1212 AN ACT to amend 13.121 (4); and to create 13.121 (5) of the statutes; relating
1313 to: sick leave for state legislators.
1414 Analysis by the Legislative Reference Bureau
1515 Under current law, state legislators and state employees are generally entitled
1616 to receive paid sick leave as part of their compensation. If a state legislator or
1717 employee does not use all of his or her sick leave during a calendar year, he or she
1818 may accumulate unused sick leave from year to year in a sick leave account.
1919 Generally, if a state legislator leaves office or a state employee terminates
2020 employment and meets certain conditions related to age or years of employment, his
2121 or her accumulated unused sick leave may be converted, at his or her highest basic
2222 pay rate, to credits for the payment of postretirement health insurance premiums
2323 under a health insurance plan administered by the Group Insurance Board.
2424 This bill provides that no state legislator may accrue any new sick leave as a
2525 state legislator during any term of office that begins after the bill's effective date. The
2626 bill does not affect any sick leave accrued by a state legislator during a term of office
2727 that began before the bill's effective date.

3030 The people of the state of Wisconsin, represented in senate and assembly, do
3131 enact as follows:

3636 SECTION 1. 13.121 (4) of the statutes is amended to read:
3737 13.121 (4) INSURANCE. For the purpose of premium determinations under s.
3838 40.05 (4) and (5) each member of the legislature shall accrue sick leave at a rate
3939 equivalent to a percentage of time worked recommended for such positions by the
4040 administrator of the division of personnel management in the department of
4141 administration and approved by the joint committee on employment relations in the
4242 same manner as compensation for such positions is determined under s. 20.923,
4343 except as provided in sub. (5). This percentage of time worked shall be applied to the
4444 sick leave accrual rate established under s. 230.35 (2). The approved percentage
4545 shall be incorporated into the compensation plan under s. 230.12 (1).
4646 SECTION 2. 13.121 (5) of the statutes is created to read:
4747 13.121 (5) SICK LEAVE. No member of the legislature may accrue any new sick
4848 leave as a member of the legislature during any term of office that begins after the
4949 effective date of this subsection .... [LRB inserts date]. Nothing in this subsection
5050 affects any sick leave accrued by a member of the legislature during a term of office
5151 that began before the effective date of this subsection .... [LRB inserts date].
