---|
14 | 14 | | committee consists of three majority party and two minority party members from |

15 | 15 | | each house. At least one member of the majority party of each house who is appointed |
---|
16 | 16 | | to the committee must also be a member of the Joint Committee on Finance. |
---|
17 | 17 | | The bill provides that any bill placing a statutory requirement on a local |
---|
18 | 18 | | governmental unit must be referred at once to the committee and the bill may not |
---|
19 | 19 | | be considered further until the committee submits a report or 30 days have lapsed. |
---|
20 | 20 | | If the committee's report concludes that the bill has a negative uncompensated fiscal |
---|
21 | 21 | | effect on local governmental units, and the mandate is a wholly state-imposed |

22 | 22 | | mandate upon local governmental units, this bill states that the committee must |

23 | 23 | | offer an amendment to the bill appropriating funds to offset the cost of the mandate. |

26 | 26 | | Additionally, the bill provides that the legislature may not enact a bill that |

38 | 38 | | mandate. Under this bill, affected local governments are reimbursed annually for |

39 | 39 | | the approximate costs attributable to state-imposed mandates. |
---|
40 | 40 | | The bill directs the Legislative Fiscal Bureau, by January 1, 2025, to identify |
---|
41 | 41 | | all mandates for the committee, other than ones having a minimal fiscal effect. The |

42 | 42 | | committee is directed to submit legislation repealing all mandates to each house of |
---|
43 | 43 | | the legislature. |
---|
44 | 44 | | The bill also requires the committee to review and evaluate existing mandates. |
---|
45 | 45 | | To carry out its duties, the committee may make investigations and hold hearings. |
---|

48 | 48 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
49 | 49 | | enact as follows: |

50 | 50 | | SECTION 1. 13.093 (2) (b) of the statutes is amended to read: |
---|
51 | 51 | | 13.093 (2) (b) Executive budget bills introduced under s. 16.47 (1) are exempt |
---|
52 | 52 | | from the fiscal estimate requirement under par. (a) but shall, if they contain a |
---|
53 | 53 | | provision affecting a public retirement fund or, providing a tax exemption, or |
---|
54 | 54 | | imposing a mandate, as defined in s. 13.59 (1) (b), be analyzed as to those provisions |
---|
55 | 55 | | by the respective joint survey committee or the joint committee on state mandates. |
---|
56 | 56 | | If such a bill imposes a mandate, as defined in s. 13.59 (1) (b), the bill shall be |
---|
57 | 57 | | simultaneously referred to the joint committee on state mandates and the joint |
---|
58 | 58 | | committee on finance. If such a bill contains a provision providing a tax exemption, |
---|
59 | 59 | | the bill shall be simultaneously referred to the joint survey committee on tax |
---|
60 | 60 | | exemptions and the joint committee on finance. The report of the joint survey |
---|
61 | 61 | | committee on tax exemptions shall be prepared within 60 days of introduction for |
---|
62 | 62 | | bills introduced under s. 16.47 (1). |

94 | 94 | | (3) COMMITTEE PROCEDURES. (a) The committee shall meet at the call of its |

96 | 96 | | (b) All actions of the committee require the approval of a majority of all of the |
---|
97 | 97 | | members. |
---|
98 | 98 | | (4) POWERS AND DUTIES. (a) The committee shall do all of the following: |
---|
99 | 99 | | 1. Provide the legislature with a report under sub. (5) concerning each bill that |
---|
100 | 100 | | would impose a mandate. |
---|
101 | 101 | | 2. On a regular basis, review existing mandates and evaluate their desirability |
---|
102 | 102 | | as a matter of public policy, cost-effectiveness, and financial responsibility. |
---|
103 | 103 | | (b) The committee may make investigations and hold hearings. |
---|
104 | 104 | | (5) REPORT. (a) Upon the introduction in either house of the legislature of a bill |
---|
105 | 105 | | that would impose a mandate, the bill shall at once be referred to the joint committee |
---|
106 | 106 | | on state mandates by the presiding officer, unless the presiding officer determines |
---|
107 | 107 | | that the mandate has a minimal fiscal effect on local governmental units. The bill |

145 | 145 | | is addressing a requirement imposed by the federal government. |

146 | 146 | | 5. Explaining the effect of the mandate contained in the bill on the revenues |

147 | 147 | | and expenditures of state government and local governmental units, including an |
---|
148 | 148 | | explanation as to whether unrestricted or restricted state aid, grants, or tax benefits |
---|
149 | 149 | | are currently being provided or potentially available under existing law to meet the |

197 | 197 | | attached to it as are amendments. The reproduction shall be in lieu of inclusion in |

198 | 198 | | the daily journal of the house in which the bill is introduced. |

199 | 199 | | (6) IDENTIFICATION OF MANDATES. (a) The legislative fiscal bureau shall identify |
