10-The people of the state of Wisconsin, represented in
11-senate and assembly, do enact as follows:
12-SECTION 1. 13.48 (26) of the statutes is amended to
13-read:
14-13.48 (26)  ENVIRONMENTAL IMPROVEMENT ANNUAL
15-FINANCE PLAN APPROVAL.  The building commission shall
16-review the versions of the biennial finance plan and any
17-amendments to the biennial finance plan submitted to it
18-by the department of natural resources and the depart-
19-ment of administration under s. 281.59 (3) (bm) and the
20-recommendations of the joint committee on finance and
21-the standing committees to which the versions of the
22-biennial finance plan and any amendments were submit-
23-ted under s. 281.59 (3) (bm).  The building commission
24-shall consider the extent to which that version of the bien-
25-nial finance plan that is updated to reflect the adopted
26-biennial budget act will maintain the funding for the
27-clean water fund program and the safe drinking water
28-loan program, in the environmental improvement fund,
29-in perpetuity.  The building commission shall consider
30-the extent to which the implementation of the clean water
31-fund program, and the safe drinking water loan program
32-and the land recycling loan program, as set forth in the
33-biennial finance plan updated to reflect the adopted bien-
34-nial budget act, implements legislative intent on the clean
35-water fund program, and the safe drinking water loan pro-
36-gram and the land recycling loan program.  The building
37-commission shall, no later than 60 days after the date of
38-enactment of the biennial budget act, either approve or
39-disapprove the biennial finance plan that is updated to
40-reflect the adopted biennial budget act.  If the building
41-commission disapproves the version of the biennial
42-finance plan that is updated to reflect the adopted biennial
43-budget act, it must notify the department of natural
44-resources and the department of administration of its rea-
45-sons for disapproving the plan, and those departments
46-must revise that version of the biennial finance plan and
47-submit the revision to the building commission.
48-SECTION 2. 20.320 (1) (sm) of the statutes is repealed.
49-SECTION 3. 20.370 (4) (mt) of the statutes is amended
50-to read:
51-20.370 (4) (mt)  General program operations — envi-
52-ronmental improvement programs; state funds.  From the
53-environmental improvement fund, the amounts in the
54-schedule for general program operations under s. 281.58,

59-SECTION 4. 20.370 (9) (mt) of the statutes is amended
60-to read:
61-20.370 (9) (mt)  Aids administration — environmen-
62-tal improvement programs; state funds.  From the envi-
63-ronmental improvement fund, the amounts in the sched-
64-ule for the administration of ss. 281.58, 281.60, 281.61,
65-281.62, and 283.31 and s. 281.60, 2021 stats.
66-SECTION 5. 20.505 (1) (v) of the statutes is amended
67-to read:
68-20.505 (1) (v)  General program operations — envi-
69-ronmental improvement programs; state funds.  From the
70-environmental improvement fund, the amounts in the
71-schedule for general program operations under s. 281.58,
72-281.59, 281.60 or 281.61 or s. 281.60, 2021 stats.
73-SECTION 6. 20.536 (1) (ka) of the statutes is amended
74-to read:
75-20.536 (1) (ka)  General program operations; envi-
76-ronmental improvement fund.  All moneys received for
77-providing services to the department of administration or
78-the department of natural resources in administering ss.
79-25.43, 281.58, 281.59, 281.60, 281.61, and 281.62 and s.

81-SECTION 7. 25.43 (1) (h) of the statutes is amended
82-to read:
83-25.43 (1) (h)  The fees imposed under ss. 281.58 (9)
84-(d), 281.60 (11m), and 281.61 (5) (b) and s. 281.60
85-(11m), 2021 stats.
86-SECTION 8. 25.43 (2s) (a) 2. of the statutes is amended

88-25.43 (2s) (a) 2.  The difference between $20,000,000

98-(9) (mt), (mx) and (ny), 20.505 (1) (v), (x) and (y),

101-SECTION 10. 67.12 (12) (a) of the statutes is amended
102-to read:
103-67.12 (12) (a)  Any municipality may issue promis-
104-sory notes as evidence of indebtedness for any public
105-purpose, as defined in s. 67.04 (1) (b), including but not
106-limited to paying any general and current municipal
107-expense, and refunding any municipal obligations,
108-including interest on them.  Each note, plus interest if any,
109-shall be repaid within 10 years after the original date of
110-the note, except that notes issued under this section for
111-purposes of ss. 119.498, 281.58, 281.59, 281.60, 281.61,
112-and 292.72 and s. 281.60, 2021 stats., issued to raise
113-funds to pay a portion of the capital costs of a metropoli-
114-tan sewerage district, or issued by a 1st class city or a
115-county having a population of 750,000 or more, to pay
116-unfunded prior service liability with respect to an
117-employee retirement system, shall be repaid within 20
118-years after the original date of the note.
119-SECTION 11. 281.59 (1) (as) of the statutes is
120-repealed.
121-SECTION 12. 281.59 (2) (a) of the statutes is amended
122-to read:
123-281.59 (2) (a)  Administer its responsibilities under
124-this section and ss. 281.58, 281.60 and 281.61 and s.
125-281.60, 2021 stats.
126-SECTION 13. 281.59 (2) (b) of the statutes is amended

