13	13	AN ACT to amend 111.70 (4) (mc) 6. of the statutes; relating to: the design of
14	14	health care coverage plans for public safety employees.

16	16	Under current law, municipal employees who are public safety employees, such
17	17	as police officers, fire fighters, and emergency medical service providers for
18	18	emergency medical services departments, may bargain collectively over wages,
19	19	hours, and conditions of employment. Public safety employees, however, may not
20	20	bargain over a subject that is identified as a prohibited subject of bargaining. Under
21	21	current law, all costs and payments associated with health care coverage plans and
22	22	the design and selection of health care coverage plans by a municipal employer for
23	23	public safety employees, as well as the impact of the costs and payments and the
24	24	design and selection of the plans on wages, hours, and conditions of employment of
25	25	public safety employees, are prohibited subjects of bargaining for public safety
26	26	employees.
27	27	This bill clarifies that for purposes of the prohibition against bargaining over
28	28	the design of a health care coverage plan selected by a municipal employer, design
29	29	does not include who is covered by the health care coverage plan. In other words,
30	30	public safety employees may bargain with a municipal employer about who will be
31	31	covered by a health care coverage plan selected by the municipal employer. In
32	32	addition, this bill clarifies that the initial decision of whether or not to provide health
33	33	care coverage is a permitted subject of bargaining between a municipal employer and
34	34	public safety employees.

41	41	The people of the state of Wisconsin, represented in senate and assembly, do
42	42	enact as follows:
43	43	SECTION 1. 111.70 (4) (mc) 6. of the statutes is amended to read:
44	44	111.70 (4) (mc) 6. Except for whether or not to provide health care coverage and
45	45	the employee premium contribution, all costs and payments associated with health
46	46	care coverage plans and the design and selection of health care coverage plans by the
47	47	municipal employer for public safety employees, and the impact of such costs and
48	48	payments and the design and selection of the health care coverage plans on the
49	49	wages, hours, and conditions of employment of the public safety employee. For
50	50	purposes of this subdivision, “design” does not include the decision as to who is
51	51	covered by a health care coverage plan selected by the municipal employer.
52	52	SECTION 2.0Nonstatutory provisions.
53	53	(1) LEGISLATIVE INTENT STATEMENT. The legislature intends that the treatment
54	54	of s. 111.70 (4) (mc) 6. by this act is to clarify the intent of 2011 Wisconsin Acts 10 and
55	55	32 and that this act is to be considered a restatement of current law.
