11	11	AN ACT to amend 41.62 (3), 247.03 (2) (a), 247.03 (2) (d) and 247.03 (2) (e) of the
12	12	statutes; relating to: the Wisconsin Artistic Endowment Foundation and the
13	13	Wisconsin regranting program.

15	15	This bill changes the membership of the Wisconsin Artistic Endowment
16	16	Foundation and makes various changes to WAEF and the Wisconsin regranting
17	17	program administered by the Arts Board. WAEF is a nonprofit corporation created
18	18	by 2001 Wisconsin Act 16 to support arts programs through tax deductible
19	19	contributions. The WAEF is currently inactive.
20	20	Current law provides that WAEF's board of directors is to be composed of 14
21	21	members: eight nominees of the governor, two representatives to the assembly, two
22	22	senators, the chairperson of the Arts Board or his or her designee, and the executive
23	23	secretary of the Arts Board, as a nonvoting member. The bill changes the
24	24	composition of the board of directors to four nominees of the governor, four
25	25	representatives to the assembly, four senators, the chairperson of the Arts Board or
26	26	his or her designee; and the executive secretary of the Arts Board, as a nonvoting
27	27	member. Under the bill, all of those appointments must be made on or before July
28	28	1, 2024.
29	29	Under current law, WAEF may distribute moneys from the artistic endowment
30	30	fund to the Wisconsin regranting program, which is administered by the Arts Board
31	31	to award grants to local arts agencies and municipalities. Under current law, a
32	32	recipient of a grant under the program must make a matching fund contribution

38	38	equal to the amount of the grant awarded. Private funds and in-kind contributions
39	39	may be applied to meet this requirement. The bill adds a requirement that the
40	40	matching fund contribution be from a nonstate funding source.

42	42	an appendix to this bill.
43	43	The people of the state of Wisconsin, represented in senate and assembly, do
44	44	enact as follows:
45	45	SECTION 1. 41.62 (3) of the statutes is amended to read:
46	46	41.62 (3) No grant may be distributed under sub. (2) unless the local arts
47	47	agency or municipality makes a matching fund contribution from a nonstate funding
48	48	source that is equal to the amount of the grant awarded under this section. Private
49	49	funds and in-kind contributions may be applied to meet the requirement of this
50	50	subsection.
51	51	SECTION 2. 247.03 (2) (a) of the statutes is amended to read:
52	52	247.03 (2) (a) Eight Four nominees of the governor, who are residents of this
53	53	state, represent the diverse artistic interests of the people of this state, and each
54	54	represent each of the different geographic regions of the state, appointed for 7-year
55	55	terms with the advice and consent of the senate. At least one of the nominees shall
56	56	be knowledgeable in marketing and fund raising. Each member appointed under
57	57	this paragraph may hold office until a successor is appointed.
58	58	SECTION 3. 247.03 (2) (d) of the statutes is amended to read:
59	59	247.03 (2) (d) Two Four representatives to the assembly, one 3 appointed by the
60	60	speaker of the assembly and one appointed by the minority leader of the assembly.
61	61	SECTION 4. 247.03 (2) (e) of the statutes is amended to read:
62	62	247.03 (2) (e) Two Four senators, one 3 appointed by the majority leader of the
63	63	senate and one appointed by the minority leader of the senate.

88	88	(1) APPOINTMENT OF MEMBERS OF THE BOARD OF DIRECTORS.
89	89	(a) Members of the board of directors of the Wisconsin Artistic Endowment
90	90	Foundation who were appointed more than 7 years before the effective date of this
91	91	subsection may not hold office after the effective date of this subsection, regardless
92	92	of whether a successor has been appointed.
93	93	(b) The appointing authorities under s. 247.03 (2) shall ensure that all
94	94	members of the Wisconsin Artistic Endowment Foundation required to be appointed
95	95	under s. 247.03 (2) (a), (d), and (e) are appointed on or before July 1, 2024.
96	96	(c) Notwithstanding s. 247.03 (2) (a), of the members of the board of directors
97	97	of the Wisconsin Artistic Endowment Foundation appointed under par. (b), one of the
98	98	members appointed under s. 247.03 (2) (a) shall be appointed for a 2-year term, one
99	99	of the members appointed under s. 247.03 (2) (a) shall be appointed for a 4-year term,
100	100	and one of the members appointed under s. 247.03 (2) (a) shall be appointed for a
101	101	6-year term.
