION 1. 49.77 (1) of the statutes is renumbered 49.77 (1) (intro.) and |

37 | 37 | | 49.77 (1) DEFINITION DEFINITIONS. (intro.) In this section “secretary": |
---|
38 | 38 | | (b) “Secretary” means the secretary of the U.S. department of health and |
---|
39 | 39 | | human services or the secretary of any other federal agency subsequently charged |
---|
40 | 40 | | with the administration of federal Title XVI. |

41 | 41 | | SECTION 2. 49.77 (1) (a) of the statutes is created to read: |

42 | 42 | | 49.77 (1) (a) “Consumer price index” means the average of the consumer price |
---|
43 | 43 | | index for all urban consumers, U.S. city average, as determined by the bureau of |
---|
44 | 44 | | labor statistics of the U.S. department of labor. |

45 | 45 | | SECTION 3. 49.77 (2r) of the statutes is created to read: |

46 | 46 | | 49.77 (2r) COST OF LIVING ADJUSTMENT. (a) On the effective date of this |
---|
47 | 47 | | paragraph .... [LRB inserts date], the department shall adjust the amount of |
---|
48 | 48 | | supplemental payments under this section by the percentage difference between the |

49 | 49 | | consumer price index for the 12-month period ending on December 31, 1994, and the |

51 | 51 | | (b) By no later than July 1 of each year, beginning on July 1, 2024, the |

52 | 52 | | department shall adjust the amount of supplemental payments under this section |

53 | 53 | | by the percentage difference between the consumer price index for the 12-month |
---|
54 | 54 | | period ending on December 31 of the preceding year and the consumer price index |
---|
55 | 55 | | for the 12-month period ending on December 31 of the year before the preceding year. |
