11		-	The people of the state of Wisconsin, represented in
12		-	senate and assembly, do enact as follows:
13		-	SECTION 1. 118.29 (1) (bm) of the statutes is
14		-	repealed.
15		-	SECTION 2. 118.29 (1) (br) of the statutes is created
16		-	to read:
17		-	118.29 (1) (br) “Epinephrine delivery system” means
18		-	a device that is approved by the federal food and drug
19		-	administration, that contains a premeasured dose of epi-
20		-	nephrine, and that is used to administer epinephrine into
21		-	the human body to prevent or treat a life−threatening
22		-	allergic reaction.
23		-	SECTION 3. 118.29 (2) (a) 2m. of the statutes is
24		-	amended to read:
25		-	118.29 (2) (a) 2m. Except for epinephrine adminis-
26		-	tered under subd. 2., may use an epinephrine auto−injec-
27		-	tor, or prefilled syringe, as defined in s. 118.292 (1g)
28		-	(bm), epinephrine delivery system to administer epi-
29		-	nephrine to any pupil who appears to be experiencing a
30		-	severe allergic reaction if, as soon as practicable, the
31		-	school bus operator, employee or volunteer reports the
32		-	allergic reaction by dialing the telephone number “911”
33		-	or, in an area in which the telephone number “911” is not
34		-	available, the telephone number for an emergency medi-
35		-	cal service provider.
36		-	SECTION 4. 118.292 (1g) (b) of the statutes is
37		-	repealed.
38		-	SECTION 5. 118.292 (1g) (bg) of the statutes is cre-
39		-	ated to read:
40		-	118.292 (1g) (bg) “Epinephrine delivery system”
41		-	means a device that is approved by the federal food and
42		-	drug administration, that contains a premeasured dose of

57		-	SECTION 8. 118.292 (1r) (a) of the statutes is

61		-	to prevent the onset or alleviate the symptoms of an emer-
62		-	gency situation.
63		-	SECTION 9. 118.292 (2) (a) of the statutes is amended

	21	+	This bill amends current law authority related to the possession,
	22	+	administration, and dispensing of epinephrine auto-injectors and prefilled syringes
	23	+	of epinephrine to instead include all epinephrine delivery systems. Under the bill,
	24	+	“epinephrine delivery system” is defined to mean a device that is approved by the
	25	+	federal Food and Drug Administration, that contains a dose of epinephrine, and that

	38	+	is used to administer epinephrine into the human body to prevent or treat a
	39	+	life-threatening allergic reaction.
	40	+	Current law allows designated school personnel, school nurses, and other
	41	+	authorized entities and individuals who have completed a training program to
	42	+	provide or administer epinephrine auto-injectors and prefilled syringes to pupils
	43	+	and other individuals. “Authorized entities” are those entities or organizations that
	44	+	operate or participate in a business, activity, or event where anaphylaxis-causing
	45	+	allergens may be present. Authorized entities include restaurants, camps,
	46	+	institutions of higher education, places of employment, amusement parks, and
	47	+	sports leagues and arenas. The bill allows the same individuals and entities to
	48	+	provide or administer any epinephrine delivery system.
	49	+	Under current law, pupils are also allowed to possess and use an epinephrine
	50	+	auto-injector or a prefilled syringe in certain circumstances while in school,
	51	+	participating in a school-sponsored activity, or under supervision by a school. Under
	52	+	the bill, pupils are allowed to possess and use any epinephrine delivery system under
	53	+	those same circumstances.
	54	+	In addition, current law allows prescribers to prescribe epinephrine
	55	+	auto-injectors and prefilled syringes in the name of the school or the name of the
	56	+	authorized entity or individual. The bill provides prescribing authority for any
	57	+	epinephrine delivery system.
	58	+	Finally, current law allows any prescriber to issue a standing order or a
	59	+	statewide standing order for the dispensing of epinephrine auto-injectors or
	60	+	prefilled syringes for use by trained individuals. The bill allows prescribers to issue
	61	+	a standing order or statewide standing orders for any epinephrine delivery system
	62	+	for use by trained individuals.

	65	+	The people of the state of Wisconsin, represented in senate and assembly, do
	66	+	enact as follows:
	67	+	SECTION 1. 118.29 (1) (bm) of the statutes is repealed.

