11	11	AN ACT to create 20.465 (3) (qs) and 256.35 (3s) (bx) of the statutes; relating to:
12	12	grants for incumbent local exchange carriers for costs associated with Next
13	13	Generation 911 and making an appropriation.
14	14	Analysis by the Legislative Reference Bureau
15	15	Under current law, the Department of Military Affairs must award grants to
16	16	public safety answering points, more commonly known as 911 call centers, for a
17	17	variety of purposes related to advanced 911 operations, known as Next Generation
18	18	911. In addition, under a separate grant program, DMA must award grants to county
19	19	land information offices for the purpose of preparing geographic information systems
20	20	data to help enable Next Generation 911.
21	21	This bill creates an additional grant program under which DMA must award
22	22	grants to incumbent local exchange carriers operating as originating service
23	23	providers for the reimbursement of the incumbent local exchange carriers' certain
24	24	various costs associated Next Generation 911. An “incumbent local exchange
25	25	carrier” is defined under the bill to have the same meaning as it does under federal
26	26	law. An “originating service provider” is an entity that provides a service that may
27	27	be used to generate a request for emergency assistance and that may connect to an
28	28	emergency number system.

36	36	The people of the state of Wisconsin, represented in senate and assembly, do
37	37	enact as follows:
38	38	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
39	39	the following amounts for the purposes indicated:

45	45	SECTION 2. 20.465 (3) (qs) of the statutes is created to read:
46	46	20.465 (3) (qs) Grant program for incumbent local exchange carriers.
47	47	Biennially, from the police and fire protection fund, the amounts in the schedule for
48	48	the department to provide grants under s. 256.35 (3s) (bx).
49	49	SECTION 3. 256.35 (3s) (bx) of the statutes is created to read:
50	50	256.35 (3s) (bx) Grant program for incumbent local exchange carriers. 1. In
51	51	this paragraph, “incumbent local exchange carrier” has the meaning given in 47 USC
52	52	251 (h).
53	53	2. From the appropriation under s. 20.465 (3) (qs), the department shall award
54	54	grants to incumbent local exchange carriers operating as originating service
55	55	providers for the reimbursement of the incumbent local exchange carriers' costs
56	56	associated with the IP-based transport of Next Generation 911, the database used
57	57	to operate Next Generation 911, and the purchase, installation, and maintenance of

81	81	Next Generation 911 equipment. An incumbent local exchange carrier is not eligible
82	82	for a grant under this subdivision unless it is acting as an incumbent local exchange
83	83	carrier in this state on the effective date of this subdivision .... [LRB inserts date].
84	84	3. The department shall develop a policy that establishes eligibility criteria for
85	85	grants under subd. 2. The department may seek recommendations from the 911
86	86	subcommittee on the awarding of grants under subd. 2., including advice on
87	87	appropriate grant purposes and eligibility criteria for grants.
88	88	4. The department may not award more than one grant under subd. 2. per
89	89	incumbent local exchange carrier per fiscal year.
