15 | 15 | | A “wholesaler” is defined as a person, other than a licensed motor vehicle dealer or |

16 | 16 | | motor vehicle auction dealer, who 1) sells more than five used motor vehicles in any |
---|
17 | 17 | | 12-month period to motor vehicle dealers, motor vehicle auction dealers, or salvage |
---|
18 | 18 | | dealers; 2) purchases used motor vehicles from a motor vehicle dealer or at a motor |
---|
19 | 19 | | vehicle auction for the purpose of selling the vehicles to a motor vehicle dealer, motor |
---|
20 | 20 | | vehicle auction, or wholesaler; or 3) purchases used motor vehicles on behalf of a |
---|
21 | 21 | | motor vehicle dealer. |
---|
22 | 22 | | This bill provides that a motor vehicle wholesaler may not engage in business |
---|
23 | 23 | | in this state unless he or she maintains a permanent business location, with indoor |
---|
24 | 24 | | office space, in this state. The bill provides that a business location does not meet |
---|
25 | 25 | | this requirement if more than one licensed wholesale dealer is located under the |
---|
26 | 26 | | same roof or if the office space 1) is common space or shared with other tenants; 2) |
---|
27 | 27 | | is rented by the hour or day; 3) contains cubicles; or 4) is temporary, virtual, or |
---|
28 | 28 | | rotating. |

37 | 37 | | SECTION 1. 218.0114 (1e) of the statutes is created to read: |

38 | 38 | | 218.0114 (1e) No motor vehicle wholesaler may engage in business in this state |
---|
39 | 39 | | unless he or she maintains a permanent business location, with indoor office space, |
---|
40 | 40 | | in this state. A business location does not meet the requirements of this subsection |

41 | 41 | | if any of the following applies: |
---|
42 | 42 | | (a) The office space is common space or shared with other tenants. |
---|
43 | 43 | | (b) The office space is rented by the hour or day. |
---|
44 | 44 | | (c) The office space contains cubicles. |
---|
45 | 45 | | (d) The office space is temporary, virtual, or rotating. |
---|
46 | 46 | | (e) More than one licensed motor vehicle wholesaler is located under the same |
---|
47 | 47 | | roof. |