	190	+	prescription specific to the pupil that is on file with the school.
	191	+	(b) Administer an epinephrine auto-injector or prefilled syringe epinephrine
	192	+	delivery system to a pupil in accordance with a prescription specific to the pupil that

110		-	(c) Administer an epinephrine auto−injector or pre-
111		-	filled syringe epinephrine delivery system to a pupil or
112		-	other person who the school nurse or designated school
113		-	personnel in good faith believes is experiencing anaphy-
114		-	laxis in accordance with a standing protocol from a
115		-	physician, an advanced practice nurse prescriber, or a
116		-	physician assistant, regardless of whether the pupil or
117		-	other person has a prescription for an epinephrine auto−
118		-	injector or prefilled syringe epinephrine delivery system.
119		-	If the pupil or other person does not have a prescription
120		-	for an epinephrine auto−injector or prefilled syringe, epi-
121		-	nephrine delivery system, or the person who administers
122		-	the epinephrine auto−injector or prefilled syringe epi-
123		-	nephrine delivery system does not know whether the
124		-	pupil or other person has a prescription for an epineph-
125		-	rine auto−injector or prefilled syringe epinephrine deliv-
126		-	ery system, the person who administers the epinephrine
127		-	auto−injector or prefilled syringe epinephrine delivery
128		-	system shall, as soon as practicable, report the adminis-
129		-	tration by dialing the telephone number “911” or, in an
130		-	area in which the telephone number “911” is not avail-
131		-	able, the telephone number for an emergency medical
132		-	service provider.
133		-	SECTION 17. 118.2925 (4m) (a) of the statutes is
134		-	amended to read:
135		-	118.2925 (4m) (a) The authority to self−administer
136		-	an epinephrine auto−injector or prefilled syringe epi-
137		-	nephrine delivery system under sub. (4) (a) is indepen-
138		-	dent of the authorized possession and use of an epineph-
139		-	rine auto−injector or prefilled syringe epinephrine
140		-	delivery system under s. 118.292 (1r).
141		-	SECTION 18. 118.2925 (4m) (b) of the statutes is
142		-	amended to read:
143		-	118.2925 (4m) (b) The authority to administer an
144		-	epinephrine auto−injector or prefilled syringe epineph-
145		-	rine delivery system under sub. (4) (b) and (c) is indepen-
146		-	dent of the authority to administer an epinephrine auto−
147		-	injector epinephrine delivery system under s. 118.29 (2)
148		-	(a) 2. and 2m.
149		-	SECTION 19. 118.2925 (5) of the statutes is amended
150		-	to read:
151		-	118.2925 (5) IMMUNITY FROM CIVIL LIABILITY; EXEMP-
152		-	TION FROM PRACTICE OF MEDICINE. A school and its desig-
153		-	nated school personnel, and a physician, advanced prac-
154		-	tice nurse prescriber, or physician assistant who provides
155		-	a prescription or standing protocol for school epineph-
156		-	rine auto−injectors or prefilled syringes epinephrine
157		-	delivery systems, are not liable for any injury that results
158		-	from the administration or self−administration of an epi-
159		-	nephrine auto−injector or prefilled syringe epinephrine
160		-	delivery system under this section, regardless of whether
161		-	authorization was given by the pupil’s parent or guardian
162		-	or by the pupil’s physician, physician assistant, or
163		-	advanced practice nurse prescriber, unless the injury is

165		-	ligence or willful or wanton misconduct. The immunity
166		-	from liability provided under this subsection is in addi-
167		-	tion to and not in lieu of that provided under s. 895.48.

	195	+	delivery system to a pupil or other person who the school nurse or designated school

211		-	system in a location readily accessible in an emergency
212		-	and in accordance with the epinephrine auto−injector’s or
213		-	prefilled syringe’s epinephrine delivery system’s instruc-
214		-	tions for use. An authorized entity shall designate an
215		-	employee or agent who has completed the training
216		-	required in sub. (5) to be responsible for the storage,
217		-	maintenance, control, and general oversight of epineph-
218		-	rine auto−injectors or prefilled syringes epinephrine
219		-	delivery systems acquired by the authorized entity.
220		-	SECTION 26. 255.07 (4) of the statutes is amended to
221		-	read:
222		-	255.07 (4) USE OF EPINEPHRINE. An employee or
223		-	agent of an authorized entity who has completed the
224		-	training required by sub. (5) or an authorized individual
225		-	may use an epinephrine auto−injector or prefilled syringe
226		-	epinephrine delivery system prescribed under sub. (2) to
227		-	do any of the following:
228		-	(a) Provide one or more epinephrine auto−injectors
229		-	or prefilled syringes epinephrine delivery systems to any
230		-	individual who the employee, agent, or authorized indi-
231		-	vidual believes in good faith is experiencing anaphylaxis,
232		-	or to the parent, guardian, or caregiver of that individual
233		-	for immediate administration, regardless of whether the
234		-	individual has a prescription for an epinephrine auto−
235		-	injector or prefilled syringe epinephrine delivery system
236		-	or has previously been diagnosed with an allergy.
237		-	(b) Administer an epinephrine auto−injector or pre-
238		-	filled syringe epinephrine delivery system to any individ-
239		-	ual who the employee, agent, or authorized individual
240		-	believes in good faith is experiencing anaphylaxis,
241		-	regardless of whether the individual has a prescription for
242		-	an epinephrine auto−injector or prefilled syringe epi-
243		-	nephrine delivery system or has previously been diag-
244		-	nosed with an allergy.

310		-	imposes any duty, obligation, or basis for liability on any
311		-	authorized entity, or employees, agents, or authorized
