1313 AN ACT to amend 450.095 (title) and 450.095 (3); and to create 49.46 (2) (bg),
1414 450.01 (16) (L), 450.095 (1) (ag) and (ar) and 450.095 (2m) of the statutes;
1515 relating to: permitting pharmacists to prescribe certain contraceptives,
1616 extending the time limit for emergency rule procedures, providing an
1717 exemption from emergency rule procedures, granting rule-making authority,
1818 and providing a penalty.

2020 This bill permits a pharmacist to prescribe and dispense hormonal
2121 contraceptive patches and self-administered oral hormonal contraceptives, subject
2222 to limitations described as follows.
2323 The bill requires the Pharmacy Examining Board, after consultation with the
2424 Medical Examining Board, the Board of Nursing, and the Department of Health
2525 Services, to promulgate rules to establish standard procedures for the prescribing of
2626 contraceptives by pharmacists under the bill.  The rules must include a
2727 self-assessment questionnaire, developed in consideration of guidelines established
2828 by the American Congress of Obstetricians and Gynecologists, that must be used by
2929 a pharmacist when prescribing a contraceptive.  The rules must include certain
3030 requirements for pharmacists prescribing contraceptives, such as 1) requiring a
3131 report to the patient's primary health care practitioner following a prescription, and
3232 2) requiring the contraceptive to be dispensed as soon as practicable after the

4141 pharmacist issues the prescription order.  In addition, the rules must prohibit a
4242 pharmacist from prescribing or dispensing a contraceptive to a patient unless 1) the
4343 patient has responded to the self-assessment questionnaire and undergone a blood
4444 pressure screening; 2) the use of the contraceptive is not contraindicated based upon
4545 the results of the questionnaire and screening; and 3) the patient acknowledges on
4646 the self-assessment questionnaire that a contraceptive is not protection against
4747 sexually transmitted diseases and that it is strongly recommended that the patient
4848 annually meet with a physician or other medical professional to discuss the patient's
4949 hormonal contraceptive treatment and other routine preventive care.  A pharmacist
5050 who prescribes contraceptives as permitted under the bill must comply with those
5151 rules, as well as any other rules promulgated by the Pharmacy Examining Board.
5252 Finally, under the bill, a pharmacist may prescribe a contraceptive only to a person
5353 who is at least 18 years of age.
5454 The bill further requires DHS to ensure any contraceptives or contraceptive
5555 services covered under the Medical Assistance program are covered and reimbursed
5656 when prescribed, if a prescription is required under federal law, or provided by a
5757 pharmacist acting under the scope of his or her practice.  The Medical Assistance
5858 program is a joint federal and state program that provides health services to
5959 individuals who have limited financial resources.  The bill also requires DHS to
6060 certify pharmacists as providers of Medical Assistance services for the purposes of
6161 covering and reimbursing prescribed hormonal contraceptive patches and
6262 self-administered oral hormonal contraceptives.
6363 For further information see the state fiscal estimate, which will be printed as
6464 an appendix to this bill.
6565 The people of the state of Wisconsin, represented in senate and assembly, do
6666 enact as follows:
6767 SECTION 1. 49.46 (2) (bg) of the statutes is created to read:
6868 49.46 (2) (bg)  The department shall ensure that any contraceptives, including
6969 contraceptive drugs or drug products, or contraceptive services that are covered
7070 under this subsection and for which reimbursement is made to any provider are
7171 covered and reimbursed when prescribed, if a prescription is required under federal
7272 law, or provided by a pharmacist acting under his or her scope of practice, including
7373 under s. 450.095 (2m).  The department shall certify pharmacists as providers of
7474 Medical Assistance services for the purposes of covering and reimbursing under this
7575 paragraph services that are provided under s. 450.095 (2m).

8989 SECTION 2. 450.01 (16) (L) of the statutes is created to read:
9090 450.01 (16) (L)  Prescribing and dispensing hormonal contraceptive patches
9191 and self-administered oral hormonal contraceptives pursuant to s. 450.095 (2m).
9292 SECTION 3. 450.095 (title) of the statutes is amended to read:
9393 450.095 (title)  Duty to dispense Prescribing and dispensing
9494 contraceptives.
9595 SECTION 4. 450.095 (1) (ag) and (ar) of the statutes are created to read:
9696 450.095 (1) (ag)  “Hormonal contraceptive patch" means a transdermal patch
9797 applied to the skin of a patient, by the patient or by a practitioner, that releases a
9898 drug composed of a combination of hormones that is approved by the federal food and
9999 drug administration to prevent pregnancy.
100100 (ar)  “Self-administered oral hormonal contraceptive" means a drug composed
101101 of a combination of hormones that is approved by the federal food and drug
102102 administration to prevent pregnancy and that the patient to whom the drug is
103103 prescribed may take orally.
104104 SECTION 5. 450.095 (2m) of the statutes is created to read:
105105 450.095 (2m) (a)  In accordance with rules promulgated by the board, a
106106 pharmacist may prescribe and dispense hormonal contraceptive patches and
107107 self-administered oral hormonal contraceptives to a person who is at least 18 years
108108 of age.
109109 (b) 1.  The board shall, after consultation with the medical examining board, the
110110 board of nursing, and the department of health services, promulgate rules to
111111 establish standard procedures for the prescribing of hormonal contraceptive patches
112112 and self-administered oral hormonal contraceptives by pharmacists under this
113113 subsection.