129-administering the clean water fund program, and the safe
130-drinking water loan program and the land recycling loan

132-under s. 281.60, 2021 stats.
133-SECTION 14. 281.59 (3) (a) 1. of the statutes is
134-amended to read:
135-281.59 (3) (a) 1.  An estimate of the wastewater treat-
136-ment, and safe drinking water and land recycling project
137-needs of the state for the 4 fiscal years of the next 2 bien-
138-nia.
139-SECTION 15. 281.59 (3) (a) 5. of the statutes is
140-amended to read:
141-281.59 (3) (a) 5.  The most recent available audited
142-financial statements of the past operations and activities
143-of the clean water fund program, and the safe drinking
144-water loan program and the land recycling loan program,
145-the estimated environmental improvement fund capital
146-available in each of the next 4 fiscal years for the clean
147-water fund program and the safe drinking water loan pro-
148-gram, and the projected environmental improvement
149-fund balance for the clean water fund program and the
150-safe drinking water loan program for each of the next 20
151-years given existing obligations and financial conditions.
152-SECTION 16. 281.59 (3) (j) of the statutes is amended
153-to read:
154-281.59 (3) (j)  No later than November 1 of each odd−
155-numbered year, the department of administration and the
156-department jointly shall submit a report, to the building
157-commission and committees as required under par. (bm),
158-on the operations and activities of the clean water fund
159-program, and the safe drinking water loan program and
160-the land recycling loan program for the previous bien-
161-nium.
162-SECTION 17. 281.59 (9) (a) of the statutes is repealed.
163-SECTION 18. 281.59 (9) (am) of the statutes is
164-amended to read:
165-281.59 (9) (am)  The department of administration, in
166-consultation with the department, may establish those
167-terms and conditions of a financial assistance agreement
168-that relate to its financial management, including what  − 3 − 2023 Wisconsin Act 6 2023 Senate Bill 13
169-type of municipal obligation, as set forth under sub. (13f),
170-if applicable, is required for the repayment of the finan-
171-cial assistance.  Any terms and conditions established
172-under this paragraph by the department of administration
173-shall comply with the requirements of this section and s.
174-281.58, 281.60 or 281.61.  In setting the terms and condi-
175-tions, the department of administration may consider fac-
176-tors that the department of administration finds are rele-
177-vant, including the type of obligation evidencing the
178-loan, the pledge of security for the obligation and the
179-applicant’s creditworthiness.
180-SECTION 19. 281.59 (9) (b) (intro.) of the statutes is
181-amended to read:
182-281.59 (9) (b) (intro.)  As a condition of receiving
183-financial assistance under the clean water fund program,
184-or the safe drinking water loan program or the land recy-
185-cling loan program, an applicant shall do all of the fol-
186-lowing:
187-SECTION 20. 281.59 (9) (b) 1. of the statutes is
188-amended to read:
189-281.59 (9) (b) 1.  Pledge the security, if any, required
190-by the rules promulgated by the department of adminis-
191-tration under this section and s. 281.58, 281.60 or 281.61.
192-SECTION 21. 281.59 (11) (a) of the statutes is
193-amended to read:
194-281.59 (11) (a)  The department of natural resources
195-and the department of administration may enter into a
196-financial assistance agreement with an applicant for
197-which the department of administration has allocated
198-financial assistance under s. 281.58 (9m), 281.60 (8) or
199-281.61 (8) if the applicant meets the conditions under
200-sub. (9) and the other requirements under this section and
201-s. 281.58, 281.60 or 281.61.
202-SECTION 22. 281.59 (11) (b) of the statutes is
203-amended to read:
204-281.59 (11) (b)  If a municipality fails to make a prin-
205-cipal repayment or interest payment after its due date, the
206-department of administration shall place on file a certi-
207-fied statement of all amounts due under this section and
208-s. 281.58, 281.60 or 281.61 or s. 281.60, 2021 stats.  After
209-consulting the department, the department of administra-
210-tion may collect all amounts due by deducting those
211-amounts from any state payments due the municipality or
212-may add a special charge to the amount of taxes appor-
213-tioned to and levied upon the county under s. 70.60.  If the
214-department of administration collects amounts due, it
215-shall remit those amounts to the fund to which they are
216-due and notify the department of that action.
217-SECTION 23. 281.59 (11) (c) of the statutes is
218-amended to read:
219-281.59 (11) (c)  The department of administration
220-may retain the last payment under a financial assistance
221-agreement until the department of natural resources and
222-the department of administration determine that the proj-
223-ect is completed and meets the applicable requirements
224-of this section and s. 281.58, 281.60 or 281.61 or s.
225-281.60, 2021 stats., and that the conditions of the finan-
226-cial assistance agreement are met.
227-SECTION 24. 281.59 (13s) of the statutes is amended
228-to read:
229-281.59 (13s)  POWERS.  The department of administra-
230-tion may audit, or contract for audits of, projects receiv-
231-ing financial assistance under the clean water fund pro-
232-gram, or the safe drinking water loan program and the
233-land recycling loan program or projects that received
234-loans under s. 281.60, 2021 stats.
235-SECTION 25. 281.59 (14) of the statutes is amended
236-to read:
237-281.59 (14)  RULES.  The department of administra-
238-tion shall promulgate rules that are necessary for the
239-proper execution of this section and of its responsibilities
240-under ss. 281.58, 281.60 and 281.61 and s. 281.60, 2021
241-stats.
242-SECTION 26. 281.60 of the statutes is repealed.
243-SECTION 27. 281.605 of the statutes is created to read:
244-281.605  Outstanding loans under the former land
245-recycling loan program.  Section 281.60 (8m), 2021
246-stats., s. 281.60 (11), 2021 stats., s. 281.60 (11m), 2021
247-stats., s. 281.60 (13) (c), 2021 stats., s. 281.60 (13) (d),
248-2021 stats., s. 281.60 (13) (f), 2021 stats., and s. 281.60
249-(13) (h), 2021 stats., shall continue to apply to any out-
250-standing loans made under the former land recycling loan
251-program under s. 281.60, 2021 stats.
252-SECTION 27m. Chapter NR 167 of the administrative
253-code is repealed.

