10	10	AN ACT to create 85.27 of the statutes; relating to: a driver education grant
11	11	program.

13	13	This bill requires the Department of Transportation to establish a driver
14	14	education grant program under which it may provide grants to a person enrolled or
15	15	seeking to be enrolled in a driver education course or a provider of such a course. The
16	16	amount of a grant under this program may not exceed the cost to the person of the
17	17	course of driver education in which the person is enrolled or seeking to be enrolled
18	18	or the cost to the provider of providing driver education to persons under 20 years
19	19	of age enrolled in the provider's course.
20	20	For further information see the state fiscal estimate, which will be printed as
21	21	an appendix to this bill.
22	22	The people of the state of Wisconsin, represented in senate and assembly, do
23	23	enact as follows:
24	24	SECTION 1. 85.27 of the statutes is created to read:
25	25	85.27 Driver education grant program. (1) The department shall
26	26	establish and administer a driver education grant program. Under the program,

34	34	from the appropriation under s. 20.395 (5) (eq), the department may provide grants
35	35	to any of the following, upon application:
36	36	(a) A person who satisfies all of the following:
37	37	1. The person is enrolled or seeking to be enrolled in a course of driver education
38	38	provided by any of the following:
39	39	a. A public school providing a course in driver education approved by the
40	40	department of public instruction or the department of transportation.
41	41	b. A technical college providing a course in driver education approved by the
42	42	technical college system board.
43	43	c. A nonpublic or private school or tribal school, as defined in s. 115.001 (15m),
44	44	providing a course in driver education that meets the minimum standards set by the
45	45	department of public instruction.
46	46	d. A school licensed by the department under s. 343.61.
47	47	2. The person satisfies the income eligibility criteria for a free or reduced-price
48	48	lunch in the federal school lunch program under 42 USC 1758 (b) (1).
49	49	(b) A provider of a course in driver education that satisfies all of the following:
50	50	1. The provider is any of the following:
51	51	a. A public school providing a course in driver education approved by the
52	52	department of public instruction or department of transportation.
53	53	b. A technical college providing a course in driver education approved by the
54	54	technical college system board.
55	55	c. A nonpublic or private school or tribal school, as defined in s. 115.001 (15m),
56	56	providing a course in driver education that meets the minimum standards set by the
57	57	department of public instruction.
58	58	d. A school licensed by the department under s. 343.61.

88	88	2. The provider provides classroom or behind-the-wheel driver instruction or
89	89	both.
90	90	(2) (a) The amount of a grant under sub. (1) (a) may not exceed the cost to the
91	91	person of the course of driver education in which the person is enrolled or seeking to
92	92	be enrolled.
93	93	(b) The amount of a grant under sub. (1) (b) may not exceed the cost to the
94	94	provider of providing driver education to persons under 20 years of age enrolled in
95	95	the provider's course.