141141 2. a.  The rules promulgated under subd. 1. shall include a self-assessment
142142 questionnaire, developed in consideration of guidelines established by the American
143143 Congress of Obstetricians and Gynecologists, that must be used by a pharmacist as
144144 described in subd. 3. a.
145145 b.  The self-assessment questionnaire shall state and the patient shall
146146 acknowledge on the self-assessment questionnaire that a hormonal contraceptive
147147 patch or a self-administered oral hormonal contraceptive is not protection against
148148 sexually transmitted diseases, which may have a significant negative impact on
149149 reproductive and general health.
150150 c.  The patient shall acknowledge on the self-assessment questionnaire that it
151151 is strongly recommended that the patient annually meet with a physician or other
152152 medical professional to discuss the patient's prescribed hormonal contraceptive
153153 treatment and other routine preventive care.
154154 3.  The rules promulgated under subd. 1. shall require a pharmacist to do all
155155 of the following:
156156 a.  Provide the self-assessment questionnaire described in subd. 2. to a patient
157157 prior to the pharmacist's prescribing the hormonal contraceptive patch or
158158 self-administered oral hormonal contraceptive to the patient.
159159 b.  Report to the patient's primary care practitioner upon prescribing and
160160 dispensing the hormonal contraceptive patch or self-administered oral hormonal
161161 contraceptive.
162162 c.  Provide the patient with a written record of the hormonal contraceptive
163163 patch or self-administered oral hormonal contraceptive prescribed and dispensed.

191191 d.  Dispense the hormonal contraceptive patch or self-administered oral
192192 hormonal contraceptive to the patient as soon as practicable after the pharmacist
193193 issues the prescription order.
194194 4.  The rules promulgated under subd. 1. shall prohibit a pharmacist from
195195 prescribing and dispensing a hormonal contraceptive patch or self-administered
196196 oral hormonal contraceptive to a patient unless all of the following apply:
197197 a.  The patient has responded to the self-assessment questionnaire provided
198198 under subd. 3. a. and undergone a blood pressure screening.
199199 b.  The use of the hormonal contraceptive patch or self-administered oral
200200 hormonal contraceptive by the patient is not contraindicated based upon the results
201201 of the questionnaire and screening.
202202 5.  The rules promulgated under subd. 1. shall permit any qualified pharmacy
203203 employee to provide a self-assessment questionnaire required under subd. 3. a. and
204204 administer a blood pressure screening required under subd. 4. a. if a pharmacist
205205 reviews the results of the self-assessment questionnaire and the blood pressure
206206 screening before prescribing and dispensing any hormonal contraceptive patch or
207207 self-administered oral hormonal contraceptive to a patient.
208208 SECTION 6. 450.095 (3) of the statutes is amended to read:
209209 450.095 (3)  Any person who violates this section or any rules promulgated
210210 under this section may be required to forfeit not less than $250 nor more than $2,500
211211 for each violation.
212212 SECTION 7.0Nonstatutory provisions.
213213 (1)  The pharmacy examining board may promulgate emergency rules under s.
214214 227.24 necessary to implement this act.  Notwithstanding s. 227.24 (1) (c) and (2),
215215 emergency rules promulgated under this subsection remain in effect until May 1,

243243 2025, or the date on which permanent rules take effect, whichever is sooner.
244244 Notwithstanding s. 227.24 (1) (a) and (3), the examining board is not required to
245245 provide evidence that promulgating a rule under this subsection as an emergency
246246 rule is necessary for the preservation of the public peace, health, safety, or welfare
247247 and is not required to provide a finding of emergency for a rule promulgated under
248248 this subsection.
249249 SECTION 8.0Effective dates. This act takes effect on January 1, 2025, except
250250 as follows:
251251 (1)  SECTION 7 (1) of this act takes effect on the day after publication.
