AN ACT to renumber and amend 49.77 (1); and to create 49.77 (1) (a) and 49.77
(2r) of the statutes; relating to: increasing state supplemental payments based
on cost of living adjustments.
Analysis by the Legislative Reference Bureau
Under current law, certain individuals who qualify to receive payments under
the federal Supplemental Security Income program are eligible to receive additional
payments under a supplemental payment program administered by the Department
of Health Services. This bill requires DHS to increase the payments to individuals
under the supplemental payment program based on the percentage change in the
consumer price index for all urban consumers, U.S. city average, as determined by
the federal Bureau of Labor Statistics of the U.S. Department of Labor between
December 31, 1994, and December 31, 2022, and annually thereafter based on the
percentage change in the same consumer price index between December 31 of the
preceding year and December 31 of the year before the preceding year.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1. 49.77 (1) of the statutes is renumbered 49.77 (1) (intro.) and
amended to read:

49.77 (1) DEFINITION DEFINITIONS. (intro.) In this section “secretary":
(b) “Secretary” means the secretary of the U.S. department of health and
human services or the secretary of any other federal agency subsequently charged
with the administration of federal Title XVI.
SECTION 2. 49.77 (1) (a) of the statutes is created to read:
49.77 (1) (a) “Consumer price index” means the average of the consumer price
index for all urban consumers, U.S. city average, as determined by the bureau of
labor statistics of the U.S. department of labor.
SECTION 3. 49.77 (2r) of the statutes is created to read:
49.77 (2r) COST OF LIVING ADJUSTMENT. (a) On the effective date of this
paragraph .... [LRB inserts date], the department shall adjust the amount of
supplemental payments under this section by the percentage difference between the
consumer price index for the 12-month period ending on December 31, 1994, and the
consumer price index for the 12-month period ending on December 31, 2022.
(b) By no later than July 1 of each year, beginning on July 1, 2024, the
department shall adjust the amount of supplemental payments under this section
by the percentage difference between the consumer price index for the 12-month
period ending on December 31 of the preceding year and the consumer price index
for the 12-month period ending on December 31 of the year before the preceding year.
