AN ACT to amend 41.62 (3), 247.03 (2) (a), 247.03 (2) (d) and 247.03 (2) (e) of the
statutes; relating to: the Wisconsin Artistic Endowment Foundation and the
Wisconsin regranting program.

This bill changes the membership of the Wisconsin Artistic Endowment
Foundation and makes various changes to WAEF and the Wisconsin regranting
program administered by the Arts Board.  WAEF is a nonprofit corporation created
by 2001 Wisconsin Act 16 to support arts programs through tax deductible
contributions. The WAEF is currently inactive.
Current law provides that WAEF's board of directors is to be composed of 14
members: eight nominees of the governor, two representatives to the assembly, two
senators, the chairperson of the Arts Board or his or her designee, and the executive
secretary of the Arts Board, as a nonvoting member.  The bill changes the
composition of the board of directors to four nominees of the governor, four
representatives to the assembly, four senators, the chairperson of the Arts Board or
his or her designee; and the executive secretary of the Arts Board, as a nonvoting
member. Under the bill, all of those appointments must be made on or before July
1, 2024.
Under current law, WAEF may distribute moneys from the artistic endowment
fund to the Wisconsin regranting program, which is administered by the Arts Board
to award grants to local arts agencies and municipalities.  Under current law, a
recipient of a grant under the program must make a matching fund contribution

equal to the amount of the grant awarded.  Private funds and in-kind contributions
may be applied to meet this requirement.  The bill adds a requirement that the
matching fund contribution be from a nonstate funding source.

an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1.  41.62 (3) of the statutes is amended to read:
41.62 (3) No grant may be distributed under sub. (2) unless the local arts
agency or municipality makes a matching fund contribution from a nonstate funding
source that is equal to the amount of the grant awarded under this section.  Private
funds and in-kind contributions may be applied to meet the requirement of this
subsection.
SECTION 2.  247.03 (2) (a) of the statutes is amended to read:
247.03 (2) (a)  Eight Four nominees of the governor, who are residents of this
state, represent the diverse artistic interests of the people of this state, and each
represent each of the different geographic regions of the state, appointed for 7-year
terms with the advice and consent of the senate.  At least one of the nominees shall
be knowledgeable in marketing and fund raising.  Each member appointed under
this paragraph may hold office until a successor is appointed.
SECTION 3.  247.03 (2) (d) of the statutes is amended to read:
247.03 (2) (d)  Two Four representatives to the assembly, one 3 appointed by the
speaker of the assembly and one appointed by the minority leader of the assembly.
SECTION 4.  247.03 (2) (e) of the statutes is amended to read:
247.03 (2) (e)  Two Four senators, one 3 appointed by the majority leader of the
senate and one appointed by the minority leader of the senate.

SECTION 5.0Nonstatutory provisions.
(1) APPOINTMENT OF MEMBERS OF THE BOARD OF DIRECTORS.
(a) Members of the board of directors of the Wisconsin Artistic Endowment
Foundation who were appointed more than 7 years before the effective date of this
subsection may not hold office after the effective date of this subsection, regardless
of whether a successor has been appointed.
(b)  The appointing authorities under s. 247.03 (2) shall ensure that all
members of the Wisconsin Artistic Endowment Foundation required to be appointed
under s. 247.03 (2) (a), (d), and (e) are appointed on or before July 1, 2024.
(c) Notwithstanding s. 247.03 (2) (a), of the members of the board of directors
of the Wisconsin Artistic Endowment Foundation appointed under par. (b), one of the
members appointed under s. 247.03 (2) (a) shall be appointed for a 2-year term, one
of the members appointed under s. 247.03 (2) (a) shall be appointed for a 4-year term,
and one of the members appointed under s. 247.03 (2) (a) shall be appointed for a
6-year term.