17+Under the environmental improvement fund, the state provides financial
18+assistance to local governmental units for certain projects. The environmental
19+improvement fund is made up of three programs: the clean water fund program; the
20+safe drinking water loan program; and the land recycling (brownfields) loan
21+program, which provides financial assistance for the investigation and remediation
22+of certain contaminated properties.
23+The bill eliminates the land recycling loan program, which has not provided
24+loans since 2008. Under the bill, current law provisions continue to apply to any
25+outstanding loans under the program that are in repayment. The bill also requires
26+any unallocated balance of moneys appropriated to the land recycling loan program
27+to be transferred to the clean water fund program and requires any moneys received

37+on outstanding loans after the effective date of the bill to be deposited into the clean
38+water fund program.

43+SECTION 1. 13.48 (26) of the statutes is amended to read:

248+281.59 (9) (am) The department of administration, in consultation with the
249+department, may establish those terms and conditions of a financial assistance
250+agreement that relate to its financial management, including what type of municipal
251+obligation, as set forth under sub. (13f), if applicable, is required for the repayment
252+of the financial assistance. Any terms and conditions established under this
253+paragraph by the department of administration shall comply with the requirements
254+of this section and s. 281.58, 281.60 or 281.61. In setting the terms and conditions,
255+the department of administration may consider factors that the department of

296+281.59 (11) (a) The department of natural resources and the department of
297+administration may enter into a financial assistance agreement with an applicant
298+for which the department of administration has allocated financial assistance under
299+s. 281.58 (9m), 281.60 (8) or 281.61 (8) if the applicant meets the conditions under
300+sub. (9) and the other requirements under this section and s. 281.58, 281.60 or
301+281.61.
302+SECTION 22. 281.59 (11) (b) of the statutes is amended to read:
303+281.59 (11) (b) If a municipality fails to make a principal repayment or interest
304+payment after its due date, the department of administration shall place on file a
305+certified statement of all amounts due under this section and s. 281.58, 281.60 or
306+281.61 or s. 281.60, 2021 stats. After consulting the department, the department of
307+administration may collect all amounts due by deducting those amounts from any
308+state payments due the municipality or may add a special charge to the amount of
309+taxes apportioned to and levied upon the county under s. 70.60. If the department
310+of administration collects amounts due, it shall remit those amounts to the fund to
311+which they are due and notify the department of that action.

353+that are necessary for the proper execution of this section and of its responsibilities
354+under ss. 281.58, 281.60 and 281.61 and s. 281.60, 2021 stats.
355+SECTION 26. 281.60 of the statutes is repealed.

361+to any outstanding loans made under the former land recycling loan program under
362+s. 281.60, 2021 stats.

256-BALANCE.  All moneys appropriated for the land recycling
257-loan program under s. 281.60, 2021 stats., that are unallo-
